Jeremy Cooney (D) is one of two pieces of legislation that he\u2019s filing to address the marijuana banking issue, though the other has yet to be formally introduced.<\/p>\n<p>It\u2019s another example of how state lawmakers are taking matters into their own hands as Congress continues to stall on enacting a federal fix to more broadly protect banks and credit unions that service cannabis businesses from being penalized by financial regulators.<\/p>\n<p>Cooney\u2019s new bill, <a href=\"https:\/\/www.nysenate.gov\/legislation\/bills\/2021\/s8758\" target=\"_blank\" rel=\"noopener\">SB S8758<\/a>, would take a modest step at the state level by authorizing the Office of Cannabis Management (OCM) to \u201cshare any and all information obtained from applicants and licensees\u2026to requesting financial institutions for the purpose of consideration and compliance,\u201d the text states.<\/p>\n<p>A justification section for the measure, which has been referred to the Senate Investigations And Government Operations Committee, says that federal prohibition of marijuana \u201ccreates challenges to banking licensed cannabis companies.\u201d<\/p>\n<p><strong>\u2014<br \/>\n<strong>Marijuana Moment is already <a href=\"https:\/\/www.marijuanamoment.net\/bills\/\" target=\"_blank\" rel=\"noopener\">tracking more than 1,000 cannabis, psychedelics and drug policy bills<\/a> in state legislatures and Congress this year. <a href=\"https:\/\/www.patreon.com\/marijuanamoment\" target=\"_blank\" rel=\"noopener\">Patreon supporters<\/a> pledging at least $25\/month get access to our interactive maps, charts and hearing calendar so they don\u2019t miss any developments.<\/strong><br \/>\n<a href=\"https:\/\/www.marijuanamoment.net\/bills\/\" target=\"_blank\" rel=\"noopener\"><img loading=\"lazy\" class=\"alignnone wp-image-9128 size-medium\" src=\"https:\/\/cannabiscultivatornews.com\/home\/wp-content\/uploads\/2022\/04\/MM_Bill_Tracker_V5_blank-20.jpg\" alt=\"\" width=\"300\" height=\"300\" \/><\/a><br \/>\n<strong>Learn more about our <a href=\"https:\/\/www.marijuanamoment.net\/bills\/\" target=\"_blank\" rel=\"noopener\">marijuana bill tracker<\/a> and become a <a href=\"https:\/\/www.patreon.com\/marijuanamoment\/\" target=\"_blank\" rel=\"noopener\">supporter on Patreon<\/a> to get access.<br \/>\n\u2014<\/strong><\/strong><\/p>\n<p>\u201cDue to rigorous federal compliance rules and anti-money laundering laws, financial institutions face increased costs and little to no incentive to take on cannabis businesses as clients,\u201d it says, noting that federal guidance in place requires banks to <a href=\"https:\/\/www.marijuanamoment.net\/more-banks-report-working-with-marijuana-businesses-as-pressure-builds-to-pass-on-congress-to-pass-reform-bill\/\" target=\"_blank\" rel=\"noopener\">submit suspicious activity reports for marijuana-related transactions<\/a>, which can be costly and onerous.<\/p>\n<p>The New York bill is meant to help by allowing financial institutions to \u201chave access to verify personal and financial information for their prospective cannabis clients,\u201d which will improve \u201ccompliance and make it easier and less costly for financial institutions who want to bank cannabis businesses to comply with the federal reporting.\u201d<\/p>\n<p>The justification also stresses that the lack of banking access for marijuana businesses constitutes a public safety threat, as many are left operating with large volumes of cash that make them targets of crime. It also says the bill would \u201cfurthers the social equity goals\u201d of New York\u2019s legalization law by \u201cremoving some of the financial and systemic barriers that can prevent individuals from actually participating in the market safely.