Brady Brammer (R) <a href=\"https:\/\/www.marijuanamoment.net\/gop-utah-lawmaker-files-bill-to-require-task-force-study-into-psychedelic-therapy-for-mental-health\/\" target=\"_blank\" rel=\"noopener\">first introduced the measure in January<\/a>, and it <a href=\"https:\/\/www.marijuanamoment.net\/utah-psychedelics-and-mental-health-bill-heads-to-governors-desk-after-senate-approval\/\" target=\"_blank\" rel=\"noopener\">cleared both chambers of the legislature<\/a> with nearly unanimous support, passing the House in a vote of 68-1 and clearing the Senate with a 23-1 tally.<\/p>\n<p>Gov. Spencer Cox (R) gave final approval to the measure on the deadline day for action, but as of press time has not yet officially announced the move.<\/p>\n<p>\u201cI am pleased to see the support from my colleagues and governor for this bill,\u201d Brammer told Marijuana Moment. \u201cIt isn\u2019t easy to set aside the stigma of psychedelics and explore their utility. I look forward to seeing the recommendations of the task force.\u201d<\/p>\n<p>There\u2019s nothing in the text of the bill that explicitly references psychedelics, but it\u2019s strongly implied\u2014and Brammer has repeatedly throughout the legislative process described the measure as a tool to explore the use of substances such as psilocybin.<\/p>\n<p>The bill will create a Mental Illness Psychotherapy Drug Task Force that will be required to \u201cstudy and make recommendations on drugs that may assist in treating mental illness.\u201d The psychotherapy drugs that the panel will consider are defined as controlled substances that are \u201cnot currently available for legal use\u201d and \u201cmay be able to treat, manage, or alleviate symptoms from mental illness.\u201d<\/p>\n<p>Brammer\u2019s\u00a0<a href=\"https:\/\/le.utah.gov\/~2022\/bills\/static\/HB0167.html\" target=\"_blank\" rel=\"noopener\">bill<\/a> outlines who will be appointed to the task force, including a psychiatrist, psychologist, Utah Medical Association representative, a researcher, a patient with experience with psychotherapy drugs and more.<\/p>\n<p><strong>\u2014<br \/>\n<strong>Marijuana Moment is already <a href=\"https:\/\/www.marijuanamoment.net\/bills\/\" target=\"_blank\" rel=\"noopener\">tracking more than 1,000 cannabis, psychedelics and drug policy bills<\/a> in state legislatures and Congress this year. <a href=\"https:\/\/www.patreon.com\/marijuanamoment\" target=\"_blank\" rel=\"noopener\">Patreon supporters<\/a> pledging at least $25\/month get access to our interactive maps, charts and hearing calendar so they don\u2019t miss any developments.<\/strong><br \/>\n<a href=\"https:\/\/www.marijuanamoment.net\/bills\/\" target=\"_blank\" rel=\"noopener\"><img loading=\"lazy\" class=\"alignnone wp-image-9128 size-medium\" src=\"https:\/\/cannabiscultivatornews.com\/home\/wp-content\/uploads\/2022\/03\/MM_Bill_Tracker_V5_blank-131.jpg\" alt=\"\" width=\"300\" height=\"300\" \/><\/a><br \/>\n<strong>Learn more about our <a href=\"https:\/\/www.marijuanamoment.net\/bills\/\" target=\"_blank\" rel=\"noopener\">marijuana bill tracker<\/a> and become a <a href=\"https:\/\/www.patreon.com\/marijuanamoment\/\" target=\"_blank\" rel=\"noopener\">supporter on Patreon<\/a> to get access.<br \/>\n\u2014<\/strong><\/strong><\/p>\n<p>\u201cThe task force shall provide evidence-based recommendations on any psychotherapy drug that the task force determines may enhance psychotherapy when treating a mental illness,\u201d the text of the measure states.<\/p>\n<p>Recommendations should touch on the types of symptoms that a given drug may treat, dosage and administration, training and licensing, how to obtain the substance, safety requirements, data tracking and \u201cproposed regulations the Legislature should consider if the psychotherapy drug is made legal for treating mental illness.\u201d<\/p>\n<p>The task force will need to submit a report with its recommendations to the Health and Human Services Interim Committee by October 31.<\/p>\n<p>Amid a mental health and drug overdose crisis, more lawmakers and activists are expressing interest in taking a new approach to treatment that might involve psychedelics. Others are more generally interested in decriminalizing or legalizing the substances.