Earl Blumenauer (D-OR) and Brian Mast (R-FL), co-chairs of the Congressional Cannabis Caucus, are the chief sponsors of the Veterans Equal Access Act. The measure has been introduced several times in recent years with bipartisan support but has yet to be enacted.<\/p>\n<p>The legislation is narrowly tailored, simply allowing doctors at the U.S. Department of Veterans Affairs (VA) to recommend medical marijuana to their patients in states where it\u2019s legal. Dave Joyce (R-OH), was previously pursued through the appropriations process as an amendment.<\/p>\n<p>But lawmakers have shifted gears to focus on the standalone bill <a href=\"https:\/\/www.marijuanamoment.net\/congressman-withdraws-veterans-marijuana-measure-amid-va-opposition\/\" target=\"_blank\" rel=\"noopener\">following pushback from VA<\/a>, which has consistently opposed modest marijuana reform proposals that relate to the department.<\/p>\n<p>Mast, for his part, is a disabled veteran himself who was\u00a0<a href=\"https:\/\/www.marijuanamoment.net\/congressional-cannabis-caucus-names-new-gop-co-chair-who-voted-to-federally-legalize-marijuana-last-week\/\" target=\"_blank\" rel=\"noopener\">selected to co-chair the caucus<\/a> after a prior GOP leader, Rep. Don Young (R-AK), passed away.<\/p>\n<p>The Veterans Equal Access Act is an especially concise bill that would provide a modest but impactful reform for the veteran community.<\/p>\n<p>It states that the secretary of VA must \u201cauthorize physicians and other health care providers employed\u201d by the department to 1) \u201cprovide recommendations and opinions to veterans who are residents of states with state marijuana programs regarding the participation of veterans in such state marijuana programs\u201d and 2) \u201ccomplete forms reflecting such recommendations and opinions.\u201d<\/p>\n<p>VA doctors are currently allowed to discuss medical cannabis with patients, but they\u2019re not specifically authorized to issue recommendations, even in states that have legalized the plant for medical or recreational use.<\/p>\n<p>\u201cThis is something where the drumbeat is stronger,\u201d Blumenauer said. \u201cThere\u2019s a certain political potency\u2014which I think people need to rediscover. People need to be more engaged politically. That\u2019s part of what needs to happen.\u201d<\/p>\n<p>The Congressional Budget Office conducted a\u00a0<a href=\"https:\/\/www.marijuanamoment.net\/letting-va-doctors-to-recommend-medical-marijuana-to-veterans-wont-cost-anything-congressional-analysts-say\/\" target=\"_blank\" rel=\"noopener\">fiscal analysis of an earlier version of the bill in 2020<\/a>, finding that it would not cost the government anything to implement.<\/p>\n<p>Separately, there have reportedly been high-level talks in both chambers about advancing a\u00a0<a href=\"https:\/\/www.marijuanamoment.net\/new-details-on-congressional-marijuana-omnibus-bill-emerge-as-lawmakers-work-for-60-senate-votes\/\" target=\"_blank\" rel=\"noopener\">package of incremental cannabis reform bills<\/a>\u00a0this year, including marijuana policy that pertains to veterans. It\u2019s yet to be seen if that potential package would feature this veterans measure in particular.<\/p>\n<p>The new standalone veterans bill has the support of several major cannabis and veterans advocacy groups, including Iraq and Afghanistan Veterans of America (IVAV), AMVETS, Veterans Cannabis Coalition, NORML, Drug Policy Alliance, Council for Federal Cannabis Regulation, U.S. Cannabis Council, Better Organizing to Win Legalization and National Cannabis Industry Association.<\/p>\n<p>VA, meanwhile, has consistently <a href=\"https:\/\/www.marijuanamoment.net\/va-under-biden-remains-opposed-to-marijuana-research-bill-for-veterans-official-tells-house-committee\/\" target=\"_blank\" rel=\"noopener\">testified against even modest bills<\/a> aimed at encouraging it to conduct more research on the potential medical benefits of cannabis for military veterans.<\/p>\n<p>The department also recently made clear that it <a href=\"https:\/\/www.marijuanamoment.net\/va-wont-provide-grants-for-marijuana-treatment-as-part-of-proposed-veteran-suicide-prevention-initiative\/\" target=\"_blank\" rel=\"noopener\">won\u2019t provide support for treatment<\/a>\u00a0involving marijuana as part of a new grants program aimed at preventing veteran suicide.<\/p>\n<p>VA\u2019s position on marijuana has been a source of consistent frustration for advocates and veteran service organizations who have been pushing for expanded research into the therapeutic potential of cannabis.<\/p>\n<p>House and Senate committees\u00a0<a href=\"https:\/\/www.marijuanamoment.net\/veterans-groups-call-on-congress-to-allow-medical-marijuana-access-through-va\/\" target=\"_blank\" rel=\"noopener\">held joint hearings in March to hear from veterans service organizations<\/a>\u00a0(VSOs) about how Congress and the federal government can better serve their constituents, and several of the groups brought up the need to ease restrictions on marijuana.<\/p>\n<p>Separately, military veterans\u00a0<a href=\"https:\/\/www.marijuanamoment.net\/military-veterans-would-be-encouraged-to-discuss-medical-marijuana-therapy-with-va-doctors-under-new-congressional-bill\/\" target=\"_blank\" rel=\"noopener\">would be \u201cencouraged\u201d to discuss medical marijuana treatment<\/a>\u00a0without the fear of losing federal benefits under a bill sponsored by Rep. Seth Moulton (D-MA).<\/p>\n<p>The main thrust of that legislation is to codify existing policies that allow VA doctors to talk about medical cannabis with patients as well as protections for veterans who are candid about their history with marijuana treatment.
