Council committee on Thursday unanimously approved a bill to ban most workplaces from subjecting job applicants to pre-employment marijuana testing.<\/p>\n<p>The legislation, sponsored by Councilmember Trayon White (D), cleared the Labor &amp; Workforce Development Committee. It would expand on previous legislation the D.C. Council approved to protect local government employees against <a href=\"https:\/\/www.marijuanamoment.net\/workplace-protections-for-dc-medical-marijuana-patients-extended-under-emergency-bill\/\" target=\"_blank\" rel=\"noopener\">workplace discrimination due to their use of medical cannabis<\/a>.<\/p>\n<p>\u201cThis is an important step towards eliminating historic inequities of cannabis use and ensuring that those who use cannabis medically or recreationally are not penalized in their work spaces [for what they do] on their private time,\u201d White said at the committee meeting on Thursday.<\/p>\n<p>The new bill stipulates that, with certain exceptions, \u201cit shall be an unlawful discriminatory practice for an employer, labor organization, employment agency, or agent thereof to require a prospective employee to submit to testing for the presence of any tetrahydrocannabinols or marijuana in such prospective employee\u2019s system as a condition of employment.\u201d<\/p>\n<div class=\"fb-video\" data-allowfullscreen=\"true\" data-href=\"https:\/\/www.facebook.com\/CMElissaSilverman\/videos\/1331647053948070\" \/>\n<p>Police, safety-sensitive construction workers and people with jobs that require a commercial driver\u2019s license or work with childcare and patients and positions \u201cwith the potential to significantly impact the health or safety of employees or members of the public\u201d could still be drug tested for cannabis, however.<\/p>\n<p>There are also exceptions for workers contracted by the federal Department of Transportation (DOT).<\/p>\n<p>\u201cNothing in this act shall be construed to require an employer to permit or accommodate the use, consumption, possession, transfer, display, transportation, sale, or growing of marijuana in the workplace,\u201d the <a href=\"https:\/\/lims.dccouncil.us\/Legislation\/B24-0109\" target=\"_blank\" rel=\"noopener\">bill<\/a> says.<\/p>\n<p>The move is also consistent with moves in other states to loosen drug testing policies for marijuana as more states move to legalization.<\/p>\n<p>In New York, for example, the state Department of Labor announced last year that employers are <a href=\"https:\/\/www.marijuanamoment.net\/new-york-employers-cant-drug-test-most-workers-for-marijuana-state-announces\/\" target=\"_blank\" rel=\"noopener\">no longer allowed to drug test most workers for marijuana<\/a>.<\/p>\n<p>Prior to the passage of statewide legalization, New York City officials had established a\u00a0<a href=\"https:\/\/www.marijuanamoment.net\/new-york-city-adds-more-exceptions-to-pre-employment-marijuana-testing-ban\/\" target=\"_blank\" rel=\"noopener\">local ban on pre-employment drug testing<\/a>\u00a0for marijuana.<\/p>\n<p><strong>\u2014<br \/>\n<strong>Marijuana Moment is already <a href=\"https:\/\/www.marijuanamoment.net\/bills\/\" target=\"_blank\" rel=\"noopener\">tracking more than 1,000 cannabis, psychedelics and drug policy bills<\/a> in state legislatures and Congress this year. <a href=\"https:\/\/www.patreon.com\/marijuanamoment\" target=\"_blank\" rel=\"noopener\">Patreon supporters<\/a> pledging at least $25\/month get access to our interactive maps, charts and hearing calendar so they don\u2019t miss any developments.