<\/p>\n<p>For instance, a Missouri House committee on Monday held a hearing on a GOP-led bill to\u00a0<a href=\"https:\/\/www.marijuanamoment.net\/missouri-lawmakers-discuss-gop-led-psychedelics-therapy-and-decriminalization-bill-in-committee\/\" target=\"_blank\" rel=\"noopener\">legalize a wide range of psychedelics for therapeutic use<\/a>\u00a0at designated care facilities while further decriminalizing low-level possession in general.<\/p>\n<p>A Connecticut legislative committee approved a bill last week that would set the state up to provide certain patients with\u00a0<a href=\"https:\/\/www.marijuanamoment.net\/connecticut-lawmakers-approve-bill-to-fund-psilocybin-and-mdma-therapy\/\" target=\"_blank\" rel=\"noopener\">access to psychedelic-assisted treatment<\/a>\u00a0with substances like MDMA and psilocybin. Connecticut Gov. Ned Lamont (D) signed a separate bill last year that includes language requiring the state to\u00a0<a href=\"https:\/\/www.marijuanamoment.net\/connecticut-governor-signs-psychedelics-study-measure-as-he-awaits-marijuana-legalization-bill\/\" target=\"_blank\" rel=\"noopener\">carry out a study into the therapeutic potential<\/a>\u00a0of psilocybin mushrooms. A\u00a0<a href=\"https:\/\/portal.ct.gov\/DMHAS\/Newsworthy\/News-Items\/Psilocybin-Study-Workgroup\" target=\"_blank\" rel=\"noopener\">workgroup<\/a>\u00a0has since been meeting\u00a0to investigate the issue.<\/p>\n<p>A Maryland House of Delegates committee held a hearing last week on a bill to create a state fund that\u00a0<a href=\"https:\/\/www.marijuanamoment.net\/maryland-lawmakers-discuss-bill-to-fund-psychedelics-research-and-access-for-veterans-in-committee\/\" target=\"_blank\" rel=\"noopener\">could be used to provide access to psychedelics<\/a>\u00a0like psilocybin, MDMA and ketamine for military veterans suffering from post-traumatic stress disorder (PTSD).<\/p>\n<p>The Washington State legislature recently sent a budget bill to the governor\u2019s desk that includes a proposal to\u00a0<a href=\"https:\/\/www.marijuanamoment.net\/washington-state-legislature-approves-200000-in-psilocybin-research-funding-in-budget\/\" target=\"_blank\" rel=\"noopener\">direct $200,000 in funding to support a new workgroup<\/a>\u00a0to study the possibility of legalizing psilocybin services in the state, including the idea of using current marijuana regulatory systems to track psychedelic mushrooms.<\/p>\n<p>This month, the Hawaii Senate approved a bill to set up a state working group to\u00a0<a href=\"https:\/\/www.marijuanamoment.net\/hawaii-senate-unanimously-approves-psilocybin-task-force-bill-with-decriminalization-measures-still-pending\/\" target=\"_blank\" rel=\"noopener\">study the therapeutic benefits of psilocybin mushrooms<\/a>\u00a0and develop a \u201clong-term\u201d plan to ensure that the psychedelic is accessible for medical use for adults 21 and older.<\/p>\n<p>Also this month, the Oklahoma House of Representatives passed a bill to\u00a0<a href=\"https:\/\/www.marijuanamoment.net\/oklahoma-house-passes-psilocybin-decriminalization-and-research-bill-sending-it-to-senate\/\" target=\"_blank\" rel=\"noopener\">decriminalize low-level possession of psilocybin<\/a>\u00a0and promote research into the therapeutic potential of the psychedelic.<\/p>\n<p>A bipartisan coalition of Georgia lawmakers recently filed a resolution that\u00a0<a href=\"https:\/\/www.marijuanamoment.net\/georgia-bill-would-create-psychedelic-study-committee-to-recommend-reform-policies\/\" target=\"_blank\" rel=\"noopener\">calls for the formation of a House study committee<\/a>\u00a0to investigate the therapeutic potential of psychedelics like psilocybin and make recommendations for reforms.<\/p>\n<p>Rhode Island lawmakers introduced\u00a0<a href=\"https:\/\/www.marijuanamoment.net\/rhode-island-lawmakers-file-psilocybin-and-broader-drug-decriminalization-bills-while-legal-marijuana-momentum-increases\/\" target=\"_blank\" rel=\"noopener\">a pair of drug decriminalization bills this month<\/a>\u2014including one focused on psilocybin and buprenorphine that would authorize doctors to prescribe the psychedelic mushroom.<\/p>\n<p>An Oregon Senate committee also recently advanced a bill to ensure that equity is\u00a0<a href=\"https:\/\/www.marijuanamoment.net\/oregon-lawmakers-file-psilocybin-equity-bill-as-state-implements-legal-use-program\/\" target=\"_blank\" rel=\"noopener\">built into the state\u2019s historic therapeutic psilocybin program<\/a>\u00a0that\u2019s actively being implemented following voter approval in 2020.