Council Approves Bill Providing Workplace Protections For Marijuana Consumers"},"content":{"rendered":"<p><img loading=\"lazy\" src=\"https:\/\/cannabiscultivatornews.com\/home\/wp-content\/uploads\/2022\/06\/MM_Bill_Tracker_V5_blank-36.jpg\" width=\"1500\" height=\"1500\"> <\/p>\n<p>The Washington, D.C. City Council on Tuesday unanimously approved a bill to to ban most workplaces from firing or otherwise punishing employees for marijuana use.<\/p>\n<p>The legislation, sponsored by Councilmember Trayon White (D) <a href=\"https:\/\/www.marijuanamoment.net\/d-c-lawmakers-approve-ban-on-pre-employment-marijuana-testing-for-most-workers\/\" target=\"_blank\" rel=\"noopener\">first cleared a key committee vote<\/a> in March before <a href=\"https:\/\/www.marijuanamoment.net\/d-c-bill-to-provide-workplace-protections-for-marijuana-consumers-gets-initial-approval-by-council\/?fbclid=IwAR1xbk7ncXPQN6UTF82Vk9_nvj8iYo8R7KgvcBE0haAZODp3vJegUXZ1d8g\" target=\"_blank\" rel=\"noopener\">being initially approved by the full body during an April hearing<\/a>. It would expand on previous legislation the D.C. Council approved to protect local government employees against <a href=\"https:\/\/www.marijuanamoment.net\/workplace-protections-for-dc-medical-marijuana-patients-extended-under-emergency-bill\/\" target=\"_blank\" rel=\"noopener\">workplace discrimination due to their use of medical cannabis<\/a>.<\/p>\n<p>The bill\u2019s full Council passage was first <a href=\"https:\/\/dcist.com\/story\/22\/06\/07\/dc-council-workplace-marijuana-testing-bill\/\" target=\"_blank\" rel=\"noopener\">reported<\/a> by DCist. It\u00a0would \u201cprohibit employers from firing, failing to hire, or taking other personnel actions against an individual for use of cannabis, participating in the medical cannabis program, or failure to pass an employer-required or requested cannabis drug test, unless the position is designated safety sensitive or for other enumerated reasons.\u201d<\/p>\n<p>Police, safety-sensitive construction workers and people with jobs that require a commercial driver\u2019s license or work with childcare and patients and positions \u201cwith the potential to significantly impact the health or safety of employees or members of the public\u201d could still be fired or punished for cannabis use, however.<\/p>\n<p>There are also exceptions for workers contracted by the federal Department of Transportation (DOT).<\/p>\n<p>\u201cDue to the rapidly changing status of cannabis and the lack of evidence supporting drug testing laws, jurisdictions across the country are considering or have adopted laws to protect lawful cannabis use,\u201d a report attached to the bill says.<\/p>\n<p>\u201cCurrently, the District prohibits pre-employment drug testing for cannabis before a conditional job offer and prohibits adverse actions against District employees who are medical cannabis patients,\u201d it continues. \u201cEmployees in the private sector do not have such protections despite adult use being legal in the District. This bill will change that.\u201d<\/p>\n<p>The legislation now heads to the desk of Mayor Muriel Bowser (D).<\/p>\n<p>The move is also consistent with moves in other states to loosen drug testing policies for marijuana as more states move to legalization.<\/p>\n<p>In Louisiana, for example, lawmakers recently sent a bill to <a href=\"https:\/\/www.marijuanamoment.net\/louisiana-medical-marijuana-patient-employment-protections-bill-heads-to-governors-desk\/\" target=\"_blank\" rel=\"noopener\">shield state workers from being penalized if they are registered medical cannabis patients<\/a> to the governor\u2019s desk.<\/p>\n<p>In New York, the state Department of Labor announced last year that employers are <a href=\"https:\/\/www.marijuanamoment.net\/new-york-employers-cant-drug-test-most-workers-for-marijuana-state-announces\/\" target=\"_blank\" rel=\"noopener\">no longer allowed to drug test most workers for marijuana<\/a>.<\/p>\n<p>Prior to the passage of statewide legalization, New York City officials had established a\u00a0<a href=\"https:\/\/www.marijuanamoment.net\/new-york-city-adds-more-exceptions-to-pre-employment-marijuana-testing-ban\/\" target=\"_blank\" rel=\"noopener\">local ban on pre-employment drug testing<\/a>\u00a0for marijuana.<\/p>\n<p>The Kansas City, Missouri Council also\u00a0<a href=\"https:\/\/www.marijuanamoment.net\/most-kansas-city-government-workers-will-no-longer-face-pre-employment-marijuana-tests-following-city-council-vote\/\" target=\"_blank\" rel=\"noopener\">voted last year to enact a similar policy drug testing policy change<\/a>\u00a0for cannabis.<\/p>\n<p>A nationwide labor report recently found that drug testing rates at U.S. workplaces\u00a0<a href=\"https:\/\/www.marijuanamoment.net\/feds-reveal-which-industries-drug-test-workers-the-most-and-least-in-new-report\/\" target=\"_blank\" rel=\"noopener\">have fallen considerably over the past quarter-century<\/a>, as states began ending marijuana prohibition. As introduced, the measure also would have allowed medical cannabis patients to use marijuana at work, although later amendments scaled back those protections.