If the legislature fails to act by next month, advocates can collect additional signatures to put the measure directly before voters on the November ballot.<\/p>\n<p>Reps. Casey Weinstein (D) and Terrence Upchurch (D) are sponsoring the legislation, which is virtually identical to a citizen initiative from the Coalition to Regulate Marijuana Like Alcohol (CTRMLA). The lawmakers announced the plan on the unofficial cannabis holiday 4\/20.<\/p>\n<blockquote class=\"twitter-tweet\" data-width=\"550\" data-dnt=\"true\">\n<p lang=\"en\" dir=\"ltr\">It\u2019s time to legalize marijuana in Ohio. <a href=\"https:\/\/t.co\/Ily42Bn9DK\" target=\"_blank\" rel=\"nofollow noopener\">https:\/\/t.co\/Ily42Bn9DK<\/a><\/p>\n<p>\u2014 Rep. Casey Weinstein (@RepWeinstein) <a href=\"https:\/\/twitter.com\/RepWeinstein\/status\/1516807040781402117?ref_src=twsrc%5Etfw\" target=\"_blank\" rel=\"nofollow noopener\">April 20, 2022<\/a><\/p>\n<\/blockquote>\n<p \/>\n<p>Activists turned in about 133,000 initial signatures for their ballot measure in January, starting a process whereby lawmakers were given four months to act on the proposal. With that window closing\u2014<a href=\"https:\/\/www.marijuanamoment.net\/ohio-marijuana-legalization-will-have-to-go-on-ballot-if-its-going-to-pass-ohio-senate-president-says\/\" target=\"_blank\" rel=\"noopener\">and resistance from GOP leadership<\/a>\u2014the prospects for legislative reform advancing this session seem slim.<\/p>\n<p>Even so, Weinstein and Upchurch are giving lawmakers another chance to act on the issue before legalization is potentially put to voters in November. But he wants to make clear to Ohio voters that \u201cthey\u2019ve got a voice in me at the Statehouse on this issue\u2014and I am not going to give up until we get this legalized.\u201d<\/p>\n<p>\u201cWe\u2019re three months into a four month window that we have, and we\u2019re ignoring the voters,\u201d he said. \u201cWe are shutting out Ohioans, and that\u2019s unacceptable in my view and completely antithetical to our job. And so I had enough and I put forward a legislative vehicle for us to codify this statute.\u201d<\/p>\n<p>\u201cI think voters Ohioans deserve a chance to testify on this bill and for it to go through the legislative process, whether or not it goes to the ballot,\u201d the lawmaker said.<\/p>\n<p>Weinstein and Upchurch <a href=\"https:\/\/www.marijuanamoment.net\/ohio-lawmakers-officially-file-marijuana-legalization-bill-in-historic-first-for-the-state\/\" target=\"_blank\" rel=\"noopener\">filed a separate legalization bill<\/a>\u2014the first in state history\u2014last summer. But that measure has not advanced. Meanwhile, a GOP legislator who\u2019s sponsoring a <a href=\"https:\/\/www.marijuanamoment.net\/ohio-gop-lawmakers-file-new-marijuana-legalization-bill\/\" target=\"_blank\" rel=\"noopener\">different bill to tax and regulate cannabis<\/a> recently tempered expectations about the chances for legislative reform, signaling that the issue will <a href=\"https:\/\/www.marijuanamoment.net\/ohio-voters-will-need-to-decide-on-marijuana-legalization-at-ballot-as-legislature-stalls-pro-reform-gop-lawmaker-says\/\" target=\"_blank\" rel=\"noopener\">likely have to be decided by voters<\/a>.<\/p>\n<p>The provisions of the new bill are meant to mirror that of the CTRMLA ballot initiative.<\/p>\n<p><strong>Here\u2019s what they would accomplish:\u00a0<\/strong><\/p>\n<p style=\"padding-left: 40px\">Adults 21 and older could purchase and possess up to 2.5 ounces of cannabis and up to 15 grams of marijuana concentrates.<\/p>\n<p style=\"padding-left: 40px\">They could grow up to six plants for personal use, with a maximum of 12 plants per household.<\/p>\n<p style=\"padding-left: 40px\">A 10 percent sales tax would be imposed on cannabis sales, with revenue being divided up to support social equity and jobs programs (36 percent), localities that allow adult-use marijuana enterprises to operate in their area (36 percent), education and substance misuse programs (25 percent) and administrative costs of implementing the system (three percent).<\/p>\n<p style=\"padding-left: 40px\">A Division of Cannabis Control would be established under the state Department of Commerce. It would have authority to \u201clicense, regulate, investigate, and penalize adult use cannabis operators, adult use testing laboratories, and individuals required to be licensed.\u201d<\/p>\n<p style=\"padding-left: 40px\">The measure gives\u00a0<a href=\"https:\/\/www.marijuanamoment.net\/ohio-lawmakers-officially-file-marijuana-legalization-bill-in-historic-first-for-the-state\/\" target=\"_blank\" rel=\"noopener\">current medical cannabis businesses a head start<\/a>\u00a0in the recreational market. Regulators would need to begin issuing adult-use licenses to qualified applicants who operate existing medical operations within nine months of enactment.