Allowing responsible banking quite frankly means that there will be ways of transmitting money that are less dangerous,\u201d Street, who is also the sponsor of a bipartisan bill that he introduced last year <a href=\"https:\/\/www.marijuanamoment.net\/bipartisan-pennsylvania-senators-unveil-marijuana-legalization-bill-amid-whirlwind-of-reform-efforts-in-the-state\/\" target=\"_blank\" rel=\"noopener\">to legalize marijuana for adult use in the state<\/a>, said.<\/p>\n<p>\u201cWalking around with bags of cash is something that we need to move away from, and both the state and federal government need to take the appropriate provisions to prevent that,\u201d he said. \u201cIt is an access issue. Allowing banking improves the quality of access that patients will have, and ultimately, again, we in the commonwealth have an obligation\u2014as does the federal government\u2014to take the appropriate steps to allow this.\u201d<\/p>\n<p>The senators previously <a href=\"https:\/\/www.marijuanamoment.net\/bipartisan-pennsylvania-senators-to-file-marijuana-banking-protection-bill-as-congressional-reform-stalls\/\" target=\"_blank\" rel=\"noopener\">circulated a co-sponsorship memo to colleagues<\/a> ahead of the bill\u2019s introduction that raised similar points.<\/p>\n<p>The text of the bill says that state government agencies cannot \u201cprohibit, penalize or otherwise discourage a financial institution or insurer from providing financial or insurance services to a legitimate cannabis-related business or the business associates of a legitimate cannabis-related business.\u201d<\/p>\n<p class=\"p1\">It also says agencies cannot \u201crecommend, incentivize or encourage a financial institution or insurer\u201d to not provide services just because a business is associated with marijuana.<\/p>\n<p>Further, state agencies could \u201cnot take adverse or corrective supervisory action on a loan made to a legitimate cannabis-related business,\u201d the text says.<\/p>\n<p>Prior to passing the marijuana banking bill, the panel adopted an amendment that the chairman described as technical in nature, saying it \u201crecognizes legitimate cannabis-related businesses authorized through federal law such as the [Drug Enforcement Administration] grower applications for research and requires disclosures for the suspension or revocation of federal permits. It also clarifies financial institution and insurer requirements to obtain legal protections.\u201d<\/p>\n<p>This is another example of how states are taking proactive steps to shield financial institutions and support their cannabis markets, while at the same time pressuring Congress to act.<\/p>\n<p>For example, Washington State officials on Tuesday held a virtual roundtable to address the <a href=\"https:\/\/www.marijuanamoment.net\/washington-officials-step-up-push-for-federal-marijuana-banking-reform-following-string-of-deadly-robberies\/\" target=\"_blank\" rel=\"noopener\">recent spate of deadly robberies targeting marijuana retailers<\/a>, with regulators reiterating their call for a federal policy change and discussing steps the state can take on its own while Congress fails to act.<\/p>\n<p>Lawmakers, advocates and representatives of cannabis businesses that have been recently robbed took part in the event, which was\u00a0<a href=\"https:\/\/www.marijuanamoment.net\/after-surge-of-deadly-robberies-at-marijuana-shops-in-washington-state-officials-push-for-federal-banking-reform\/\" target=\"_blank\" rel=\"noopener\">organized by the state\u2019s Liquor and Cannabis Board (LCB)<\/a>\u00a0after at least three people were killed within the span of four recent days at three different Washington cannabis retailers.<\/p>\n<p>\u201cA decade of congressional dithering is enough,\u201d Washington State Treasurer Mike Pellicciotti said, referring to the fact that the House has repeatedly advanced marijuana banking legislation only to be blocked in the Senate under Republican and Democratic control. \u201cWe are at a point where Congress needs to pass the SAFE Banking Act.