It now heads to the House for consideration.<\/p>\n<p \/>\n<p>This is one of several psilocybin measures\u2014including one that\u2019s broader in scope by decriminalizing the substance and requiring the establishment of therapeutic psilocybin treatment centers\u2014that have been introduced and could be taken up in the legislature this session.<\/p>\n<p>The text of the\u00a0<a href=\"https:\/\/capitol.hawaii.gov\/measure_indiv.aspx?billtype=SB&amp;billnumber=3160&amp;year=2022\" target=\"_blank\" rel=\"noopener\">measure<\/a>\u00a0says that \u201cbecause the State has a shortage of mental health professionals, the State should actively consider novel, innovative, and safe solutions to treat its residents.\u201d It then outlines the proposed composition of the workgroup and what it would be tasked with investigating.<\/p>\n<p><strong>\u2014<br \/>\n<strong>Marijuana Moment is already <a href=\"https:\/\/www.marijuanamoment.net\/bills\/\" target=\"_blank\" rel=\"noopener\">tracking more than 1,000 cannabis, psychedelics and drug policy bills<\/a> in state legislatures and Congress this year. <a href=\"https:\/\/www.patreon.com\/marijuanamoment\" target=\"_blank\" rel=\"noopener\">Patreon supporters<\/a> pledging at least $25\/month get access to our interactive maps, charts and hearing calendar so they don\u2019t miss any developments.<\/strong><br \/>\n<a href=\"https:\/\/www.marijuanamoment.net\/bills\/\" target=\"_blank\" rel=\"noopener\"><img loading=\"lazy\" class=\"alignnone wp-image-9128 size-medium\" src=\"https:\/\/cannabiscultivatornews.com\/home\/wp-content\/uploads\/2022\/03\/MM_Bill_Tracker_V5_blank-48.jpg\" alt=\"\" width=\"300\" height=\"300\" \/><\/a><br \/>\n<strong>Learn more about our <a href=\"https:\/\/www.marijuanamoment.net\/bills\/\" target=\"_blank\" rel=\"noopener\">marijuana bill tracker<\/a> and become a <a href=\"https:\/\/www.patreon.com\/marijuanamoment\/\" target=\"_blank\" rel=\"noopener\">supporter on Patreon<\/a> to get access.<br \/>\n\u2014<\/strong><\/strong><\/p>\n<p>Members would be required to study \u201cthe medicinal and therapeutic effects of psilocybin\u201d and develop \u201ca long-term strategic plan to ensure the availability of therapeutic psilocybin or psilocybin-based products that are safe, accessible, and affordable for adults twenty-one years of age or older.\u201d<\/p>\n<p>While the report as drafted would have required the workgroup to submit a report with its findings and recommendations within 20 days of the 2023 legislative session, a committee approved a change that pushed back the effective date of the bill to January 1, 2050.<\/p>\n<p>Adding a \u201cdefective date\u201d is a common legislative practice in the Hawaii legislature to leave open opportunities to further consider and revise a given bill as it moves through the process, which could include resolving differences legislation between chambers in conference.<\/p>\n<p>The working group would also examine \u201cfederal, state, and local laws, regulations, administrative rules, and procedures regarding the therapeutic use of psilocybin,\u201d scientific research into the psychedelic and \u201crequirements, specifications, and guidelines for a medical professional to prescribe and provide psilocybin to patients in jurisdictions in which psilocybin is used to treat mental health conditions.\u201d<\/p>\n<p>In testimony for the first panel this bill moved through, the Department of Health expressed some reservations about the scope of the proposal.<\/p>\n<p>The House companion\u00a0<a href=\"https:\/\/capitol.hawaii.gov\/measure_indiv.aspx?billtype=HB&amp;billnumber=2400&amp;year=2022\" target=\"_blank\" rel=\"noopener\">version<\/a>\u00a0of the psychedelics legislation has yet to be scheduled for a hearing.<\/p>\n<p>The full Senate did approve measures with similar language and directives last year, but they were in the form of non-binding resolutions.