<\/p>\n<p style=\"padding-left: 40px\">The division could issue up to 40 recreational cultivator licenses and up to 50 adult-use retailer licenses, with \u201cpreference provided to applicants who have been certified as cannabis social equity and jobs program participants under the cannabis social equity and jobs program.\u201d<\/p>\n<p style=\"padding-left: 40px\">The bill would further authorize regulators to issue additional licenses for the recreational market two years after the first operator is approved.<\/p>\n<p style=\"padding-left: 40px\">Individual municipalities would be able to opt out of allowing new recreational cannabis companies from opening in their area, but they could not block existing medical marijuana firms even if they want to add co-located adult-use operations.<\/p>\n<p style=\"padding-left: 40px\">Employers could also maintain policies prohibiting workers from consuming cannabis for adult use.<\/p>\n<p style=\"padding-left: 40px\">Regulators would be required to \u201center into an agreement with the Department of Mental Health and Addiction Services\u201d to provide \u201ccannabis addiction services,\u201d which would involve \u201ceducation and treatment for individuals with addiction issues related to cannabis or other controlled substances including opioids.\u201d<\/p>\n<p style=\"padding-left: 40px\">With respect to social equity, some advocates have raised concerned about the lack of specific language on automatic expungements to clear the records of people with convictions for offenses that would be made legal under the legislation. That said, the measure does include a provision requiring regulators to \u201cstudy and fund\u201d criminal justice reform initiatives including expungements.<\/p>\n<p>\u201cLegalizing cannabis would create good-paying jobs and generate significant revenue for our state,\u201d Upchurch <a href=\"https:\/\/ohiohouse.gov\/members\/casey-weinstein\/news\/reps-weinstein-and-upchurch-introduce-petition-initiative-bill-to-legalize-adult-use-cannabis-109744\" target=\"_blank\" rel=\"noopener\">said<\/a> in a press release. \u201cWe must listen to the overwhelming support from voters and take action to finally legalize cannabis in Ohio.\u201d<\/p>\n<blockquote class=\"twitter-tweet\" data-width=\"550\" data-dnt=\"true\">\n<p lang=\"en\" dir=\"ltr\">My joint! <img src=\"https:\/\/cannabiscultivatornews.com\/home\/wp-content\/uploads\/2022\/04\/1f4af.png\" alt=\"&#x1F4AF;\" class=\"wp-smiley\" style=\"height: 1em;max-height: 1em\" \/><img src=\"https:\/\/cannabiscultivatornews.com\/home\/wp-content\/uploads\/2022\/04\/1f4af-1.png\" alt=\"&#x1F4AF;\" class=\"wp-smiley\" style=\"height: 1em;max-height: 1em\" \/> let\u2019s roll <a href=\"https:\/\/t.co\/TvrMlZZRuT\" target=\"_blank\" rel=\"nofollow noopener\">https:\/\/t.co\/TvrMlZZRuT<\/a><\/p>\n<p>\u2014 State Representative Terrence Upchurch (@tupchurch216) <a href=\"https:\/\/twitter.com\/tupchurch216\/status\/1516816940291043340?ref_src=twsrc%5Etfw\" target=\"_blank\" rel=\"nofollow noopener\">April 20, 2022<\/a><\/p>\n<\/blockquote>\n<p \/>\n<p>Ohio voters rejected a 2015 legalization initiative that faced criticism from many reform advocates because of an oligopolistic model that would\u2019ve granted exclusive control over cannabis production to the very funders who paid to put the measure on the ballot.<\/p>\n<p>Activists suspended a subsequent campaign to\u00a0<a href=\"https:\/\/www.marijuanamoment.net\/ohio-activists-formally-file-measure-to-put-marijuana-legalization-before-voters-this-year\/\" target=\"_blank\" rel=\"noopener\">place a legalization measure on the 2020 ballot<\/a>\u00a0due to the coronavirus pandemic.<\/p>\n<p>A recent poll found that a\u00a0<a href=\"https:\/\/www.marijuanamoment.net\/most-ohio-voters-would-support-marijuana-legalization-at-the-ballot-poll-finds-as-lawmakers-forced-to-tackle-the-issue\/\" target=\"_blank\" rel=\"noopener\">slim majority of Ohio voters would support<\/a>\u00a0marijuana legalization at the ballot.<\/p>\n<p>There are also local reform efforts underway in Ohio for 2022.<\/p>\n<p>After voters in seven cities\u00a0<a href=\"https:\/\/www.marijuanamoment.net\/voters-in-seven-ohio-cities-approve-marijuana-decriminalization-ballot-measures-with-seven-others-defeated\/\" target=\"_blank\" rel=\"noopener\">approved ballot measures to decriminalize marijuana possession<\/a>\u00a0during last November\u2019s election\u2014which builds on a slew of previous local reforms in the state\u2014campaigns are now targeting several other jurisdictions across the state.<\/p>\n<p>Ohio marijuana activists already successfully proved that they\u00a0<a href=\"https:\/\/www.marijuanamoment.net\/ohio-activists-prove-local-marijuana-decriminalization-initiative-had-enough-signatures-to-make-ballot-after-recount\/\" target=\"_blank\" rel=\"noopener\">turned in enough valid signatures to put a local decriminalization initiative<\/a>\u00a0before Kent voters after having missed the 2021 ballot due to a verification error on the part of county officials.