<\/p>\n<p>A bill to decriminalize a wide array of psychedelics in Virginia was taken up by a House of Delegates panel in January,\u00a0<a href=\"https:\/\/www.marijuanamoment.net\/virginia-house-committee-pushes-back-psychedelics-decriminalization-bill-until-2023-but-senate-proposal-still-pending\/\" target=\"_blank\" rel=\"noopener\">only to be pushed off until 2023<\/a>. A separate Senate proposal to decriminalize psilocybin alone\u00a0<a href=\"https:\/\/www.marijuanamoment.net\/virginia-psilocybin-decriminalization-bill-defeated-in-senate-committee-after-top-gop-lawmaker-flips-support\/\" target=\"_blank\" rel=\"noopener\">was later defeated in a key committee<\/a>.<\/p>\n<p>California Sen. Scott Wiener (D) told Marijuana Moment in a recent interview that his bill to\u00a0<a href=\"https:\/\/www.marijuanamoment.net\/california-senator-says-bill-to-legalize-psychedelics-possession-has-50-50-chance-to-pass-this-year\/\" target=\"_blank\" rel=\"noopener\">legalize psychedelics possession<\/a>\u00a0stands a 50\/50 chance of reaching the governor\u2019s desk this year. It already cleared the full Senate and two Assembly committees during the first half of the two-year session.<\/p>\n<p>Washington State lawmakers\u00a0<a href=\"https:\/\/www.marijuanamoment.net\/psilocybin-services-would-be-legalized-in-washington-state-under-new-bill\/\" target=\"_blank\" rel=\"noopener\">also introduced legislation in January<\/a>\u00a0that would legalize what the bill calls \u201csupported psilocybin experiences\u201d by adults 21 and older.<\/p>\n<p>Meanwhile, a Pennsylvania bill meant to promote research into the therapeutic potential of psilocybin mushrooms for certain mental health conditions may be in jeopardy, with the sponsor saying that the chair of a key House committee is <a href=\"https:\/\/www.marijuanamoment.net\/pennsylvania-psilocybin-research-bill-in-limbo-after-key-committee-chair-raises-concern-over-mushroom-overdose-sponsor-says\/\" target=\"_blank\" rel=\"noopener\">expressing reservations even after the legislation<\/a> was amended in an effort to build support.<\/p>\n<p>New Hampshire lawmakers filed measures to\u00a0<a href=\"https:\/\/www.marijuanamoment.net\/new-hampshire-lawmakers-file-psilocybin-and-broader-drug-decriminalization-bills-for-2022\/\" target=\"_blank\" rel=\"noopener\">decriminalize psilocybin and all drugs<\/a>.<\/p>\n<p>Legislation was\u00a0<a href=\"https:\/\/www.marijuanamoment.net\/texas-will-study-benefits-of-psychedelics-for-military-veterans-under-bill-enacted-without-governors-signature\/\" target=\"_blank\" rel=\"noopener\">also enacted by the Texas legislature<\/a>\u00a0last year requiring the state to study the medical risks and benefits of psilocybin, MDMA and ketamine for military veterans in partnership with Baylor College of Medicine and a military-focused medical center.<\/p>\n<p>A pair of Michigan senators also introduced a bill in September to\u00a0<a href=\"https:\/\/www.marijuanamoment.net\/possessing-and-cultivating-psychedelics-would-be-legalized-in-michigan-under-new-senate-bill\/\" target=\"_blank\" rel=\"noopener\">legalize the possession, cultivation and delivery<\/a>\u00a0of an array of plant- and fungi-derived psychedelics like psilocybin and mescaline.<\/p>\n<p>In a setback for the movement, California activists on Wednesday announced that they have come up short on collecting enough signatures to\u00a0<a href=\"https:\/\/www.marijuanamoment.net\/california-activists-drop-2022-psilocybin-legalization-ballot-initiative-after-falling-short-of-signature-requirement\/\" target=\"_blank\" rel=\"noopener\">qualify a measure to legalize psilocybin mushrooms<\/a>\u00a0for the state\u2019s November ballot, though they aren\u2019t giving up on a future election cycle bid.<\/p>\n<p>Colorado activists, meanwhile, recently selected one of the four psychedelics reform ballot initiatives that they drafted and filed for the November ballot, choosing to\u00a0<a href=\"https:\/\/www.marijuanamoment.net\/colorado-activists-pick-one-of-several-psychedelics-reform-initiatives-to-pursue-for-november-ballot\/\" target=\"_blank\" rel=\"noopener\">proceed with a measure to legalize psilocybin<\/a>, create licensed \u201chealing centers\u201d where people can use the psychedelic for therapeutic purposes and provide a pathway for record sealing for prior convictions.