\u201d<\/p>\n<p>Marijuana Moment reached out to Cooney\u2019s office for comment on the separate pending bill that was first <a href=\"https:\/\/www.syracuse.com\/marijuana\/2022\/04\/sen-cooney-introduces-new-cannabis-banking-bill.html\" target=\"_blank\" rel=\"noopener\">reported<\/a> by Syracuse NY Cannabis Insider, but a representative was not immediately available.<\/p>\n<p>Separately, New York lawmakers are also seeking to <a href=\"https:\/\/www.marijuanamoment.net\/new-york-marijuana-businesses-would-get-state-tax-breaks-despite-federal-280e-provision-under-budget-deal\/\" target=\"_blank\" rel=\"noopener\">provide tax breaks for the forthcoming marijuana market<\/a>,\u00a0<a href=\"https:\/\/www.marijuanamoment.net\/new-york-lawmakers-send-budget-with-marijuana-business-tax-breaks-to-governor-as-partial-280e-workaround\/\" target=\"_blank\" rel=\"noopener\">approving a budget proposal that Gov. Kathy Hochul (D) signed<\/a>\u00a0over the weekend that would do just that.<\/p>\n<p>Cooney <a href=\"https:\/\/www.marijuanamoment.net\/new-york-bill-would-allow-marijuana-industry-to-deduct-business-expenses-on-state-taxes\/\" target=\"_blank\" rel=\"noopener\">filed a standalone bill in December<\/a> seeking a similar carve-out for the state\u2019s burgeoning cannabis industry, and Assemblymember Donna Lupardo (D) followed suit in her chamber.<\/p>\n<p>Outside of New York, the Pennsylvania Senate on Wednesday approved a bill to <a href=\"https:\/\/www.marijuanamoment.net\/pennsylvania-senate-approves-marijuana-banking-bill-sending-it-to-the-house\/\" target=\"_blank\" rel=\"noopener\">safeguard banks and insurers against being penalized by state regulators<\/a> for working with state-legal medical marijuana businesses. It\u2019s now scheduled for floor consideration on Wednesday.<\/p>\n<p>The bill, which previously <a href=\"https:\/\/www.marijuanamoment.net\/pennsylvania-senators-approve-marijuana-banking-protection-bill-as-congressional-reform-stalls\/\" target=\"_blank\" rel=\"noopener\">advanced through the Senate Banking &amp; Insurance Committee<\/a>\u00a0late last month, would not immunize banks and insurers from potential federal repercussions\u2014but it\u2019s an interim step meant to signal to the financial sector that they at least won\u2019t face penalties under state law.<\/p>\n<p>The move to provide state-level protections could also add pressure on congressional lawmakers to enact a federal change, such as the bipartisan Secure and Fair Enforcement (SAFE) Banking Act that has <a href=\"https:\/\/www.marijuanamoment.net\/marijuana-banking-sponsor-says-hes-in-amendment-talks-with-senate-leader-as-house-passes-reform-for-sixth-time\/\" target=\"_blank\" rel=\"noopener\">passed the House in some form six times<\/a>\u00a0at this point, only to stall in the Senate.<\/p>\n<p>One possible vehicle for that congressional policy change could be a large-scale manufacturing and innovation bill, where marijuana banking was included by the House and\u00a0<a href=\"https:\/\/www.marijuanamoment.net\/marijuana-banking-push-set-to-be-revived-as-congressional-leaders-appoint-negotiators-on-large-scale-manufacturing-bill\/\" target=\"_blank\" rel=\"noopener\">may now be taken up by appointed negotiators<\/a>\u00a0in both chambers as they head to conference.<\/p>\n<p>Rodney Hood, a board member and former chairman of the National Credit Union Administration (NCUA), has repeatedly\u00a0<a href=\"https:\/\/www.marijuanamoment.net\/federal-financial-regulator-cheers-state-marijuana-banking-moves-as-congress-fails-to-act\/\" target=\"_blank\" rel=\"noopener\">emphasized the urgent need for a federal resolution<\/a>\u00a0to the marijuana banking problem. He recently\u00a0<a href=\"https:\/\/www.marijuanamoment.net\/federal-financial-regulator-talks-marijuana-industrys-bright-future-and-need-for-banking-access\/\" target=\"_blank\" rel=\"noopener\">applauded efforts by lawmakers in states like Pennsylvania<\/a>\u00a0to address the issue within their jurisdictions, but he said it\u2019s not enough.