\u201d<\/p>\n<p>Pellicciotti made similar remarks at a <a href=\"https:\/\/www.marijuanamoment.net\/state-treasurers-discuss-marijuana-banking-challenges-at-annual-conference-with-congressional-officials\/\" target=\"_blank\" rel=\"noopener\">recent conference of the National Association of State Treasurers (NAST)<\/a>. And Colorado Treasurer Dave Young\u00a0<a href=\"https:\/\/www.marijuanamoment.net\/colorado-treasurer-discusses-need-for-federal-marijuana-banking-reform-and-impact-of-senate-inaction\/\" target=\"_blank\" rel=\"noopener\">echoed that sentiment in a recent interview<\/a>\u00a0with Marijuana Moment.<\/p>\n<p>SAFE Banking Act sponsor Rep. Ed Perlmutter (D-CO), for his part, is committed to getting something done before his retirement at the end of this session. He\u2019s even made a point to talk about enacting the reform legislation <a href=\"https:\/\/www.marijuanamoment.net\/marijuana-banking-sponsor-wont-stop-talking-about-his-bill-in-hearings-on-unrelated-legislation\/\" target=\"_blank\" rel=\"noopener\">during committee hearings on ostensibly unrelated or wider-ranging legislation<\/a>, like at a recent House Rules Committee hearing.<\/p>\n<p>At a recent event hosted by the American Bankers Association (ABA), the congressman said that he will\u00a0<a href=\"https:\/\/www.marijuanamoment.net\/congressman-pledges-to-be-a-real-pest-until-senate-passes-his-marijuana-banking-bill\/\" target=\"_blank\" rel=\"noopener\">\u201ccontinue to be a real pest, and persistent in getting this done\u201d<\/a>\u00a0before he leaves Congress.<\/p>\n<p>Following the bipartisan House passage of the banking bill, Perlmutter said he naively expected it \u201cto sail through the Senate, which is always a bad assumption, because nothing sails through the Senate.\u201d<\/p>\n<p>But he\u2019s taken pains to build support, including from current Senate leadership that has insisted on enacting comprehensive legalization with firm equity provisions in place before advancing a bill viewed as friendly to the industry.<\/p>\n<p>Despite recently\u00a0<a href=\"https:\/\/www.marijuanamoment.net\/house-marijuana-banking-bill-sponsor-is-confident-it-will-advance-through-senate-despite-obstacles\/\" target=\"_blank\" rel=\"noopener\">saying that he\u2019s \u201cconfident\u201d that the Senate will take up his bill<\/a>\u00a0this session, the congressman recognized that while he\u2019s supportive of revisions related to criminal justice reform, taxation, research and other issues, he knows that \u201cas we expand this thing, then we start losing votes, particularly Republican votes and we got enough votes in the Senate to do it\u201d as is.<\/p>\n<p>Perlmutter also brought up the fact that Treasury Secretary Janet Yellen has\u00a0<a href=\"https:\/\/www.marijuanamoment.net\/biden-treasury-secretary-says-of-course-marijuana-banking-would-make-irss-job-easier\/\" target=\"_blank\" rel=\"noopener\">addressed the federal-state marijuana banking conflict<\/a>\u00a0and \u201cshe wants to get this off her plate and get it done.\u201d<\/p>\n<p>Ahead of the ABA\u00a0event, the financial group released a poll that it commissioned showing that a strong majority of Americans\u00a0<a href=\"https:\/\/www.marijuanamoment.net\/americans-want-congress-to-pass-marijuana-banking-bill-poll-from-american-bankers-association-poll-finds\/\" target=\"_blank\" rel=\"noopener\">support freeing up banks to work with marijuana businesses<\/a>\u00a0without facing federal penalties.<\/p>\n<p>Meanwhile, the number of banks that report working with marijuana businesses\u00a0<a href=\"https:\/\/www.marijuanamoment.net\/more-banks-report-working-with-marijuana-businesses-as-pressure-builds-to-pass-on-congress-to-pass-reform-bill\/\" target=\"_blank\" rel=\"noopener\">ticked up again near the end of 2021<\/a>, according to recently released federal data.<\/p>\n<p>It\u2019s not clear if the increase is related to congressional moves to pass a bipartisan cannabis banking reform bill, but the figures from the Financial Crimes Enforcement Network (FinCEN) signal that financial institutions continue to feel more comfortable servicing businesses in state-legal markets.