Jason Nemes (R), cleared the House Judiciary Committee in a 15-1 vote. Meanwhile, separate adult-use and medical legalization bills were <a href=\"https:\/\/www.marijuanamoment.net\/kentucky-democrats-file-bills-to-legalize-marijuana\/\" target=\"_blank\" rel=\"noopener\">filed by Democratic lawmakers<\/a> last month.<\/p>\n<p>Nemes filed a medical legalization bill in 2020 that\u00a0<a href=\"https:\/\/www.marijuanamoment.net\/kentucky-house-approves-medical-marijuana-legalization-bill\/\" target=\"_blank\" rel=\"noopener\">soundly passed the House<\/a>\u00a0but later died in the Senate without a vote amid the early part of the coronavirus pandemic. He\u00a0<a href=\"https:\/\/www.marijuanamoment.net\/kentucky-lawmakers-file-bill-to-legalize-medical-marijuana-as-governor-steps-up-call-for-reform\/\" target=\"_blank\" rel=\"noopener\">reintroduced the legislation<\/a>\u00a0for the 2021 session, but it did not advance.<\/p>\n<p>In the months since, the lawmaker has worked to build support\u2014and he recently earned the endorsement of Senate Judiciary Chairman Whitney Westerfield (R), who said he will back the House bill despite personal reservations about marijuana reform because he\u2019s heard from constituents who stand to benefit from the treatment option.<\/p>\n<blockquote class=\"twitter-tweet\" data-width=\"550\" data-dnt=\"true\">\n<p lang=\"en\" dir=\"ltr\">A word about <a href=\"https:\/\/twitter.com\/jmnemes?ref_src=twsrc%5Etfw\" target=\"_blank\" rel=\"nofollow noopener\">@jmnemes<\/a>\u2019 HB136 \u2014 I appreciate his hard work on this:  <a href=\"https:\/\/twitter.com\/hashtag\/kyga22?src=hash&amp;ref_src=twsrc%5Etfw\" target=\"_blank\" rel=\"nofollow noopener\">#kyga22<\/a> <a href=\"https:\/\/twitter.com\/hashtag\/kyleg?src=hash&amp;ref_src=twsrc%5Etfw\" target=\"_blank\" rel=\"nofollow noopener\">#kyleg<\/a> <a href=\"https:\/\/t.co\/xjSleLxESq\" target=\"_blank\" rel=\"nofollow noopener\">pic.twitter.com\/xjSleLxESq<\/a><\/p>\n<p>\u2014 Whitney Westerfield (@KyWhitney) <a href=\"https:\/\/twitter.com\/KyWhitney\/status\/1501410023070707715?ref_src=twsrc%5Etfw\" target=\"_blank\" rel=\"nofollow noopener\">March 9, 2022<\/a><\/p>\n<\/blockquote>\n<p \/>\n<p>\u201cI think the debate is over with respect to whether or not medical cannabis helps people,\u201d Nemes said at Thursday\u2019s hearing. \u201cI don\u2019t think there\u2019s anybody\u2014even the staunchest opponents\u2014that says that it doesn\u2019t help some people. I think that debate is in the past.\u201d<\/p>\n<p>\u201cThis bill is no joke,\u201d he continued. \u201cThis is a law enforcement-heavy, this is a medication-heavy bill. This is not a wink-wink nod-nod to get to recreational. I don\u2019t want to slouch toward recreational.\u201d<\/p>\n<p>Nemes has continually expressed confidence that the reform legislation would advance through the legislature if only leadership <a href=\"https:\/\/www.marijuanamoment.net\/kentucky-medical-marijuana-bill-will-pass-if-leadership-has-courage-to-allow-a-vote-on-new-version-sponsor-says\/\" target=\"_blank\" rel=\"noopener\">had the \u201ccourage\u201d to put it to a vote<\/a>.<\/p>\n<p>The bill, HB 136, introduced in January, would establish a relatively restrictive program, prohibiting both the home cultivation of marijuana and the smoking of cannabis flower. At a minimum, the conditions will include any type of cancer, epilepsy and seizure disorders, multiple sclerosis, nausea or vomiting and chronic, severe, intractable or debilitating pain.<\/p>\n<p>The program would launch in early 2023 if the <a href=\"https:\/\/apps.legislature.ky.gov\/record\/22RS\/HB136.html\" target=\"_blank\" rel=\"noopener\">legislation<\/a> is approved.<\/p>\n<p>The narrow approach is designed to win support among GOP leaders in the state Senate, who\u2019ve killed past versions of Nemes\u2019s proposal. Senate Floor Leader Damon Thayer (R), for example, steadfastly opposes the change, having warned that it\u2019s a fast track to full legalization.<\/p>\n<p>\u201cI know my constituents are for it,\u201d Thayer, who owns a whiskey distillery,\u00a0<a href=\"https:\/\/www.marijuanamoment.net\/gop-kentucky-senator-who-sells-bourbon-invites-voters-to-unseat-him-over-medical-marijuana-opposition\/\" target=\"_blank\" rel=\"noopener\">said during a televised panel in January<\/a>. \u201cBut this is a republic, and they elect us to go to Frankfort and make decisions on their behalf\u2014and if they don\u2019t like it, they can take it out on me in the next election.