Ron Hicks (R) and Oklahoma Rep. Scott Fetgatter (R)<\/strong><\/p>\n<p dir=\"ltr\">The fundamental problem with the marijuana legalization efforts moving forward state by state in the United States today is that the federal government has not ended the federal prohibition on marijuana. This situation has been recently <a href=\"https:\/\/www.marijuanamoment.net\/supreme-court-justice-clarence-thomas-slams-feds-marijuana-stance-as-contradictory-and-unstable\/\" target=\"_blank\" rel=\"noopener\">criticized by U.S. Supreme Court Justice Clarence Thomas<\/a>, who said this past June, \u201cOnce comprehensive, the Federal Government\u2019s current approach is a half-in, half-out regime that simultaneously tolerates and forbids local use of marijuana. This contradictory and unstable state of affairs strains basic principles of federalism and conceals traps for the unwary.\u201d<b \/><\/p>\n<p dir=\"ltr\">Both Missouri and Oklahoma have fallen into such traps, albeit for different reasons.\u00a0<b \/><\/p>\n<p dir=\"ltr\">In Oklahoma, a citizen\u2019s ballot initiative <a href=\"https:\/\/www.marijuanamoment.net\/oklahoma-voters-legalize-marijuana-for-medical-use\/\" target=\"_blank\" rel=\"noopener\">passed the nation\u2019s most free-market medical marijuana program<\/a>\u2014but because of the lack of regulation and enforcement in the program, criminal gangs and cartels have come to Oklahoma, growing marijuana in nominally licensed operations and then shipping product out of state, primarily to the East Coast. This year in Oklahoma, we estimate a staggering four million pounds of marijuana will be grown\u2014far more than the market demand from Oklahoma citizens.<b \/><\/p>\n<p dir=\"ltr\">In Missouri (and dozens of other states) a medical marijuana ballot initiative campaign funded by special interests put significant licensing restrictions in the Missouri Constitution\u2014leading to immense public controversy, the appearance of corruption in the licensing process and legislative investigations and hundreds of lawsuits when over 1,800 applications were arbitrarily denied. In 2018, the Federal Bureau of Investigation put out a <a href=\"https:\/\/www.marijuanamoment.net\/fbi-seeks-tips-on-marijuana-industry-corruption\/\" target=\"_blank\" rel=\"noopener\">national bulletin warning of public corruption and bribery<\/a> in states where licenses were restricted in this manner\u2014and dozens of federal investigations into public corruption and bribery have indicated this situation is a persistent threat to the very legitimacy of our state governments.<b \/><\/p>\n<blockquote class=\"twitter-tweet\" data-width=\"550\" data-dnt=\"true\">\n<p lang=\"en\" dir=\"ltr\">Proud to work with my colleague Oklahoma State Rep. My Cannabis Freedom Act centers expungement and restorative justice and I look forward to its passage <a href=\"https:\/\/twitter.com\/hashtag\/moleg?src=hash&amp;ref_src=twsrc%5Etfw\" target=\"_blank\" rel=\"nofollow noopener\">#moleg<\/a> <a href=\"https:\/\/t.co\/BHAwW0RP7C\" target=\"_blank\" rel=\"nofollow noopener\">https:\/\/t.co\/BHAwW0RP7C<\/a><\/p>\n<p>\u2014 Ron Hicks (@RNHCKS) <a href=\"https:\/\/twitter.com\/RNHCKS\/status\/1499435691457060868?ref_src=twsrc%5Etfw\" target=\"_blank\" rel=\"nofollow noopener\">March 3, 2022<\/a><\/p>\n<\/blockquote>\n<p \/>\n<p dir=\"ltr\">Now, in 2022, adult-use (sometimes called recreational) <a href=\"https:\/\/www.marijuanamoment.net\/missouri-activists-plan-marijuana-legalization-initiative-for-2022-ballot\/\" target=\"_blank\" rel=\"noopener\">marijuana campaigns are moving forward<\/a> with <a href=\"https:\/\/www.marijuanamoment.net\/oklahoma-becomes-marijuana-legalization-battleground-between-advocates-with-legal-challenges-and-a-new-ballot-initiative\/\" target=\"_blank\" rel=\"noopener\">ballot initiative campaigns in both states<\/a>, and because these campaigns are not willing or capable of engaging all stakeholders on this issue and putting the interests of our citizens first, we are faced with the hard truth of Justice Thomas\u2019s statement.<b \/><\/p>\n<p dir=\"ltr\">First, we call upon the federal government to act\u2014only federal action can smooth the way to a nationally regulated system that protects opportunity and ends the illegal market as it exists today.<b \/><\/p>\n<p dir=\"ltr\">Second, while we\u2019re waiting on Congress and the president to do their part, <a href=\"https:\/\/www.marijuanamoment.net\/gop-missouri-lawmaker-unveils-wide-ranging-marijuana-legalization-bill-as-others-pursue-2022-ballot\/\" target=\"_blank\" rel=\"noopener\">our state legislatures should do their part<\/a>\u2014on one hand, ensuring that criminal actors aren\u2019t able to game state marijuana licensing to perpetuate illegal interstate commerce\u2014and on the other hand, ensuring that opportunity is available to all who can demonstrate compliance with a reasonably regulated and enforced program.<\/p>\n<p dir=\"ltr\">It\u2019s important to get this right. American voters are ready to end the war on marijuana\u2014but their options shouldn\u2019t be governed by special interests that can\u2019t do the hard work of ensuring all stakeholders have a voice at the table. We can\u2019t afford to create a crisis of governmental legitimacy through going too far in either direction.\u00a0<b \/><\/p>\n<p dir=\"ltr\">That\u2019s why, in consultation with policymakers and lawmakers in different states that have been trapped in this quagmire, we\u2019re proposing sensible reforms in our state legislatures in 2022.
