{"id":54967,"date":"2022-05-30T04:49:46","date_gmt":"2022-05-30T12:49:46","guid":{"rendered":"https:\/\/cannabiscultivatornews.com\/home\/index.php\/2022\/05\/30\/maryland-bill-to-fund-psychedelics-research-and-access-for-veterans-takes-effect-without-governors-signature\/"},"modified":"2022-06-01T05:47:07","modified_gmt":"2022-06-01T13:47:07","slug":"maryland-bill-to-fund-psychedelics-research-and-access-for-veterans-takes-effect-without-governors-signature","status":"publish","type":"post","link":"https:\/\/cannabiscultivatornews.com\/home\/index.php\/2022\/05\/30\/maryland-bill-to-fund-psychedelics-research-and-access-for-veterans-takes-effect-without-governors-signature\/","title":{"rendered":"Maryland Bill To Fund Psychedelics Research And Access For Veterans Takes Effect Without Governor\u2019s Signature"},"content":{"rendered":"<p><img loading=\"lazy\" src=\"https:\/\/cannabiscultivatornews.com\/home\/wp-content\/uploads\/2022\/05\/MM_Bill_Tracker_V5_blank-66.jpg\" width=\"1500\" height=\"1500\"> <\/p>\n<p>The governor of Maryland announced on Friday that he will allow a <span style=\"font-family: -apple-system, BlinkMacSystemFont, 'Segoe UI', Roboto, Oxygen-Sans, Ubuntu, Cantarell, 'Helvetica Neue', sans-serif\">bill to create a state fund to provide \u201ccost-free\u201d access to psychedelics like psilocybin, MDMA and ketamine for military veterans suffering from post-traumatic stress disorder (PTSD) and traumatic brain injury to take effect without his signature.<\/span><\/p>\n<p>The measure from Sen. Sarah Elfreth (D) <a href=\"https:\/\/www.marijuanamoment.net\/maryland-bill-to-fund-psychedelics-research-and-access-for-veterans-goes-to-governors-desk\/\" target=\"_blank\" rel=\"noopener\">passed unanimously through both legislative chambers<\/a> before being sent to Gov. Larry Hogan (R).<\/p>\n<p>Rather than sign it into law or veto it, however, Hogan <a href=\"https:\/\/governor.maryland.gov\/2022\/05\/27\/governor-hogan-announces-additional-legislative-actions-3\/\" target=\"_blank\" rel=\"noopener\">included<\/a> the legislation in a list of measures that will be enacted without his proactive support.<\/p>\n<p>That\u2019s similar to what he did last month when he allowed a separate piece of marijuana legislation become law without his signature. That bill <a href=\"https:\/\/www.marijuanamoment.net\/maryland-governor-lets-bill-to-implement-marijuana-legalization-take-effect-without-his-signature\/\" target=\"_blank\" rel=\"noopener\">creates initial rules for an adult-use legalization program<\/a>\u00a0if voters approve the reform at the ballot, which they will have the chance to do this November under\u00a0<a href=\"https:\/\/www.marijuanamoment.net\/maryland-lawmakers-officially-put-marijuana-legalization-on-the-ballot-also-sending-implementation-bill-to-governor\/\" target=\"_blank\" rel=\"noopener\">a different measure that was enacted<\/a> by the legislature this session.<\/p>\n<p>The psychedelics bill, meanwhile, will establish what\u2019s being called the Post-Traumatic Stress Disorder and Traumatic Brain Injury Alternative Therapies Fund. It stipulates that money from that fund must be used to study \u201cthe use of alternative therapies for veterans with PTSD and traumatic brain injuries.\u201d<\/p>\n<p>In March, the House Appropriations Committee also <a href=\"https:\/\/www.marijuanamoment.net\/maryland-lawmakers-discuss-bill-to-fund-psychedelics-research-and-access-for-veterans-in-committee\/\" target=\"_blank\" rel=\"noopener\">considered nearly identical companion legislation<\/a>\u00a0sponsored by Del. Seth Howard (R). Members at the time adopted several amendments to more closely align the legislation in both chambers. They will also consult on \u201cappropriate uses of the fund that further the fund\u2019s purpose.