<\/p>\n<p>Some Republicans are scratching their heads about how Democrats have so far failed to pass the modest banking reform with majorities in both chambers and control of the White House, too. For example, Rep. Rand Paul (R-KY)\u00a0<a href=\"https:\/\/www.marijuanamoment.net\/rand-paul-mocks-democrats-for-failing-to-pass-marijuana-banking-in-annual-festivus-grievances-list\/\" target=\"_blank\" rel=\"noopener\">criticized his Democratic colleagues over the issue<\/a>\u00a0in December.<\/p>\n<p>In the interim, federal financial regulator Rodney Hood\u2014a board member and former chairman of the federal National Credit Union Administration (NCUA)\u2014recently said that marijuana legalization is not a question of \u201cif\u201d but \u201cwhen,\u201d and he\u2019s again offering advice on\u00a0<a href=\"https:\/\/www.marijuanamoment.net\/federal-financial-regulator-talks-marijuana-industrys-bright-future-and-need-for-banking-access\/\" target=\"_blank\" rel=\"noopener\">how to navigate the federal-state conflict<\/a>\u00a0that has left many banks reluctant to work with cannabis businesses.<\/p>\n<p>Back in Pennsylvania, a key Senate committee <a href=\"https:\/\/www.marijuanamoment.net\/key-pennsylvania-senate-committee-completes-final-marijuana-legalization-hearing-to-inform-reform-legislation\/\" target=\"_blank\" rel=\"noopener\">held the last of three scheduled hearings on marijuana legalization<\/a> earlier this month, taking testimony that\u2019s designed to help inform a forthcoming reform bill that the panel\u2019s chairman is actively drafting.<\/p>\n<p>The Senate Law and Justice Committee meeting involved testimony from cannabis reform advocates, former regulators from other states and industry stakeholders.<\/p>\n<p>Sen. Mike Regan (R), who chairs the panel,\u00a0<a href=\"https:\/\/www.marijuanamoment.net\/bipartisan-pennsylvania-lawmakers-team-up-on-marijuana-legalization-bill-as-push-for-reform-in-the-state-heats-up\/\" target=\"_blank\" rel=\"noopener\">circulated a cosponsorship memo last year<\/a>\u00a0along with Rep. Amen Brown (D) to build support for the reform, and these meetings are designed to give lawmakers added context into the best approach to legalization for the state.<\/p>\n<p>At an initial hearing last month, much of the discussion focused on whether creating a regulated market\u00a0<a href=\"https:\/\/www.marijuanamoment.net\/pennsylvania-senators-discuss-marijuana-legalization-for-first-time-at-gop-led-committee-hearing\/\" target=\"_blank\" rel=\"noopener\">would be sufficient to eliminate illicit sales<\/a>, how police would be affected and the impact on impaired driving.<\/p>\n<p>The\u00a0<a href=\"https:\/\/www.marijuanamoment.net\/pennsylvania-senate-committee-holds-second-marijuana-legalization-hearing-as-reform-bill-is-drafted\/\" target=\"_blank\" rel=\"noopener\">second hearing held late last month<\/a>\u00a0centered on varying tax structures and other regulatory approaches that have been created in states like Illinois and California.<\/p>\n<p>While reform bills have been introduced in past sessions and the policy change has the support of Gov. Tom Wolf (D), the committee\u2019s final hearing marked only the third time a legislative panel had debated recreational legalization in the Republican-controlled Pennsylvania General Assembly.<\/p>\n<p>Street and Sen. Dan Laughlin (R), the chief sponsors of the bipartisan legalization bill filed last year, also recently filed a bill that would allow <a href=\"https:\/\/www.marijuanamoment.net\/bipartisan-pennsylvania-senators-file-bill-to-let-medical-marijuana-patients-grow-their-own-plants\/\" target=\"_blank\" rel=\"noopener\">medical marijuana patients to cultivate their own plants<\/a> for personal use. Street had attempted to get the reform enacted as an amendment to an omnibus bill last summer, <a href=\"https:\/\/www.marijuanamoment.net\/pennsylvania-senate-blocks-medical-marijuana-home-cultivation-amendment\/\" target=\"_blank\" rel=\"noopener\">but it did not advance<\/a>.