\u201d<\/p>\n<p>Others remain wary, such as House Speaker Pro Tempore David Meade (R), who said at the event that he\u2019s still \u201con the fence\u201d about medical cannabis.<\/p>\n<p>The Nemes bill includes provisions such as a ban on discrimination against cannabis patients in areas such as child custody matters and organ transplants. Students who use medical marijuana would be permitted to consume it on campus under the administration of a school nurse.<\/p>\n<p>Patients would be able to have a 10-day supply of marijuana products outside the home and up to a 30-day supply secured at their residence. Those amounts are still poorly defined, however, as the bill leaves it to regulators to determine what constitutes a day\u2019s worth of cannabis.<\/p>\n<p>Products would be subject to a 12 percent excise tax and taxes on gross receipts, with revenues split between state and local governments. Of all state revenue, 13.75 percent would go to local law enforcement to help enforce the new law.<\/p>\n<p>Business licensing would be fairly flexible, with no caps on license numbers or rules about vertical integration, as some other states have implemented.<\/p>\n<p>While Gov. Andy Beshear (D) has said that his focus will be on getting medical cannabis enacted this year, he said he also supports legislation introduced by Rep. Nima Kulkarni (D) in November that would prevent people from being incarcerated over marijuana for any use, saying he\u2019s in favor of that policy.<\/p>\n<p>Kulkarni\u2019s bill would\u00a0<a href=\"https:\/\/www.marijuanamoment.net\/kentucky-lawmaker-pre-files-marijuana-legalization-bills-for-2022-session\/\" target=\"_blank\" rel=\"noopener\">legalize the possession and personal cultivation of cannabis<\/a>, but it doesn\u2019t provide a regulatory framework for commercial sales.<\/p>\n<p>Democratic leaders from both chambers, meanwhile, said in January that <a href=\"https:\/\/www.marijuanamoment.net\/kentucky-democratic-leaders-say-medical-marijuana-legalization-will-be-top-2022-legislative-priority\/\" target=\"_blank\" rel=\"noopener\">legalizing medical marijuana will be a top legislative priority<\/a> for this year\u2019s session. And in the spirit, Senate Minority Floor Leader Morgan McGarvey (D) and two other colleagues filed their own legalization measure last month.<\/p>\n<p>The companion legislation\u2014<a href=\"https:\/\/apps.legislature.ky.gov\/record\/22rs\/sb186.html\" target=\"_blank\" rel=\"noopener\">SB 186<\/a> and <a href=\"https:\/\/apps.legislature.ky.gov\/record\/22rs\/hb521.html\" target=\"_blank\" rel=\"noopener\">HB 521<\/a>\u2014is dubbed LETT\u2019s Grow, an acronym built of the bills\u2019 main components: Legalizing sales, expunging crimes, treatment through medical use and taxing of adult-use sales.<\/p>\n<p>It would also expand funding for treatment of substance use disorder and earmark a portion of state proceeds for scholarship programs and grants to groups that have been disproportionately impacted by the drug war.<\/p>\n<p>If passed, the Democratic-led bill would legalize possession of up to a one ounce of marijuana in public and up to 12 ounces in a private space. Sharing of up to an ounce of cannabis between adults or patients would also be legal. People legally allowed to possess and use cannabis could also grow their own at home, with up to 10 mature marijuana plants per person.<\/p>\n<p>Medical use would be allowed for any medical condition \u201cfor which an authorized practitioner believes that a cardholder patient may receive therapeutic or palliative benefit from the use of medical cannabis.\u201d<\/p>\n<p>Sales of adult-use cannabis would be taxed at six percent at the state level, with municipalities able to add fees of up to five percent combined between local jurisdictions. Overall, sales would be taxed at no more than 11 percent, which is lower than most other legal states.<\/p>\n<p>All products would need to carry an advisory label and include basic details including ingredients and additives, net weight, an expiration or use-by date and \u201clabeling that differentiates between medical cannabis products and adult use cannabis products.\u201d Further, all packaging would need to be opaque.<\/p>\n<p>The bill would also forbid employers or professional organizations from discriminating against people who use cannabis off the job provided it does not affect their work performance or compromise safety. Smoking marijuana in public would remain illegal but be punishable by a maximum $100 fine.<\/p>\n<p>Anyone ever convicted of a misdemeanor for possession, delivery or manufacture of cannabis or cannabis-related paraphernalia could petition a court for expungement.