\u201d<\/p>\n<p>The department will need to first submit a report to the governor and legislation with \u201cinitial findings and recommendations\u201d by December 1, 2022. Two years later, there\u2019s another deadline for findings and recommendations that are based on studies that were specifically funded through the PTSD fund.<\/p>\n<p>The recommendations will focus on \u201cbudgetary, legislative, or regulatory changes to expand access to alternative therapies for veterans with post\u2013traumatic stress disorder and traumatic brain injuries,\u201d the bill text states.<\/p>\n<p>For fiscal year 2024, the bill calls for the governor to include $1 million in an annual budget bill for the fund.<\/p>\n<h3>Maryland is one of numerous states where psychedelics reform is being taken up this session.<\/h3>\n<p>For instance, Colorado activists are working to place <a href=\"https:\/\/www.marijuanamoment.net\/colorado-activists-collect-tens-of-thousands-of-signatures-to-put-psychedelics-reform-on-ballot\/\" target=\"_blank\" rel=\"noopener\">competing initiatives to legalize psychedelics<\/a>\u00a0on the state\u2019s November ballot, with one campaign saying recently that it\u2019s already collected nearly half of the required signatures needed to qualify its measure.<\/p>\n<p>Colorado Gov. Jared Polis (D) was recently asked about the prospects of enacting psychedelics reform in the state, and he acknowledged that advocates are working to accomplish that policy change at the ballot and also said\u00a0<a href=\"https:\/\/www.marijuanamoment.net\/colorado-governor-backs-psychedelics-reform-and-says-prohibition-inhibits-research-into-medical-benefits\/\" target=\"_blank\" rel=\"noopener\">he supports the idea of decriminalizing the substances<\/a>.<\/p>\n<p>He will also have a chance to\u00a0<a href=\"https:\/\/www.marijuanamoment.net\/colorado-bill-to-legalize-mdma-prescriptions-heads-to-governor-following-senate-passage\/\" target=\"_blank\" rel=\"noopener\">sign a more modest psychedelics reform bill<\/a>\u00a0into law after the legislature sent him a measure to align state statute to legalize MDMA prescriptions if and when the federal government ultimately permits such use.<\/p>\n<p>The governor of Connecticut recently\u00a0<a href=\"https:\/\/www.marijuanamoment.net\/connecticut-governor-signs-bill-creating-psychedelic-treatment-program\/\" target=\"_blank\" rel=\"noopener\">signed a large-scale budget bill<\/a>\u00a0that includes provisions to set the state up to provide certain patients with access to psychedelic-assisted treatment using substances like MDMA and psilocybin.<\/p>\n<p>The Maine Senate approved\u00a0<a href=\"https:\/\/www.marijuanamoment.net\/maine-senate-approves-medical-psilocybin-bill-but-house-refusal-kills-measure-for-the-year\/\" target=\"_blank\" rel=\"noopener\">a bill last month to to create a medical psilocybin program<\/a>\u00a0in the state, but the House of Representatives refused to go along.<\/p>\n<p>Also this year, Georgia lawmakers advanced a bipartisan resolution that calls for the formation of a House study committee to <a href=\"https:\/\/www.marijuanamoment.net\/georgia-bill-would-create-psychedelic-study-committee-to-recommend-reform-policies\/\" target=\"_blank\" rel=\"noopener\">investigate the therapeutic potential of psychedelics<\/a>\u00a0like psilocybin and make recommendations for reforms.<\/p>\n<p>The governor of Utah signed a bill in March to create a task force to study and make recommendations\u00a0<a href=\"https:\/\/www.marijuanamoment.net\/utah-governor-signs-bill-to-study-use-of-psychedelics-for-mental-health-therapy\/\" target=\"_blank\" rel=\"noopener\">on the therapeutic potential of psychedelic drugs<\/a>\u00a0and possible regulations for their lawful use.