<\/p>\n<p>Washington State Treasurer Mike Pellicciotti (D) has also been especially vocal about the need for congressional reform, and he\u00a0<a href=\"https:\/\/www.marijuanamoment.net\/washington-treasurer-urges-colleagues-in-other-states-to-pressure-congress-to-pass-marijuana-banking-bill\/\" target=\"_blank\" rel=\"noopener\">wrote in a recent letter to his colleagues<\/a>\u00a0in other states that it\u2019s \u201cjust not safe to have this financial volume in cash.\u201d<\/p>\n<p>Pellicciotti made similar remarks at a\u00a0<a href=\"https:\/\/www.marijuanamoment.net\/state-treasurers-discuss-marijuana-banking-challenges-at-annual-conference-with-congressional-officials\/\" target=\"_blank\" rel=\"noopener\">recent conference of the National Association of State Treasurers (NAST)<\/a>. And Colorado Treasurer Dave Young\u00a0<a href=\"https:\/\/www.marijuanamoment.net\/colorado-treasurer-discusses-need-for-federal-marijuana-banking-reform-and-impact-of-senate-inaction\/\" target=\"_blank\" rel=\"noopener\">echoed that sentiment in a recent interview<\/a>\u00a0with Marijuana Moment.<\/p>\n<p>The sponsor of the congressional SAFE Banking Act, Rep. Ed Perlmutter (D-CO), told Marijuana Moment on Monday that he\u2019s hopeful that his reform legislation will be attached to the final America COMPETES Act that\u2019s heading to conference.<\/p>\n<p>The congressman pointed out that \u201cmore than two-thirds of the conferees [for the large-scale bill] have already voted for or cosponsored the SAFE Banking Act.\u201d<\/p>\n<p>One of those conferees, longstanding marijuana reform champion Rep. Earl Blumenauer (D-OR), said in an op-ed for Marijuana Moment this week that\u00a0<a href=\"https:\/\/www.marijuanamoment.net\/were-at-a-critical-threshold-for-cannabis-reform-congressman-says-op-ed\/\" target=\"_blank\" rel=\"noopener\">the banking reform measure as \u201ca huge step\u201d<\/a>\u00a0toward public safety and equity in the industry.<\/p>\n<p>Perlmutter also recently\u00a0<a href=\"https:\/\/www.marijuanamoment.net\/biden-treasury-secretary-says-congresss-marijuana-banking-inaction-is-extremely-frustrating\/\" target=\"_blank\" rel=\"noopener\">spoke with Treasury Secretary Janet Yellen<\/a>\u00a0about the marijuana banking issue during a hearing of the House Financial Services Committee. And the secretary said that it\u2019s \u201cextremely frustrating\u201d that Congress hasn\u2019t \u201cbeen able to resolve it.\u201d<\/p>\n<p>The sponsor has even made a point to talk about enacting the reform legislation\u00a0<a href=\"https:\/\/www.marijuanamoment.net\/marijuana-banking-sponsor-wont-stop-talking-about-his-bill-in-hearings-on-unrelated-legislation\/\" target=\"_blank\" rel=\"noopener\">during committee hearings on ostensibly unrelated or wider-ranging legislation<\/a>, like at a recent House Rules Committee hearing.<\/p>\n<p>At a recent event hosted by the American Bankers Association (ABA), the congressman said that he will\u00a0<a href=\"https:\/\/www.marijuanamoment.net\/congressman-pledges-to-be-a-real-pest-until-senate-passes-his-marijuana-banking-bill\/\" target=\"_blank\" rel=\"noopener\">\u201ccontinue to be a real pest, and persistent in getting this done\u201d<\/a>\u00a0before he retires from Congress at the end of the session.