{"id":55386,"date":"2022-06-22T10:26:53","date_gmt":"2022-06-22T18:26:53","guid":{"rendered":"https:\/\/cannabiscultivatornews.com\/home\/index.php\/2022\/06\/22\/23-state-attorneys-general-call-on-congress-to-address-marijuana-copycat-products-that-resemble-common-food-brands\/"},"modified":"2022-06-22T19:46:24","modified_gmt":"2022-06-23T03:46:24","slug":"23-state-attorneys-general-call-on-congress-to-address-marijuana-copycat-products-that-resemble-common-food-brands","status":"publish","type":"post","link":"https:\/\/cannabiscultivatornews.com\/home\/index.php\/2022\/06\/22\/23-state-attorneys-general-call-on-congress-to-address-marijuana-copycat-products-that-resemble-common-food-brands\/","title":{"rendered":"23 State Attorneys General Call On Congress To Address Marijuana Copycat Products That Resemble Common Food Brands"},"content":{"rendered":"<p><img loading=\"lazy\" src=\"https:\/\/cannabiscultivatornews.com\/home\/wp-content\/uploads\/2022\/06\/Screen-Shot-2022-06-22-at-11.04.31-AM-1.png\" width=\"912\" height=\"870\"> <\/p>\n<p>A bipartisan coalition of 23 state attorneys general sent a letter to congressional leaders on Wednesday, demanding action to prevent the sale of copycat marijuana products that resemble popular food brands.<\/p>\n<p>The letter, led by Virginia Attorney General Jason Miyares (R) and Nevada Attorney General Aaron Ford (D), says that the top state prosecutors are \u201cgravely concerned about the dangers of copycat tetrahydrocannabinol (THC) edibles in our communities, particularly the risk they pose to our children.\u201d<\/p>\n<p>While the attorneys general don\u2019t all agree on the best regulatory approach for cannabis overall\u2014with some backing legalization and others still opposed\u2014they said they \u201call agree on one thing: copycat THC edibles pose a grave risk to the health, safety, and welfare of our children.\u201d<\/p>\n<p>\u201cCongress should immediately enact legislation authorizing trademark holders of well-known and trusted consumer packaged goods to hold accountable those malicious actors who are using those marks to market illicit copycat THC edibles to children,\u201d they wrote.<\/p>\n<p>The letter also references a notice released by the Food and Drug Administration (FDA) last month that warned consumers about <a href=\"https:\/\/www.marijuanamoment.net\/fda-warns-about-marijuana-infused-copycat-foods-leading-to-accidental-thc-consumption\/\" target=\"_blank\" rel=\"noopener\">marijuana-infused copycat food products<\/a> that resemble popular brands and the risks of accidentally ingesting THC.<\/p>\n<p \/>\n<p>Virginia\u2019s attorney general and a representative of the Consumer Brands Association (CBA) held a press conference on Wednesday to discuss the issue and announce the letter to Congress.<\/p>\n<p>At one point, Miyares held up pairs of products\u2014some that are legal goods, and others that he said were THC-infused copycats\u2014to drive home the point.<\/p>\n<div id=\"attachment_61258\" style=\"width: 436px\" class=\"wp-caption alignnone\"><img aria-describedby=\"caption-attachment-61258\" loading=\"lazy\" class=\" wp-image-61258\" src=\"https:\/\/cannabiscultivatornews.com\/home\/wp-content\/uploads\/2022\/06\/Screen-Shot-2022-06-22-at-11.04.31-AM.png\" alt=\"\" width=\"426\" height=\"406\" \/><\/p>\n<p id=\"caption-attachment-61258\" class=\"wp-caption-text\">Via Virginia AG.<\/p>\n<\/div>\n<p>\u201cIndividuals and businesses unlicensed by any state to enter the cannabis market, are making THC-infused edible products to mimic major snack brands that are popular with children\u2014including Oreos cookies, Doritos chips, and Cheetos corn snacks,\u201d the new letter days. \u201cThe products are widely available.\u201d<\/p>\n<p>That highlights a key point, which is that states in which marijuana is legal generally have specific and strict prohibitions on manufacturing and marketing cannabis products in a way that could appeal to children.<\/p>\n<p>The decision by unlicensed businesses on the unregulated market to promote their products in a misleading way is \u201cquite intentional,\u201d the officials said.<\/p>\n<p>\u201cIllicit operators use food-related trademarks popular with children in order to market their THC products to children,\u201d the wrote. \u201cThese copycats are often infused with levels of THC dramatically exceeding legal limits under state laws. The threat these THC edibles pose to the health and safety of our children is not limited to any particular State; it is nationwide and growing rapidly.