<\/p>\n<p>What also remains to be seen is whether Hawaii lawmakers will have the appetite to advance a broader psilocybin bill that was filed for this session but has also yet to be scheduled for committee hearings.<\/p>\n<p>The\u00a0<a href=\"https:\/\/www.capitol.hawaii.gov\/measure_indiv.aspx?billtype=SB&amp;billnumber=2575&amp;year=2022\" target=\"_blank\" rel=\"noopener\">measure<\/a>, which is virtually identical to a\u00a0<a href=\"https:\/\/www.capitol.hawaii.gov\/measure_indiv.aspx?billtype=SB&amp;billnumber=738&amp;year=2022\" target=\"_blank\" rel=\"noopener\">bill<\/a>\u00a0that was carried over from the 2021 session, would remove psilocybin and psilocyn from the list of controlled substances and require the Department of Health to \u201cestablish designated treatment centers for the therapeutic administration of\u201d the psychedelics. It would further create a review panel to study and submit reports on the impacts of the reform to the legislature.<\/p>\n<p>The bill text is the same as the legislation that was carried over in 2021, except that the deadlines that the panel faced to submit their annual reports begins one year later in the new version.<\/p>\n<p>Also last year,\u00a0<a href=\"https:\/\/www.marijuanamoment.net\/hawaii-legislature-seeks-marijuana-exemption-from-dea-while-senate-requests-legal-psilocybin-plan\/\" target=\"_blank\" rel=\"noopener\">the state legislature adopted a resolution<\/a>\u00a0that asks the state to seek an exemption from the Drug Enforcement Administration (DEA) stipulating that it is permitted to run its medical cannabis program without federal interference.<\/p>\n<p>Hawaii is just one of numerous states where lawmakers are taking the lead on psychedelics reform this year.<\/p>\n<p>For example, the Oklahoma House of Representatives on Monday approved a bill to<a href=\"https:\/\/www.marijuanamoment.net\/oklahoma-house-passes-psilocybin-decriminalization-and-research-bill-sending-it-to-senate\/\" target=\"_blank\" rel=\"noopener\"> decriminalize low-level possession of psilocybin and promote research<\/a> into the therapeutic potential of the psychedelic, sending it to the Senate.<\/p>\n<p>Rhode Island lawmakers introduced\u00a0<a href=\"https:\/\/www.marijuanamoment.net\/rhode-island-lawmakers-file-psilocybin-and-broader-drug-decriminalization-bills-while-legal-marijuana-momentum-increases\/\" target=\"_blank\" rel=\"noopener\">a pair of drug decriminalization bills last week<\/a>\u2014including one focused on psilocybin and buprenorphine that would authorize doctors to prescribe the psychedelic mushroom.<\/p>\n<p>Also last week, a Missouri Republican lawmaker filed a bill that would\u00a0<a href=\"https:\/\/www.marijuanamoment.net\/gop-missouri-lawmaker-files-psychedelics-therapy-and-decriminalization-bill\/\" target=\"_blank\" rel=\"noopener\">legalize a wide range of psychedelics for therapeutic use<\/a>\u00a0at designated care facilities while further decriminalizing low-level possession in general.<\/p>\n<p>Last month,\u00a0<a href=\"https:\/\/www.marijuanamoment.net\/utah-psychedelics-and-mental-health-bill-heads-to-governors-desk-after-senate-approval\/\" target=\"_blank\" rel=\"noopener\">Utah lawmakers sent a bill to the governor<\/a>\u00a0that would create a task force to study and make recommendations on the\u00a0<a href=\"https:\/\/www.marijuanamoment.net\/gop-utah-lawmaker-files-bill-to-require-task-force-study-into-psychedelic-therapy-for-mental-health\/\" target=\"_blank\" rel=\"noopener\">therapeutic potential of psychedelic drugs<\/a>\u00a0and possible regulations for their lawful use.