{"id":55691,"date":"2022-07-05T12:06:52","date_gmt":"2022-07-05T20:06:52","guid":{"rendered":"https:\/\/cannabiscultivatornews.com\/home\/index.php\/2022\/07\/05\/minnesota-house-leader-says-new-law-allowing-thc-edibles-was-intentional-step-toward-marijuana-legalization\/"},"modified":"2022-07-05T20:45:38","modified_gmt":"2022-07-06T04:45:38","slug":"minnesota-house-leader-says-new-law-allowing-thc-edibles-was-intentional-step-toward-marijuana-legalization","status":"publish","type":"post","link":"https:\/\/cannabiscultivatornews.com\/home\/index.php\/2022\/07\/05\/minnesota-house-leader-says-new-law-allowing-thc-edibles-was-intentional-step-toward-marijuana-legalization\/","title":{"rendered":"Minnesota House Leader Says New Law Allowing THC Edibles Was \u2018Intentional\u2019 Step Toward Marijuana Legalization"},"content":{"rendered":"<p><img loading=\"lazy\" src=\"https:\/\/cannabiscultivatornews.com\/home\/wp-content\/uploads\/2022\/07\/MM_Bill_Tracker_V5_blank-21.jpg\" width=\"1500\" height=\"1500\"> <\/p>\n<p>The Democratic leader of the Minnesota House of Representatives said on Tuesday that passing the state\u2019s newly enacted law <a href=\"https:\/\/www.marijuanamoment.net\/minnesota-law-legalizing-thc-cannabis-edibles-takes-effect-prompting-pushback-from-key-gop-senator-who-voted-for-it\/\" target=\"_blank\" rel=\"noopener\">allowing low-THC edibles for adults<\/a> was an \u201cintentional\u201d legislative step meant to open the door to broader marijuana legalization that is opposed by many Republican colleagues who ultimately voted for the incremental reform.<\/p>\n<p>At a press briefing, House Majority Leader Ryan Winkler (DFL), who has consistently <a href=\"https:\/\/www.marijuanamoment.net\/minnesota-republican-senators-block-marijuana-legalization-vote\/\" target=\"_blank\" rel=\"noopener\">championed legalization in the legislature<\/a>, emphasized that the legislation that took effect last week was debated and passed in a public forum, so GOP members who have since expressed reservations about the edibles provisions after voting in favor of the bill don\u2019t exactly have an excuse.<\/p>\n<p>In the end, Republican lawmakers in the state who don\u2019t want to see adult-use legalization only have themselves to blame for paving the path for more comprehensive marijuana legislation down the line, Winkler suggested.<\/p>\n<p>\u201cWe absolutely did this on purpose. It was an intentional step forward,\u201d the leader said, \u201cand it is an opportunity for Minnesota businesses and Minnesota consumers to have access to a product that can be safe and is widely available and used today\u2014however, through an illicit marketplace.\u201d<\/p>\n<p>He also said that he and his colleagues have been strategic by not necessarily publicizing the edible policy change in the new law, which further establishes regulations for products infused with delta-8 THC and other cannabinoids.<\/p>\n<p \/>\n<p>While the legislating that went behind this bill \u201cwas all done in the public eye,\u201d he and his colleagues felt that \u201cdrawing attention to this change in the regulatory structure\u201d before the legislation was passed might have compromised its bipartisan support.<\/p>\n<p>\u201cWe have a lot of work to do in Minnesota on cannabis legalization, but this is an important step forward\u2014and the door is now open to consumers having access to products containing THC that many of them prefer to consume,\u201d he said. \u201cI don\u2019t think we are going to go backwards.\u201d<\/p>\n<p>Winkler was joined at the press conference by bill sponsor Rep. Heather Edelson (DFL), Rep. Jess Hanson (DFL) and hemp industry stakeholders. The lawmakers discussed the new law and how it plays into their cannabis reform agenda going forward.<\/p>\n<p>The now-effective policy clarifies that adults 21 and older can possess and consume hemp-based edibles and beverages that contain up to five milligrams of THC per serving, with a maximum 50 milligrams THC per package. The products cannot contain more than 0.3 percent THC by dry weight, per state and federal hemp statute.<\/p>\n<p>The law, which Gov. Tim Walz (D) signed early last month, prompted Senate Human Services Reform Finance and Policy Committee Chairman Jim Abeler (R) to call for a rollback because he was under the impression that the bill he voted for only concerned delta-8 THC rules.<\/p>\n<p>Winkler, who is currently running for Hennepin County Attorney, responded by calling the request \u201cridiculous.\u201d<\/p>\n<p>It was the hope of activists that the enactment of the THC edibles legislation would rouse legislators to take comprehensive legalization more seriously.<\/p>\n<p><strong>\u2014<br \/>\n<strong>Marijuana Moment is <a href=\"https:\/\/www.marijuanamoment.net\/bills\/\" target=\"_blank\" rel=\"noopener\">tracking more than 1,500 cannabis, psychedelics and drug policy bills<\/a> in state legislatures and Congress this year. <a href=\"https:\/\/www.patreon.com\/marijuanamoment\" target=\"_blank\" rel=\"noopener\">Patreon supporters<\/a> pledging at least $25\/month get access to our interactive maps, charts and hearing calendar so they don\u2019t miss any developments.