It said that FDA staff and the Hawaii Department of Agriculture \u201csurveilled retail shops in Hawaii\u2019s Chinatown, including a CBD dispensary.\u201d<\/p>\n<p>\u201cAs a result, law enforcement &amp; [the state Department of Health] embargoed CBD products and arrested two people suspected of promoting harmful and\/or detrimental drugs,\u201d FDA said.<\/p>\n<blockquote class=\"twitter-tweet\" data-width=\"550\" data-dnt=\"true\">\n<p lang=\"en\" dir=\"ltr\">This May <a href=\"https:\/\/twitter.com\/hashtag\/FDAORA?src=hash&amp;ref_src=twsrc%5Etfw\" target=\"_blank\" rel=\"nofollow noopener\">#FDAORA<\/a> staff &amp; <a href=\"https:\/\/twitter.com\/hdoapio?ref_src=twsrc%5Etfw\" target=\"_blank\" rel=\"nofollow noopener\">@hdoapio<\/a> surveilled retail shops in Hawaii\u2019s Chinatown, including a <a href=\"https:\/\/twitter.com\/hashtag\/CBD?src=hash&amp;ref_src=twsrc%5Etfw\" target=\"_blank\" rel=\"nofollow noopener\">#CBD<\/a> dispensary. As a result, law enforcement &amp; <a href=\"https:\/\/twitter.com\/HawaiiDOH?ref_src=twsrc%5Etfw\" target=\"_blank\" rel=\"nofollow noopener\">@HawaiiDOH<\/a> embargoed CBD products and arrested two people suspected of promoting harmful and\/or detrimental drugs. <a href=\"https:\/\/t.co\/M5lFnPLCXW\" target=\"_blank\" rel=\"nofollow noopener\">https:\/\/t.co\/M5lFnPLCXW<\/a><\/p>\n<p>\u2014 FDA_ORA (@FDA_ORA) <a href=\"https:\/\/twitter.com\/FDA_ORA\/status\/1542244403049291777?ref_src=twsrc%5Etfw\" target=\"_blank\" rel=\"nofollow noopener\">June 29, 2022<\/a><\/p>\n<\/blockquote>\n<p \/>\n<p>A federal agency collaborating with state partners on drug enforcement isn\u2019t particularly novel on its face, but FDA\u2019s involvement did raise some eyebrows. When it comes to CBD, the agency is more commonly known to take enforcement actions like sending warning letters to companies that make misleading medical claims about their products, for example.<\/p>\n<p>\u201cThis type of operation is unique and is an example of our efforts to expand partnership opportunities with the states in areas of mutual public health and law enforcement priorities,\u201d an FDA spokesperson told Marijuana Moment on Friday. \u201cThe FDA is committed to partnering with states and have entered into a formal partnership agreement with the state of Hawai\u2019i to coordinate efforts in support of our shared public health missions.\u201d<\/p>\n<p>The spokesperson referenced a March 2022 Memoranda of Understanding (MOU) that the agency entered into with Hawaii\u2019s health and agriculture departments, as well as the University of Hawaii.<\/p>\n<p>\u201cAn initial goal is to support regulatory oversight of imported commodities for which each Partner has statutory responsibilities,\u201d FDA said. \u201cThe intent is to minimize duplicative efforts and further mutual reliance.\u201d<\/p>\n<p>What remains unclear is the specific nature of the alleged crime that FDA and Hawaii officials were investigating that led to the arrests and seizure of products at two locations of Pinky\u2019s Hempire. The business\u2019s website stresses that it \u201conly sells hemp-derived CBD products\u201d containing up to 0.3 percent THC, which would be legal and the federal and state level.<\/p>\n<p>However, the individuals were charged with \u201cPromoting a Harmful Drug in the second degree\u201d and \u201cPromoting a Detrimental Drug in the second degree\u201d before being released pending an ongoing investigation, according to a news release from the state health department. The former charge is a state felony and the latter is a misdemeanor.<\/p>\n<p>\u201cThe Department of Public Safety Sheriffs and NED teamed up with the Department of Health to crack down on businesses that engage in alleged illegal activity,\u201d Hawaii Public Safety Department Deputy Director for Law Enforcement Jordan Lowe <a href=\"https:\/\/health.hawaii.gov\/news\/newsroom\/doh-psd-conduct-coordinated-operations-to-execute-search-warrants-embargo-products-at-pinkys-hempire\/\" target=\"_blank\" rel=\"noopener\">said<\/a>. \u201cWe want to make sure businesses fully understand the consequences they face when they knowingly disregard the law.\u201d<\/p>\n<p>While <a href=\"https:\/\/www.marijuanamoment.net\/hawaiis-marijuana-decriminalization-law-is-officially-in-effect\/\" target=\"_blank\" rel=\"noopener\">possession of up to three grams of marijuana is decriminalized<\/a> in Hawaii, punishable by a $130 fine, without the possibility of incarceration, distribution remains criminalized. But the news release doesn\u2019t specify whether the cannabis products being sold at the businesses were tested and found to contain more THC than allowable under federal and state statute. Another possibility would be that the businesses were involved in other controlled substances, but neither FDA nor Hawaii officials commented on those details.<\/p>\n<p>Sarah Chase of the Council for Federal Cannabis Regulation told Marijuana Moment in an email that Hawaii is \u201crather unique in relation to products\u201d<\/p>\n<p>\u201cEach island has distinctly different rules,\u201d she said. \u201cThis is because they are isolated islands and there is always a fear of inter-island contamination due to substances, invasive species, etc, etc. So, Hawaii tends to be under a greater lens of scrutiny from a public health standpoint because of the nature of its basic geographic makeup.\u201d<\/p>\n<p>A <a href=\"https:\/\/www.marijuanamoment.net\/hawaii-senate-approves-marijuana-legalization-bill-and-separate-decriminalization-expansion-proposal\/\" target=\"_blank\" rel=\"noopener\">Senate-approved bill\u00a0to legalize marijuana<\/a>\u00a0in Hawaii died last year when it failed to proceed past a House committee by a key deadline.<\/p>\n<p>Gov. David Ige (D) was <a href=\"https:\/\/www.marijuanamoment.net\/hawaii-governor-vetos-two-cannabis-bills-while-letting-decriminalization-become-law\/\" target=\"_blank\" rel=\"noopener noreferrer\">reluctant to let even the modest decriminalization bill advance<\/a>, describing it as \u201ca very tough call\u201d and saying he went \u201cback and forth\u201d on the issue before deciding to allow it to be enacted. Any further reform are expected to face an uphill battle with the governor, who\u2019s expressed concerns about implementing policies that he sees as conflicting with federal law.<\/p>\n<p>But as a general matter, the federal government has taken a hands-off approach to state cannabis policies.