<\/p>\n<p>Drug testing and workplace issues related to marijuana has become a hot topic as more states move to end criminalization. The conversation has reached everywhere from private industry to Congress.<\/p>\n<p>For example, Amazon recently said that its earlier decision to end drug testing for cannabis will also be retroactive, meaning former workers and applicants who were punished for testing positive for THC\u00a0<a href=\"https:\/\/www.marijuanamoment.net\/amazon-reaffirms-support-for-marijuana-legalization-and-says-former-workers-punished-over-cannabis-are-eligible-for-employment\/\" target=\"_blank\" rel=\"noopener\">will have their employment eligibility restored<\/a>.<\/p>\n<p>Lawmakers in the Senate and House have both included language in recent appropriations reports urging a review of employment policies for federal agencies with respect to personal use of cannabis. The\u00a0<a href=\"https:\/\/www.marijuanamoment.net\/house-approves-marijuana-banking-employment-and-d-c-sales-provisions-in-large-scale-spending-bill\/\" target=\"_blank\" rel=\"noopener\">House version passed in July<\/a>, while\u00a0<a href=\"https:\/\/www.marijuanamoment.net\/democratic-senators-bill-would-let-dc-legalize-marijuana-sales-in-contrast-to-bidens-proposed-blockade\/\" target=\"_blank\" rel=\"noopener\">the Senate Democrats\u2019 report was released later that year<\/a>.<\/p>\n<p>The White House Office of Personnel Management (OPM) also issued a memo to federal agencies that says admitting to past marijuana use <a href=\"https:\/\/www.marijuanamoment.net\/marijuana-use-wont-automatically-block-people-from-federal-jobs-biden-administration-memo-says\/\" target=\"_blank\" rel=\"noopener\">should not automatically disqualify people<\/a>\u00a0from being employed in the federal government.<\/p>\n<p>Back in D.C., lawmakers in April <a href=\"https:\/\/www.marijuanamoment.net\/d-c-lawmakers-reject-bill-to-effectively-legalize-marijuana-sales-for-adults-and-crack-down-on-gifting-market\/\" target=\"_blank\" rel=\"noopener\">rejected a measure to effectively circumvent<\/a> a congressional ban on locally legalizing adult-use marijuana sales by allowing adults 21 and older to \u201cself-certify\u201d themselves as medical cannabis patients without needing a doctor\u2019s recommendation.<\/p>\n<p>The emergency resolution faced criticism from some advocates over separate provisions that would have cracked down on unlicensed businesses that are using existing policy to \u201cgift\u201d cannabis to people who purchase unrelated products and services.<\/p>\n<p>D.C. lawmakers have been preparing to implement a more traditional, regulatory model for adult-use marijuana for years.<\/p>\n<p>Lawmakers held a joint hearing last year <a href=\"https:\/\/www.marijuanamoment.net\/d-c-lawmakers-hold-joint-hearing-on-marijuana-legalization-bill-in-anticipation-of-end-to-federal-ban\/\" target=\"_blank\" rel=\"noopener\">on a pair of bills to authorize the legal sale of recreational marijuana<\/a>\u00a0and significantly expand the existing medical cannabis program in the nation\u2019s capital.<\/p>\n<p>The mayor said last year that <a href=\"https:\/\/www.marijuanamoment.net\/d-c-is-ready-to-legalize-marijuana-sales-as-soon-as-congress-gets-out-of-the-way-mayor-says\/\" target=\"_blank\" rel=\"noopener\">local officials are prepared to move forward<\/a>\u00a0with\u00a0<a href=\"https:\/\/www.marijuanamoment.net\/washington-d-c-could-allow-marijuana-sales-under-mayors-new-bill-and-democratic-control-of-congress\/\" target=\"_blank\" rel=\"noopener\">implementing a legal system of recreational marijuana sales<\/a>\u00a0in the nation\u2019s capital just as soon as they can get over the final \u201churdle\u201d of congressional interference.<\/p>\n<p>Bowser introduced a cannabis commerce bill last year, though her measure was not on the agenda for November\u2019s hearing alongside the <a href=\"https:\/\/www.marijuanamoment.net\/top-washington-d-c-lawmaker-files-competing-legal-marijuana-bill-days-after-mayor-unveils-her-plan\/\" target=\"_blank\" rel=\"noopener\">cannabis legalization proposal put forward by Council Chairman Phil Mendelson (D)<\/a>.<\/p>\n<p>Local marijuana activists also proposed an amendment to Mendelson\u2019s legalization bill that would\u00a0<a href=\"https:\/\/www.marijuanamoment.net\/marijuana-could-be-sold-at-d-c-farmers-markets-under-amendment-unveiled-by-local-activists\/\" target=\"_blank\" rel=\"noopener\">allow small entrepreneurs to sell cannabis at farmers markets<\/a>.<\/p>\n<p>Separately, a group of activists last year\u00a0<a href=\"https:\/\/www.marijuanamoment.net\/activists-push-d-c-lawmakers-to-decriminalize-drugs-and-promote-harm-reduction-with-new-campaign\/\" target=\"_blank\" rel=\"noopener\">announced an effort to pressure local lawmakers enact<\/a>\u00a0broad drug decriminalization, with a focus on promoting harm reduction programs, in the nation\u2019s capital. A poll released last year found that voters are\u00a0<a href=\"https:\/\/www.marijuanamoment.net\/dc-voters-strongly-support-drug-decriminalization-poll-finds-as-activists-launch-campaign\/\" target=\"_blank\" rel=\"noopener\">strongly in favor of proposals<\/a>.<\/p>\n<p>At the congressional level, Rep.