<\/p>\n<p>Despite recently\u00a0<a href=\"https:\/\/www.marijuanamoment.net\/house-marijuana-banking-bill-sponsor-is-confident-it-will-advance-through-senate-despite-obstacles\/\" target=\"_blank\" rel=\"noopener\">saying that he\u2019s \u201cconfident\u201d that the Senate will take up his bill<\/a>\u00a0this session, Perlmutter recognized that while he\u2019s supportive of revisions related to criminal justice reform, taxation, research and other issues, he knows that \u201cas we expand this thing, then we start losing votes, particularly Republican votes and we got enough votes in the Senate to do it\u201d as is.<\/p>\n<p>Ahead of last month\u2019s ABA event, the financial group released a poll that it commissioned showing that a strong majority of Americans\u00a0<a href=\"https:\/\/www.marijuanamoment.net\/americans-want-congress-to-pass-marijuana-banking-bill-poll-from-american-bankers-association-poll-finds\/\" target=\"_blank\" rel=\"noopener\">support freeing up banks to work with marijuana businesses<\/a>\u00a0without facing federal penalties.<\/p>\n<p>Meanwhile, the number of banks that report working with marijuana businesses\u00a0<a href=\"https:\/\/www.marijuanamoment.net\/more-banks-report-working-with-marijuana-businesses-as-pressure-builds-to-pass-on-congress-to-pass-reform-bill\/\" target=\"_blank\" rel=\"noopener\">ticked up again near the end of 2021<\/a>, according to recently released federal data.<\/p>\n<p>It\u2019s not clear if the increase is related to congressional moves to pass a bipartisan cannabis banking reform bill, but the figures from the Financial Crimes Enforcement Network (FinCEN) signal that financial institutions continue to feel more comfortable servicing businesses in state-legal markets.<\/p>\n<p>Some Republicans are scratching their heads about how Democrats have so far failed to pass the modest banking reform with majorities in both chambers and control of the White House, too. For example, Rep. Rand Paul (R-KY)\u00a0<a href=\"https:\/\/www.marijuanamoment.net\/rand-paul-mocks-democrats-for-failing-to-pass-marijuana-banking-in-annual-festivus-grievances-list\/\" target=\"_blank\" rel=\"noopener\">criticized his Democratic colleagues over the issue<\/a>\u00a0in December.<\/p>\n<p>Back in New York, the banking bill is just one step that state lawmakers and officials are taking to prepare to launch the recreational marijuana industry. Regulators advanced a rule last month to make it so people with prior marijuana convictions, or whose family members have been harmed by criminalization, will get the <a href=\"https:\/\/www.marijuanamoment.net\/new-york-regulators-unanimously-advance-rule-to-let-people-with-marijuana-convictions-open-shop-before-big-businesses-can-enter-market\/\" target=\"_blank\" rel=\"noopener\">first round of adult-use marijuana retailer licenses<\/a>\u2014ahead of existing medical cannabis businesses. A recent poll found that\u00a0<a href=\"https:\/\/www.marijuanamoment.net\/most-new-york-voters-oppose-prioritizing-marijuana-licenses-for-people-with-previous-convictions-poll-finds\/\" target=\"_blank\" rel=\"noopener\">most New Yorkers voters are against that proposal<\/a>.<\/p>\n<p>The state has also taken separate steps to get the industry in a position to have products available by creating provisional marijuana cultivator and processor licenses for existing hemp businesses that take certain steps to promote equity in the emerging industry.\u00a0<a href=\"https:\/\/www.marijuanamoment.net\/new-york-governor-signs-bill-to-let-hemp-farmers-start-growing-adult-use-marijuana-while-promoting-equity\/\" target=\"_blank\" rel=\"noopener\">Hochul signed that legislation in February<\/a>.