<\/strong><br \/>\n<a href=\"https:\/\/www.marijuanamoment.net\/bills\/\" target=\"_blank\" rel=\"noopener\"><img loading=\"lazy\" class=\"alignnone wp-image-9128 size-medium\" src=\"https:\/\/cannabiscultivatornews.com\/home\/wp-content\/uploads\/2022\/07\/MM_Bill_Tracker_V5_blank-20.jpg\" alt=\"\" width=\"300\" height=\"300\" \/><\/a><br \/>\n<strong>Learn more about our <a href=\"https:\/\/www.marijuanamoment.net\/bills\/\" target=\"_blank\" rel=\"noopener\">marijuana bill tracker<\/a> and become a <a href=\"https:\/\/www.patreon.com\/marijuanamoment\/\" target=\"_blank\" rel=\"noopener\">supporter on Patreon<\/a> to get access.<br \/>\n\u2014<\/strong><\/strong><\/p>\n<p>Edelson, who sponsored the cannabis bill, said at Tuesday\u2019s briefing that while the measure does provide new testing, labeling and packaging requirements for hemp products\u2014including restrictions on labeling that appeals to children\u2014she\u2019s aware that there are parts of the law that may be tweaked.<\/p>\n<p>Specifically, she talked about potential enforcement challenges associated with gummies, chocolates and other candies that could potentially appeal to children and are being infused with low concentrations of THC.<\/p>\n<p>\u201cLater this week, I\u2019ll be having more information about how we plan to handle that as a state,\u201d she said. \u201cThere is going to be some problems in terms of how do we enforce this.\u201d<\/p>\n<p>The governor, for his part, signaled that he\u2019d be unlikely to sign any bill scaling back the overall new policy allowing edibles if he is reelected in November, saying in a tweet last week that it is a \u201cgood first step to expand our economy, but there\u2019s more to do.\u201d<\/p>\n<p>The cannabis reform development in Minnesota is largely the result of an effort to permanently correct a legislative drafting problem that emerged after state lawmakers sought to align Minnesota\u2019s hemp policy with that of the federal government.<\/p>\n<p>Senate Minority Leader Melisa L\u00f3pez Franzen (D) tried in May to\u00a0<a href=\"https:\/\/www.marijuanamoment.net\/minnesota-republican-senators-block-marijuana-legalization-vote\/\" target=\"_blank\" rel=\"noopener\">advance broader legalization through a a procedural mechanism<\/a>\u00a0that would have required a supermajority of 41 votes to advance. But it failed, as expected. A House companion version\u00a0<a href=\"https:\/\/www.marijuanamoment.net\/minnesota-house-approves-marijuana-legalization-bill\/\" target=\"_blank\" rel=\"noopener\">did pass that full chamber last year<\/a>.<\/p>\n<p>Back in January, Winkler and\u00a0L\u00f3pez Franzen\u00a0<a href=\"https:\/\/www.marijuanamoment.net\/minnesota-democratic-leaders-preview-marijuana-legalization-plan-for-2022\/\" target=\"_blank\" rel=\"noopener\">discussed their plans to advance the cannabis reform<\/a>\u00a0this session.<\/p>\n<p>Winkler said at the time that his bill, which moved through 12 committees before\u00a0<a href=\"https:\/\/www.marijuanamoment.net\/minnesota-house-approves-marijuana-legalization-bill\/\" target=\"_blank\" rel=\"noopener\">being approved on the House floor last year<\/a>, was the \u201cproduct of hundreds of hours of work involving thousands of people\u2019s input, countless hearings and public listening sessions.\u201d<\/p>\n<p>Separately, certain Democrats including staff for Winkler have <a href=\"https:\/\/www.marijuanamoment.net\/minnesota-democratic-operatives-accused-of-plotting-to-change-marijuana-party-name-to-maga-party-to-siphon-gop-votes\/\" target=\"_blank\" rel=\"noopener\">found themselves caught up in a controversy<\/a>\u00a0over an alleged (and ultimately unsuccessful) attempt to change the name of a third party focused on marijuana that some have seen as undercutting Democratic support on the ballot in past cycles to one instead meant to appeal to far-right conservatives in an apparent attempt to siphon votes away from Republicans in the upcoming election.<\/p>\n<p>For his part, the governor\u00a0<a href=\"https:\/\/www.marijuanamoment.net\/minnesota-governor-puts-marijuana-legalization-funding-in-budget-request\/\" target=\"_blank\" rel=\"noopener\">is supportive of marijuana legalization<\/a>, and he included funding to implement the reform in his annual budget request to lawmakers in January.<\/p>\n<p>While he\u00a0<a href=\"https:\/\/www.marijuanamoment.net\/minnesota-governor-urges-lawmakers-to-pursue-marijuana-legalization-amid-budget-talks\/\" target=\"_blank\" rel=\"noopener\">declined to propose putting dollars toward implementation<\/a>\u00a0in his prior budget request, Walz said this year that he wants funding for multiple programs and departments to launch an adult-use marijuana market in line with the House-passed bill.<\/p>\n<p>Previously, in 2019, the governor\u00a0<a href=\"https:\/\/www.marijuanamoment.net\/minnesota-governor-directs-state-agencies-to-prepare-for-marijuana-legalization\/\" target=\"_blank\" rel=\"noopener\">directed state agencies to prepare to implement reform<\/a>\u00a0in anticipation of legalization eventually passing.<\/p>\n<p>While legalization wasn\u2019t ultimately enacted following the House\u2019s passage of the bill last year, the governor did sign a bill to\u00a0<a href=\"https:\/\/www.marijuanamoment.net\/minnesota-governor-signs-bill-legalizing-smokable-medical-marijuana\/\" target=\"_blank\" rel=\"noopener\">expand the state\u2019s medical marijuana program<\/a>, in part by allowing patients to access smokable cannabis products.<\/p>\n<p>A poll conducted by Minnesota lawmakers that was released last year found that\u00a0<a href=\"https:\/\/www.marijuanamoment.net\/minnesota-lawmakers-poll-shows-growing-support-for-marijuana-legalization\/\" target=\"_blank\" rel=\"noopener\">58 percent of residents are in favor of legalization<\/a>.