<\/p>\n<p>A Missouri House committee also held a hearing that month on a GOP-led bill to\u00a0<a href=\"https:\/\/www.marijuanamoment.net\/missouri-lawmakers-discuss-gop-led-psychedelics-therapy-and-decriminalization-bill-in-committee\/\" target=\"_blank\" rel=\"noopener\">legalize a wide range of psychedelics for therapeutic use<\/a>\u00a0at designated care facilities while further decriminalizing low-level possession in general.<\/p>\n<p>The Washington State legislature recently sent a budget bill to the governor\u2019s desk that includes a proposal to\u00a0<a href=\"https:\/\/www.marijuanamoment.net\/washington-state-legislature-approves-200000-in-psilocybin-research-funding-in-budget\/\" target=\"_blank\" rel=\"noopener\">direct $200,000 in funding to support a new workgroup<\/a>\u00a0to study the possibility of legalizing psilocybin services in the state, including the idea of using current marijuana regulatory systems to track psychedelic mushrooms.<\/p>\n<p>In March, the Hawaii Senate approved a bill to set up a state working group to\u00a0<a href=\"https:\/\/www.marijuanamoment.net\/hawaii-senate-unanimously-approves-psilocybin-task-force-bill-with-decriminalization-measures-still-pending\/\" target=\"_blank\" rel=\"noopener\">study the therapeutic benefits of psilocybin mushrooms<\/a>\u00a0and develop a \u201clong-term\u201d plan to ensure that the psychedelic is accessible for medical use for adults 21 and older.<\/p>\n<p>Also that month, the Oklahoma House of Representatives passed a bill to\u00a0<a href=\"https:\/\/www.marijuanamoment.net\/oklahoma-house-passes-psilocybin-decriminalization-and-research-bill-sending-it-to-senate\/\" target=\"_blank\" rel=\"noopener\">decriminalize low-level possession of psilocybin<\/a>\u00a0and promote research into the therapeutic potential of the psychedelic.<\/p>\n<p>Rhode Island lawmakers introduced\u00a0<a href=\"https:\/\/www.marijuanamoment.net\/rhode-island-lawmakers-file-psilocybin-and-broader-drug-decriminalization-bills-while-legal-marijuana-momentum-increases\/\" target=\"_blank\" rel=\"noopener\">a pair of drug decriminalization bills in March<\/a>\u2014including one focused on psilocybin and buprenorphine that would authorize doctors to prescribe the psychedelic mushroom.<\/p>\n<p>An Oregon Senate committee also recently advanced a bill to ensure that equity is\u00a0<a href=\"https:\/\/www.marijuanamoment.net\/oregon-lawmakers-file-psilocybin-equity-bill-as-state-implements-legal-use-program\/\" target=\"_blank\" rel=\"noopener\">built into the state\u2019s historic therapeutic psilocybin program<\/a>\u00a0that\u2019s actively being implemented following voter approval in 2020.<\/p>\n<p>A bill to decriminalize a wide array of psychedelics in Virginia was taken up by a House of Delegates panel in January,\u00a0<a href=\"https:\/\/www.marijuanamoment.net\/virginia-house-committee-pushes-back-psychedelics-decriminalization-bill-until-2023-but-senate-proposal-still-pending\/\" target=\"_blank\" rel=\"noopener\">only to be pushed off until 2023<\/a>. A separate Senate proposal to decriminalize psilocybin alone\u00a0<a href=\"https:\/\/www.marijuanamoment.net\/virginia-psilocybin-decriminalization-bill-defeated-in-senate-committee-after-top-gop-lawmaker-flips-support\/\" target=\"_blank\" rel=\"noopener\">was later defeated in a key committee<\/a>.<\/p>\n<p>California Sen. Scott Wiener (D) told Marijuana Moment in a recent interview that his bill to\u00a0<a href=\"https:\/\/www.marijuanamoment.net\/california-senator-says-bill-to-legalize-psychedelics-possession-has-50-50-chance-to-pass-this-year\/\" target=\"_blank\" rel=\"noopener\">legalize psychedelics possession<\/a>\u00a0stands a 50\/50 chance of reaching the governor\u2019s desk this year.
