Edie Hooton (D) was significantly watered down with an amendment adopted by the panel that replaced all of its language with provisions to merely form a task force to explore marijuana employment challenges.<\/p>\n<p>The committee ultimately rejected the amended bill in a 1-12 vote.<\/p>\n<p>Under the revised legislation, a 15-member task force would have been created under the state Division of Labor and Employment that would convene in 2023 to study marijuana employment policies, with a report due by the year\u2019s end.<\/p>\n<p>The revised measure \u201cbrings together stakeholders impacted by current workplace practices favoring medical marijuana patients to find solutions and make recommendations for potential legislation in the absence of reliable testing,\u201d Hooton said in her opening remarks.<\/p>\n<p><strong>\u2014<br \/>\n<strong>Marijuana Moment is already <a href=\"https:\/\/www.marijuanamoment.net\/bills\/\" target=\"_blank\" rel=\"noopener\">tracking more than insurance, labor, medical marijuana patients, physicians and attorneys.<\/p>\n<p>\u201cThese are recommendations to the legislature, because that is required when the legislature establishes a task force,\u201d the sponsor said. \u201cNo one is required to act on those recommendations.\u201d<\/p>\n<p>The proposal was significantly dialed down from the bill Hooton first filed in February.<\/p>\n<p>The original <a href=\"https:\/\/leg.colorado.gov\/bills\/hb22-1152\" target=\"_blank\" rel=\"noopener\">legislation<\/a> would have stipulated that employers could not \u201ctake adverse action against an employee because the employee\u201d uses medical cannabis \u201con the premises of the employer during working hours\u201d or uses either medical cannabis or adult-use marijuana when they\u2019re off the job.<\/p>\n<p>There would have been exceptions to the protections if it related to a \u201cbona fide occupational requirement\u201d or \u201crationally related to the employment activities and responsibilities of a particular employee or a particular group of employees.\u201d<\/p>\n<p>Further, the protections would not have applied to workers if it would have been \u201cnecessary to avoid a conflict of interest with any responsibilities to the employer\u201d or the appearance of a conflict of interest.<\/p>\n<p>Hooton attempted to <a href=\"https:\/\/sg001-harmony.sliq.net\/00327\/Harmony\/en\/PowerBrowser\/PowerBrowserV2\/20220324\/25\/13011\" target=\"_blank\" rel=\"noopener\">explain<\/a> why she moved to strike the original language with this task force proposal.<\/p>\n<p>After receiving feedback from employment attorneys and workers\u2019 compensation officials, the lawmaker said those interests \u201cwould not necessarily lean favorably toward recommending any conditions under which medical marijuana use on the job would be acceptable to them.\u201d<\/p>\n<p>\u201cWhat I see the value of this being is the conversation and what is produced and this is absolutely the intention of the bill,\u201d she said.<\/p>\n<p>Even with the revised language, representatives of the Denver Metro Chamber of Commerce, the town manager of Monument, Colorado, a municipal water conservancy agency, the Colorado Mining Association, Colorado Restaurants Association, Colorado Aviation Association, Colorado Counties, Inc. and others all testified in opposition.<\/p>\n<p>There were some witnesses who recommended further amendments or voiced support, including one patient activist who said that using medical cannabis is sometimes necessary in order for patients to function in the workplace.<\/p>\n<h3>As more states have moved to reform cannabis law, there\u2019s been increased attention to workplace marijuana policies.<\/h3>\n<p>A federal labor recent report found that drug testing rates at U.S. workplaces <a href=\"https:\/\/www.marijuanamoment.net\/feds-reveal-which-industries-drug-test-workers-the-most-and-least-in-new-report\/\" target=\"_blank\" rel=\"noopener\">have fallen considerably over the past quarter-century<\/a>, as states began ending marijuana prohibition\u2014and the data also offered a glance at what types of industries are screening workers for drugs the most and the least.<\/p>\n<p>Meanwhile, as Missouri lawmakers work to advance marijuana legalization in the state, the St. Louis County Council approved a bill this month to <a href=\"https:\/\/www.marijuanamoment.net\/st-louis-county-lawmakers-vote-to-end-marijuana-testing-for-most-county-workers-as-state-moves-to-legalize\/\" target=\"_blank\" rel=\"noopener\">ban pre-employment and random drug testing<\/a> for cannabis for most county workers.<\/p>\n<p>The Kansas City, Missouri Council also <a href=\"https:\/\/www.marijuanamoment.net\/most-kansas-city-government-workers-will-no-longer-face-pre-employment-marijuana-tests-following-city-council-vote\/\" target=\"_blank\" rel=\"noopener\">voted last year to enact a similar policy drug testing policy change<\/a>\u00a0for cannabis.<\/p>\n<p>The Illinois House of Representatives recently passed legislation to <a href=\"https:\/\/www.marijuanamoment.net\/illinois-house-approves-workplace-protections-for-cannabis-consumers\/\" target=\"_blank\" rel=\"noopener\">protect workers from being fired for using cannabis<\/a>\u00a0in their free time, with some exceptions.<\/p>\n<p>A Washington, D.C. Council committee unanimously approved a bill this month to ban most workplaces from <a href=\"https:\/\/www.marijuanamoment.net\/d-c-lawmakers-approve-ban-on-pre-employment-marijuana-testing-for-most-workers\/\" target=\"_blank\" rel=\"noopener\">subjecting job applicants to pre-employment marijuana testing<\/a>. It would expand on previous legislation the D.C. Council approved to protect local government employees against\u00a0<a href=\"https:\/\/www.marijuanamoment.net\/workplace-protections-for-dc-medical-marijuana-patients-extended-under-emergency-bill\/\" target=\"_blank\" rel=\"noopener\">workplace discrimination due to their use of medical cannabis<\/a>.<\/p>\n<p>Following the enactment of adult-use legalization in New York, the state Department of Labor announced a policy change barring most employers from\u00a0<a href=\"https:\/\/www.marijuanamoment.net\/new-york-employers-cant-drug-test-most-workers-for-marijuana-state-announces\/\" target=\"_blank\" rel=\"noopener\">drug testing certain workers for marijuana<\/a>.<\/p>\n<p>At the federal level, House appropriations legislation and attached reports\u00a0<a href=\"https:\/\/www.marijuanamoment.net\/house-approves-marijuana-banking-employment-and-d-c-sales-provisions-in-large-scale-spending-bill\/\" target=\"_blank\" rel=\"noopener\">passed by the House last year<\/a>\u00a0directed federal government agencies to\u00a0<a href=\"https:\/\/www.marijuanamoment.net\/federal-agencies-should-reconsider-firing-workers-for-marijuana-congressional-committee-urges\/\" target=\"_blank\" rel=\"noopener\">reconsider policies that fire employees for using cannabis<\/a>\u00a0in compliance with state law.