<\/p>\n<p>Assembly Majority Leader Crystal Peoples-Stokes (D), who sponsored the legislation\u00a0that created the legalization law and recently\u00a0<a href=\"https:\/\/www.marijuanamoment.net\/new-york-assembly-leader-launches-pac-that-will-support-pro-marijuana-reform-candidates\/\" target=\"_blank\" rel=\"noopener\">launched an equity-focused political action committee<\/a>\u00a0that will place a strong focus on electing candidates that support marijuana reform, said that \u201cwe are doing what no other state has done by focusing on the people most criminalized by cannabis prohibition, and promoting New York farmers.\u201d<\/p>\n<p>As it stands, adults 21 and older can\u00a0<a href=\"https:\/\/www.marijuanamoment.net\/cops-cant-arrest-you-for-smoking-marijuana-on-sidewalks-nypd-says-in-post-legalization-memo\/\" target=\"_blank\" rel=\"noopener\">possess and publicly consume cannabis<\/a>, as well as gift marijuana to other adults as long as they aren\u2019t being compensated. But regulators are still finalizing licensing rules, and there are currently no retailers that are authorized to sell cannabis for adult use in the state.<\/p>\n<p>Hochul has repeatedly emphasized her interest in\u00a0<a href=\"https:\/\/www.marijuanamoment.net\/getting-new-york-marijuana-legalization-rolling-is-a-priority-new-governors-office-says\/\" target=\"_blank\" rel=\"noopener\">efficiently implementing the legalization law<\/a>.<\/p>\n<p>The governor released a State of the State book in January that called for\u00a0<a href=\"https:\/\/www.marijuanamoment.net\/new-york-governor-announces-200-million-marijuana-fund-to-promote-industry-equity\/\" target=\"_blank\" rel=\"noopener\">the creation of a $200 million public-private fund<\/a>\u00a0to specifically help promote social equity in the state\u2019s burgeoning marijuana market. That funding, called the \u201cNew York Social Equity Cannabis Investment Program,\u201d is the last component of the Seeding Opportunity Initiative.<\/p>\n<p>Hochul said that while cannabis business licenses have yet to be approved since legalization was signed into law last year, the market stands to generate billions of dollars, and it\u2019s important to \u201ccreate opportunities for all New Yorkers, particularly those from historically marginalized communities.\u201d<\/p>\n<p>That proposal was\u00a0<a href=\"https:\/\/www.marijuanamoment.net\/new-york-will-generate-more-than-1-25-billion-in-marijuana-revenue-over-next-six-years-governors-budget-estimates\/\" target=\"_blank\" rel=\"noopener\">also cited in the governor\u2019s executive budget<\/a>, which was released in January. The budget also estimated that New York stands to generate more than $1.25 billion in marijuana tax revenue over the next six years.<\/p>\n<p>Enacting legislation that expedites licensing could help the state reduce the number of businesses that are effectively using the legal \u201cgifting\u201d provision of the state\u2019s marijuana law to give away cannabis for \u201cfree\u201d if a non-marijuana-related purchase is made.<\/p>\n<p>New York regulators recently\u00a0<a href=\"https:\/\/www.marijuanamoment.net\/new-york-regulators-crack-down-on-businesses-gifting-marijuana-as-state-prepares-to-approve-licensed-retailers\/\" target=\"_blank\" rel=\"noopener\">issued warnings to more than two dozen businesses<\/a>\u00a0that they allege are either illegally selling marijuana without a license or exploiting the \u201cgifting\u201d component.<\/p>\n<p><strong>Here are some other ways that New York lawmakers and regulators are working to build upon the legalization law as the state prepares to implement retail sales:\u00a0<\/strong><\/p>\n<p>In February, for example, a state senator filed a bill that would\u00a0<a href=\"https:\/\/www.marijuanamoment.net\/new-york-senator-files-marijuana-recycling-bill-to-mitigate-environmental-impact-of-new-industry\/\" target=\"_blank\" rel=\"noopener\">promote recycling in the marijuana industry<\/a>\u00a0once retail sales officially launch.<\/p>\n<p>Sen.