<\/p>\n<p>An Oregon Senate committee also recently advanced a bill to ensure that equity is\u00a0<a href=\"https:\/\/www.marijuanamoment.net\/oregon-lawmakers-file-psilocybin-equity-bill-as-state-implements-legal-use-program\/\" target=\"_blank\" rel=\"noopener\">built into the state\u2019s historic therapeutic psilocybin program<\/a>\u00a0that\u2019s actively being implemented following voter approval in 2020.<\/p>\n<p>A group of Maryland senators recently filed a bill that would\u00a0<a href=\"https:\/\/www.marijuanamoment.net\/maryland-senate-bill-would-provide-cost-free-access-to-psychedelics-for-military-veterans\/\" target=\"_blank\" rel=\"noopener\">create a state fund that could be used to provide free access to psychedelics<\/a>\u00a0like psilocybin, MDMA and ketamine for military veterans suffering from post-traumatic stress disorder (PTSD), while also supporting research into their therapeutic potential.<\/p>\n<p>A bill to decriminalize a wide array of psychedelics in Virginia was taken up by a House of Delegates panel in January,\u00a0<a href=\"https:\/\/www.marijuanamoment.net\/virginia-house-committee-pushes-back-psychedelics-decriminalization-bill-until-2023-but-senate-proposal-still-pending\/\" target=\"_blank\" rel=\"noopener\">only to be pushed off until 2023<\/a>. A separate Senate proposal to decriminalize psilocybin alone\u00a0<a href=\"https:\/\/www.marijuanamoment.net\/virginia-psilocybin-decriminalization-bill-defeated-in-senate-committee-after-top-gop-lawmaker-flips-support\/\" target=\"_blank\" rel=\"noopener\">was later defeated in a key committee<\/a>.<\/p>\n<p>California Sen. Scott Wiener (D) told Marijuana Moment in a recent interview that his bill to\u00a0<a href=\"https:\/\/www.marijuanamoment.net\/california-senator-says-bill-to-legalize-psychedelics-possession-has-50-50-chance-to-pass-this-year\/\" target=\"_blank\" rel=\"noopener\">legalize psychedelics possession<\/a>\u00a0stands a 50\/50 chance of reaching the governor\u2019s desk this year. It already cleared the full Senate and two Assembly committees during the first half of the two-year session.<\/p>\n<p>Washington State lawmakers\u00a0<a href=\"https:\/\/www.marijuanamoment.net\/psilocybin-services-would-be-legalized-in-washington-state-under-new-bill\/\" target=\"_blank\" rel=\"noopener\">also introduced legislation in January<\/a>\u00a0that would legalize what the bill calls \u201csupported psilocybin experiences\u201d by adults 21 and older.<\/p>\n<p>New Hampshire lawmakers filed measures to\u00a0<a href=\"https:\/\/www.marijuanamoment.net\/new-hampshire-lawmakers-file-psilocybin-and-broader-drug-decriminalization-bills-for-2022\/\" target=\"_blank\" rel=\"noopener\">decriminalize psilocybin and all drugs<\/a>.<\/p>\n<p>Last year, the governor of Connecticut signed legislation that includes language requiring the state to\u00a0<a href=\"https:\/\/www.marijuanamoment.net\/connecticut-governor-signs-psychedelics-study-measure-as-he-awaits-marijuana-legalization-bill\/\" target=\"_blank\" rel=\"noopener\">carry out a study into the therapeutic potential<\/a>\u00a0of psilocybin mushrooms.<\/p>\n<p>Similar legislation was\u00a0<a href=\"https:\/\/www.marijuanamoment.net\/texas-will-study-benefits-of-psychedelics-for-military-veterans-under-bill-enacted-without-governors-signature\/\" target=\"_blank\" rel=\"noopener\">also enacted by the Texas legislature<\/a>, requiring the state to study the medical risks and benefits of psilocybin, MDMA and ketamine for military veterans in partnership with Baylor College of Medicine and a military-focused medical center.<\/p>\n<p>Colorado officials last week\u00a0<a href=\"https:\/\/www.marijuanamoment.net\/colorado-officials-clear-psychedelics-legalization-ballot-language-bringing-activists-closer-to-signature-gathering\/\" target=\"_blank\" rel=\"noopener\">approved the language of two more psychedelics reform initiatives<\/a>\u00a0from the same campaign that already passed that procedural step for two separate measures it submitted late last year.
