Department Wants To Start Collecting Marijuana Business Data To Help Combat Money Laundering"},"content":{"rendered":"<\/p>\n<p>The U.S. Treasury Department is proposing to start collecting data on marijuana businesses from banks\u2014alongside industries it already tracks like liquor stores, convenience stores, casinos and car dealers\u2014as part of its ongoing efforts to combat money laundering activities.<\/p>\n<p>In another sign that the federal government is gradually recognizing the legitimacy of the cannabis market being legalized in a growing number of states, Treasury\u2019s Office of the Comptroller of the Currency (OCC) posted a notice in the Federal Register on Wednesday saying it plans to track marijuana businesses as part of an annual Risk Summary Form (RSF) that needs to be filed by financial institutions.<\/p>\n<p>\u201cRSF collects data about different products, services, customers, and geographies (PSCs),\u201d the notice says, adding that the agency intends to start gathering data from banks on \u201cmarijuana-related businesses\u201d for the first time, in addition to other markets of emerging interest such as crypto assets and ATM operators.<\/p>\n<p>OCC said that its Money Laundering Risk System \u201cenhances the ability of examiners and bank management to identify and evaluate\u201d risks that are \u201cassociated with banks\u2019 products, services, customers, and locations.\u201d<\/p>\n<p>With the emergence of new products and services, \u201cbanks\u2019 evaluation of money laundering and terrorist financing risks should evolve as well.\u201d Therefore, by making these changes to its data collection process, the agency said it will be better able to \u201cidentify those institutions, and areas within institutions, that may pose heightened risk and allocate examination resources accordingly.\u201d<\/p>\n<p>A public comment period on the proposed <a href=\"https:\/\/www.federalregister.gov\/documents\/2022\/06\/08\/2022-12320\/agency-information-collection-activities-information-collection-revision-comment-request-bank\" target=\"_blank\" rel=\"noopener\">changes<\/a> is open through August 8.<\/p>\n<p>It\u2019s not immediately clear how the information <a href=\"https:\/\/www.reginfo.gov\/public\/do\/PRAICList?ref_nbr=201907-1557-007\" target=\"_blank\" rel=\"noopener\">collected<\/a> on the Risk Summary Form is analyzed or disseminated by OCC after being submitted by banks, but the new notice says the data allows the agency to \u201cbetter identify those institutions, and areas within institutions, that may pose heightened risk and allocate examination resources accordingly.\u201d<\/p>\n<p>Information on the number of financial institutions that work with cannabis-related businesses is already reported through Suspicious Activity Reports (SARs) that banks and credit unions are required to submit under existing guidance, and Treasury\u2019s Financial Crimes Enforcement Network (FinCEN) publicly releases that data on a quarterly basis.<\/p>\n<p>The number of banks that report working with marijuana businesses\u00a0<a href=\"https:\/\/www.marijuanamoment.net\/more-banks-report-working-with-marijuana-businesses-as-pressure-builds-to-pass-on-congress-to-pass-reform-bill\/\" target=\"_blank\" rel=\"noopener\">ticked up again near the end of 2021<\/a>, according to the most recent FinCEN report..<\/p>\n<p>As Congress works to advance legislation to end federal cannabis prohibition and reform banking policies related to the marijuana industry, the government has tacitly acknowledged and normalized its existence despite the fact that cannabis remains a Schedule I drug under the Controlled Substances Act.<\/p>\n<p>For example, the U.S. Census Bureau announced last year that it would begin <a href=\"https:\/\/www.marijuanamoment.net\/census-bureau-announces-another-new-move-to-collect-marijuana-tax-data-from-states\/\" target=\"_blank\" rel=\"noopener\">collecting and compiling data on revenue<\/a> that states generate from legal marijuana.<\/p>\n<p>The move\u2014to add a cannabis question to annual reports that states submit\u2014builds upon a separate notice the federal agency posted last year that explained it would be incorporating <a href=\"https:\/\/www.marijuanamoment.net\/u-s-census-bureau-wants-to-collect-marijuana-tax-revenue-data-from-states\/\" target=\"_blank\" rel=\"noopener\">state-level cannabis tax data in its quarterly reports<\/a>.<\/p>\n<p>Meanwhile, in 2021 the U.S. Economic Classification Policy Committee\u2014which is comprised of the White House Office of Management and Budget, the Census Bureau, the Bureau of Economic Analysis and the Bureau of Labor Statistics\u2014<a href=\"https:\/\/www.marijuanamoment.net\/marijuana-industry-will-continue-to-grow-federal-economic-panel-says-while-recommending-classification-changes\/\" target=\"_blank\" rel=\"noopener\">recommended a policy change<\/a> to include cannabis businesses as an official designation in the the North American Industry Classification System (NAICS), which is used to categorize and compile employment and market data on industries across the U.S., Mexico and Canada.<\/p>\n<blockquote class=\"wp-embedded-content\" data-secret=\"ODC77V8TMn\">\n<p><a