<\/p>\n<p>Pennsylvania lawmakers could also take up more modest marijuana reform proposals like a bill filed late last year to\u00a0<a href=\"https:\/\/www.marijuanamoment.net\/pennsylvania-lawmaker-files-bill-to-expand-medical-marijuana-growers-prioritizing-small-farmers\/\" target=\"_blank\" rel=\"noopener\">expand the number of medical marijuana cultivators<\/a>\u00a0in the state, prioritizing small farms to break up what she characterized as a monopoly or large corporations that\u2019s created supply problems.<\/p>\n<p>Additionally, another pair of state lawmakers\u2014Reps. Jake Wheatley (D) and Dan Frankel (D)\u2014<a href=\"https:\/\/www.marijuanamoment.net\/pennsylvania-lawmakers-unveil-marijuana-legalization-bill-with-focus-on-social-equity\/\" target=\"_blank\" rel=\"noopener\">formally unveiled a legalization bill they\u2019re proposing<\/a>\u00a0last year.<\/p>\n<p>Philadelphia voters also\u00a0<a href=\"https:\/\/www.marijuanamoment.net\/philadelphia-voters-approve-marijuana-referendum-calling-for-statewide-legalization\/\" target=\"_blank\" rel=\"noopener\">approved a referendum on marijuana legalization<\/a>\u00a0in November that adds a section to the city charter saying that \u201cthe citizens of Philadelphia call upon the Pennsylvania General Assembly and the Governor to pass legislation that will decriminalize, regulate, and tax the use, and sale to adults aged 21 years or older, of cannabis for non-medical purposes.\u201d<\/p>\n<p>Wolf, the governor,\u00a0<a href=\"https:\/\/www.marijuanamoment.net\/pennsylvania-governor-says-marijuana-legalization-is-a-priority-in-budget-negotiations-with-lawmakers\/\" target=\"_blank\" rel=\"noopener\">said last year that marijuana legalization was a priority<\/a>\u00a0as he negotiated the annual budget with lawmakers. However, his formal spending request didn\u2019t contain legislative language to actually accomplish the cannabis policy change.<\/p>\n<p>The governor, who signed\u00a0<a href=\"https:\/\/www.marijuanamoment.net\/pennsylvania-governor-signs-medical-marijuana-expansion-bill-into-law\/\" target=\"_blank\" rel=\"noopener\">a medical cannabis expansion bill in June<\/a>, has repeatedly called for legalization and\u00a0<a href=\"https:\/\/www.marijuanamoment.net\/pennsylvania-governor-again-calls-on-lawmakers-to-legalize-marijuana\/\" target=\"_blank\" rel=\"noopener\">pressured the Republican-controlled legislature to pursue the reform<\/a>\u00a0since\u00a0<a href=\"https:\/\/www.marijuanamoment.net\/pennsylvania-governor-comes-out-in-support-of-marijuana-legalization\/\" target=\"_blank\" rel=\"noopener\">coming out in favor of the policy in 2019<\/a>. Shortly after he did that, a lawmaker filed a separate bill to\u00a0<a href=\"https:\/\/www.marijuanamoment.net\/bill-to-legalize-marijuana-through-state-run-model-introduced-in-pennsylvania\/\" target=\"_blank\" rel=\"noopener noreferrer\">legalize marijuana through a state-run model<\/a>.<\/p>\n<p>Meanwhile, Lt. Gov. John Fetterman (D), who is running for U.S. Senate this year, said one of his key goals in his final year in office is to ensure that as many eligible people as possible submit <a href=\"https:\/\/www.bop.pa.gov\/Apply%20for%20Clemency\/Pages\/Expedited-Review-Program.aspx\" target=\"_blank\" rel=\"noopener\">applications<\/a>\u00a0to have the courts\u00a0<a href=\"https:\/\/www.marijuanamoment.net\/pennsylvanias-lieutenant-governor-wants-to-process-as-many-marijuana-pardons-as-possible-before-leaving-office\/\" target=\"_blank\" rel=\"noopener\">remove their cannabis records and restore opportunities<\/a>\u00a0to things like housing, student financial aid and employment through an expedited petition program.<\/p>\n<p>A survey from Franklin &amp; Marshall College released last year found that\u00a0<a href=\"https:\/\/www.marijuanamoment.net\/support-for-marijuana-legalization-in-pennsylvania-hits-record-high-new-poll-finds\/\" target=\"_blank\" rel=\"noopener\">60 percent of Pennsylvania voters back adult-use legalization<\/a>.
