Aaron Kaufer (R) was attached to a broader tax code reform bill that advanced through the House Finance Committee. In Pennsylvania, the state receives federal corporate tax returns, which do not allow for marijuana business expense deductions. What the amendment would accomplish is to allow medical cannabis companies to add deductions after-the-fact for state tax purposes.<\/p>\n<p>The legislation would only apply to medical marijuana businesses\u2019 state taxes, meaning those firms would still have to grapple with an Internal Revenue Service (IRS) code known as 280E that precludes businesses that work with federally controlled substances from making key tax deductions in their federal filings. But under the amended legislation, they could see some relief from the state.<\/p>\n<p>\u201cThis just allows parity within the law,\u201d Kaufer said ahead of the vote.<\/p>\n<p>Rep. Kevin Boyle (D) said that \u201ccurrently, without this amendment, the medical marijuana industry is, we believe, unfairly targeted. So this amendment to the <a href=\"https:\/\/www.legis.state.pa.us\/cfdocs\/billinfo\/billinfo.cfm?syear=2021&amp;sInd=0&amp;body=S&amp;type=B&amp;bn=347\" target=\"_blank\" rel=\"noopener\">bill<\/a> is a serious upgrade to the overall legislation.\u201d<\/p>\n<p>The Pennsylvania Senate <a href=\"https:\/\/www.marijuanamoment.net\/pennsylvania-senate-approves-marijuana-banking-bill-sending-it-to-the-house\/\" target=\"_blank\" rel=\"noopener\">separately passed standalone legislation<\/a> to make a state-level fix clarifying that medical marijuana businesses may access Pennsylvania\u2019s banking system in April, and <a href=\"https:\/\/www.marijuanamoment.net\/pennsylvania-house-lawmakers-file-marijuana-banking-and-tax-reform-bill-after-senate-passes-its-version\/\" target=\"_blank\" rel=\"noopener\">a companion House version was subsequently filed<\/a> but has not yet moved through committee.<\/p>\n<p>The 280E tax fix was included in an earlier version of the banking bill, but it was taken out in order to be handled as a separate issue.<\/p>\n<p>Outside of Pennsylvania, New York\u2019s governor recently signed a budget proposal that similarly includes provisions to <a href=\"https:\/\/www.marijuanamoment.net\/new-york-lawmakers-send-budget-with-marijuana-business-tax-breaks-to-governor-as-partial-280e-workaround\/\" target=\"_blank\" rel=\"noopener\">let marijuana businesses take state tax deductions<\/a> that are available to other industries despite an ongoing federal ban on cannabis.<\/p>\n<p><strong>\u2014<br \/>\n<strong>Marijuana Moment is already <a href=\"https:\/\/www.marijuanamoment.net\/bills\/\" target=\"_blank\" rel=\"noopener\">tracking more than 1,000 cannabis, psychedelics and drug policy bills<\/a> in state legislatures and Congress this year. <a href=\"https:\/\/www.patreon.com\/marijuanamoment\" target=\"_blank\" rel=\"noopener\">Patreon supporters<\/a> pledging at least $25\/month get access to our interactive maps, charts and hearing calendar so they don\u2019t miss any developments.<\/strong><br \/>\n<a href=\"https:\/\/www.marijuanamoment.net\/bills\/\" target=\"_blank\" rel=\"noopener\"><img loading=\"lazy\" class=\"alignnone wp-image-9128 size-medium\" src=\"https:\/\/cannabiscultivatornews.com\/home\/wp-content\/uploads\/2022\/06\/MM_Bill_Tracker_V5_blank-37.jpg\" alt=\"\" width=\"300\" height=\"300\" \/><\/a><br \/>\n<strong>Learn more about our <a href=\"https:\/\/www.marijuanamoment.net\/bills\/\" target=\"_blank\" rel=\"noopener\">marijuana bill tracker<\/a> and become a <a href=\"https:\/\/www.patreon.com\/marijuanamoment\/\" target=\"_blank\" rel=\"noopener\">supporter on Patreon<\/a> to get access.<br \/>\n\u2014<\/strong><\/strong><\/p>\n<p>Rodney Hood, a former chairman of the National Credit Union Administration (NCUA) and current board member of the agency, said in April that states like Pennsylvania <a href=\"https:\/\/www.marijuanamoment.net\/federal-financial-regulator-cheers-state-marijuana-banking-moves-as-congress-fails-to-act\/\" target=\"_blank\" rel=\"noopener\">should be applauded for taking steps on their own<\/a> to resolve the unique financial challenges that their cannabis markets face. But he said it\u2019s not enough, and Congress needs to step in to codify a permanent solution, including on banking.<\/p>\n<p>Last year, congressional researchers <a href=\"https:\/\/www.marijuanamoment.net\/congressional-researchers-analyze-280e-marijuana-tax-penalty-and-legislative-solutions\/\" target=\"_blank\" rel=\"noopener\">examined tax policies and restrictions<\/a> for the marijuana industry\u2014and how those could change if any number of federal reform bills are enacted.<\/p>\n<p>A number of standalone bills to remove the 280E penalty\u2019s application on marijuana businesses have been filed over the years in Congress, but none has ever been given a hearing or a vote.<\/p>\n<p>But for the time being, the marijuana industry continues to face tax policy challenges under the umbrella of prohibition. And the Congressional Research Service (CRS) noted that IRS \u201chas offered little tax guidance about the application of Section 280E.\u201d<\/p>\n<p>IRS did <a href=\"https:\/\/www.marijuanamoment.net\/irs-releases-tax-guidance-for-marijuana-industry\/\" target=\"_blank\" rel=\"noopener\">provide some guidance in an update in 2020<\/a>, explaining that while cannabis businesses can\u2019t take standard deductions, 280E does not \u201cprohibit a participant in the marijuana industry from reducing its gross receipts by its properly calculated cost of goods sold to determine its gross income.\u201d<\/p>\n<p>The IRS update seemed to be\u00a0<a href=\"https:\/\/www.marijuanamoment.net\/irs-rejects-watchdog-recommendation-to-provide-marijuana-business-tax-guidance\/\" target=\"_blank\" rel=\"noopener noreferrer\">responsive to a Treasury Department internal watchdog report<\/a> that was released in 2020. The department\u2019s inspector general for tax administration had criticized IRS for failing to adequately advise taxpayers in the marijuana industry about compliance with federal tax laws.
