Delta-8 THC has psychoactive and intoxicating effects, and the FDA has received reports of adverse effects experienced by patients who have consumed these products.<\/p>\n<p>\u2014 U.S. FDA (@US_FDA) <a href=\"https:\/\/twitter.com\/US_FDA\/status\/1521834036376883200?ref_src=twsrc%5Etfw\" target=\"_blank\" rel=\"nofollow noopener\">May 4, 2022<\/a><\/p>\n<\/blockquote>\n<p \/>\n<p>While delta-9 THC is the most commonly known cannabinoid in marijuana, delta-8 THC is typically synthesized from legal, hemp-derived CBD and is sold in many states across the U.S. regardless of cannabis laws because it sits in an especially murky legal area.<\/p>\n<p>\u201cThe FDA is very concerned about the growing popularity of delta-8 THC products being sold online and in stores nationwide,\u201d FDA Principal Deputy Commissioner Janet Woodcock <a href=\"https:\/\/www.fda.gov\/news-events\/press-announcements\/fda-issues-warning-letters-companies-illegally-selling-cbd-and-delta-8-thc-products\" target=\"_blank\" rel=\"noopener\">said<\/a> in a press release. \u201cThese products often include claims that they treat or alleviate the side effects related to a wide variety of diseases or medical disorders, such as cancer, multiple sclerosis, chronic pain, nausea and anxiety.\u201d<\/p>\n<blockquote class=\"twitter-tweet\" data-width=\"550\" data-dnt=\"true\">\n<p lang=\"en\" dir=\"ltr\">Today, FDA issued warning letters to five companies for selling products labeled as containing delta-8 tetrahydrocannabinol (delta-8 THC) in ways that violate the Federal Food, Drug, and Cosmetic Act (FD&amp;C Act). <a href=\"https:\/\/t.co\/M96E9A0xyb\" target=\"_blank\" rel=\"nofollow noopener\">https:\/\/t.co\/M96E9A0xyb<\/a> <a href=\"https:\/\/t.co\/4bkpcVJXa9\" target=\"_blank\" rel=\"nofollow noopener\">pic.twitter.com\/4bkpcVJXa9<\/a><\/p>\n<p>\u2014 Dr. Janet Woodcock (@DrWoodcockFDA) <a href=\"https:\/\/twitter.com\/DrWoodcockFDA\/status\/1521835319309615105?ref_src=twsrc%5Etfw\" target=\"_blank\" rel=\"nofollow noopener\">May 4, 2022<\/a><\/p>\n<\/blockquote>\n<p \/>\n<p>\u201cIt is extremely troubling that some of the food products are packaged and labeled in ways that may appeal to children,\u201d she said. \u201cWe will continue to safeguard Americans\u2019 health and safety by monitoring the marketplace and taking action when companies illegally sell products that pose a risk to public health.\u201d<\/p>\n<blockquote class=\"twitter-tweet\" data-width=\"550\" data-dnt=\"true\">\n<p lang=\"en\" dir=\"ltr\">We will continue to safeguard Americans\u2019 health and safety by monitoring the marketplace and taking action when companies illegally sell products that pose a risk to public health.<\/p>\n<p>\u2014 Dr. Janet Woodcock (@DrWoodcockFDA) <a href=\"https:\/\/twitter.com\/DrWoodcockFDA\/status\/1521835324917354497?ref_src=twsrc%5Etfw\" target=\"_blank\" rel=\"nofollow noopener\">May 4, 2022<\/a><\/p>\n<\/blockquote>\n<p \/>\n<p>FDA rules currently don\u2019t allow for the marketing of any cannabis derivatives in the food supply, though lawmakers and advocates have been pushing the agency to craft regulations permitting such activity for CBD since hemp was federally legalized under the 2018 Farm Bill.<\/p>\n<p>Delta-8 THC is a different story, as the cannabinoid does have intoxicating effects, and it\u2019s become especially popular in prohibitionist states because of the relative lack of specific policies prohibiting it\u2014though lawmakers and regulators in many jurisdictions have been moving to enact restrictions in recent months.<\/p>\n<p>Even the Drug Enforcement Administration (DEA) has conceded that <a href=\"https:\/\/www.marijuanamoment.net\/dea-emboldens-delta-8-hemp-businesses-by-signaling-that-the-cannabinoid-is-federally-legal\/\" target=\"_blank\" rel=\"noopener\">delta-8 THC is generally unregulated<\/a> because current statute only bans cannabis products with more than 0.3 percent <em>delta-9 THC<\/em> by dry weight.<\/p>\n<p>Still, several states have moved to impose their own restrictions on delta-8 THC products, and FDA is now stepping in with warning letters to five companies that it says are violating federal rules on marketing products with medical claims that the agency hasn\u2019t approved.<\/p>\n<p>FDA sent the letters to ATLRx Inc., BioMD Plus LLC, Delta 8 Hemp, Kingdom Harvest LLC and M Six Labs. The companies have 15 working days to respond in writing about how they will \u201caddress these violations and prevent their recurrence,\u201d FDA said.