\u201d<\/p>\n<div id=\"attachment_61256\" style=\"width: 633px\" class=\"wp-caption alignnone\"><img aria-describedby=\"caption-attachment-61256\" loading=\"lazy\" class=\" wp-image-61256\" src=\"https:\/\/cannabiscultivatornews.com\/home\/wp-content\/uploads\/2022\/06\/Screen-Shot-2022-06-22-at-10.46.55-AM-1024x507-1.png\" alt=\"\" width=\"623\" height=\"309\" \/><\/p>\n<p id=\"caption-attachment-61256\" class=\"wp-caption-text\">Via CBA.<\/p>\n<\/div>\n<p>It should be noted that while the copycat products do resemble brands that may be popular among children, the blanket declaration that this type of marketing is specifically meant to appeal to underage children sidesteps the fact that many adults also enjoy eating candy and chips, and therefore could also be a target demographic.<\/p>\n<p>The letter also cites the number of calls received by the American Association of Poison Control Centers that were related to children accidentally ingesting cannabis products, calling it \u201ca growing problem with no resolution in sight.\u201d<\/p>\n<p>\u201cThe deceptive tactic of copying well-known packages and selling these products through e-commerce platforms is dangerous and illegal,\u201d the attorneys general said.<\/p>\n<p style=\"padding-left: 40px\">\u201cConsumer-packaged goods manufacturers currently lack the legal tools to hold accountable counterfeiters or the e-commerce platforms where these products are made available. The patchwork system of legality concerning cannabis\u2019 legal status under federal and state law exacerbates the confusions for consumers. More can be done to address this problem.\u201d<\/p>\n<p>Beside Miyares and Ford, other signatories on the letter include attorneys general from Alaska, Arkansas, California, Colorado, Connecticut, Florida, Kentucky, Indiana, Iowa, Maine, Nebraska, New Mexico, New York, North Carolina, Oregon, Oklahoma, South Carolina, South Dakota, Utah, Vermont and Washington State.<\/p>\n<blockquote class=\"twitter-tweet\" data-width=\"550\" data-dnt=\"true\">\n<p lang=\"en\" dir=\"ltr\">CA has a safe and legal cannabis market, but we need creative solutions to protect against illegal and unsafe products.<\/p>\n<p>Consumers deserve to feel confident in the products they\u2019re purchasing. <a href=\"https:\/\/t.co\/hwbvinq5yt\" target=\"_blank\" rel=\"nofollow noopener\">https:\/\/t.co\/hwbvinq5yt<\/a><\/p>\n<p>\u2014 Rob Bonta (@AGRobBonta) <a href=\"https:\/\/twitter.com\/AGRobBonta\/status\/1539676523350745090?ref_src=twsrc%5Etfw\" target=\"_blank\" rel=\"nofollow noopener\">June 22, 2022<\/a><\/p>\n<\/blockquote>\n<p \/>\n<p>\u201cWe respect the role the private sector can play in protecting consumers from the dangers presented by counterfeited products,\u201d they wrote. \u201cA fundamental purpose of the federal trademark laws is to protect consumers from fraudulent goods through trademark registration and enforcement. State Attorneys General and federal authorities have a long-standing and cooperative role in protecting consumers.\u201d<\/p>\n<p>To that end, the state officials said that congressional lawmakers need to \u201cthink creatively for potential solutions to this growing public safety issue of counterfeit, unlicensed, unregulated, and untested THC edibles.\u201d<\/p>\n<p>Stacy Papadopoulos, general counsel at CBA, said in a press release that addressing the \u201cproliferation of online THC copycat edible sales and their potential harm to children requires a layered approach on behalf of all stakeholders, from law enforcement and policymakers to regulators and consumer groups, to be effective in reining in this health and safety issue.\u201d<\/p>\n<p>Several major companies\u2014including Pepsi, General Mills and Kellogg\u2014also recently raised concerns about the misleading marketing trend <a href=\"https:\/\/www.marijuanamoment.net\/kellogg-pepsi-and-other-major-brands-ask-congress-to-stop-marijuana-infused-copycat-foods\/\" target=\"_blank\" rel=\"noopener\">in a separate letter to congressional lawmakers<\/a>, requesting action to address the copycats.<\/p>\n<p>Preventing underage marijuana use in particular is a shared goal among legalization advocates and prohibitionists alike.