<\/strong><br \/>\n<a href=\"https:\/\/www.marijuanamoment.net\/bills\/\" target=\"_blank\" rel=\"noopener\"><img loading=\"lazy\" class=\"alignnone wp-image-9128 size-medium\" src=\"https:\/\/cannabiscultivatornews.com\/home\/wp-content\/uploads\/2022\/03\/MM_Bill_Tracker_V5_blank-17.jpg\" alt=\"\" width=\"300\" height=\"300\" \/><\/a><br \/>\n<strong>Learn more about our <a href=\"https:\/\/www.marijuanamoment.net\/bills\/\" target=\"_blank\" rel=\"noopener\">marijuana bill tracker<\/a> and become a <a href=\"https:\/\/www.patreon.com\/marijuanamoment\/\" target=\"_blank\" rel=\"noopener\">supporter on Patreon<\/a> to get access.<br \/>\n\u2014<\/strong><\/strong><\/p>\n<p>Drug testing and workplace issues related to marijuana has become a hot topic as more states move to end criminalization. The conversation has reached everywhere from private industry to Congress.<\/p>\n<p>For example, Amazon recently said that its earlier decision to end drug testing for cannabis will also be retroactive, meaning former workers and applicants who were punished for testing positive for THC\u00a0<a href=\"https:\/\/www.marijuanamoment.net\/amazon-reaffirms-support-for-marijuana-legalization-and-says-former-workers-punished-over-cannabis-are-eligible-for-employment\/\" target=\"_blank\" rel=\"noopener\">will have their employment eligibility restored<\/a>.<\/p>\n<p>Lawmakers in the Senate and House have both included language in recent appropriations reports urging a review of employment policies for federal agencies with respect to personal use of cannabis. The\u00a0<a href=\"https:\/\/www.marijuanamoment.net\/house-approves-marijuana-banking-employment-and-d-c-sales-provisions-in-large-scale-spending-bill\/\" target=\"_blank\" rel=\"noopener\">House version passed in July<\/a>, while\u00a0<a href=\"https:\/\/www.marijuanamoment.net\/democratic-senators-bill-would-let-dc-legalize-marijuana-sales-in-contrast-to-bidens-proposed-blockade\/\" target=\"_blank\" rel=\"noopener\">the Senate Democrats\u2019 report was released later that year<\/a>.<\/p>\n<p>The White House Office of Personnel Management (OPM) recently issued a memo to federal agencies that says admitting to past marijuana use <a href=\"https:\/\/www.marijuanamoment.net\/marijuana-use-wont-automatically-block-people-from-federal-jobs-biden-administration-memo-says\/\" target=\"_blank\" rel=\"noopener\">should not automatically disqualify people<\/a>\u00a0from being employed in the federal government.<\/p>\n<blockquote class=\"twitter-tweet\" data-width=\"550\" data-dnt=\"true\">\n<p lang=\"en\" dir=\"ltr\">Watch live now<\/p>\n<p>Markup<br \/>\u2013 Cannabis Employment Protections  Amendment Act<\/p>\n<p>Watch: <a href=\"https:\/\/t.co\/AI4bC6rUgg\" target=\"_blank\" rel=\"nofollow noopener\">https:\/\/t.co\/AI4bC6rUgg<\/a> <a href=\"https:\/\/t.co\/8itoOk8uyN\" target=\"_blank\" rel=\"nofollow noopener\">pic.twitter.com\/8itoOk8uyN<\/a><\/p>\n<p>\u2014 Council of DC (@councilofdc) <a href=\"https:\/\/twitter.com\/councilofdc\/status\/1499474950830362631?ref_src=twsrc%5Etfw\" target=\"_blank\" rel=\"nofollow noopener\">March 3, 2022<\/a><\/p>\n<\/blockquote>\n<p \/>\n<p>Back in D.C., the mayor recently signed a bill into law that will expand access to the District\u2019s medical marijuana program in a series of ways.<\/p>\n<p>Now, senior citizens will be able to self-certify their own eligibility for cannabis without having to get a recommendation from a doctor. The law also further extends the registration renewal deadline for patients and creates a week-long medical marijuana tax relief \u201choliday\u201d that coincides with the unofficial cannabis event known as 4\/20.<\/p>\n<p>That bill also generally <a href=\"https:\/\/www.marijuanamoment.net\/dc-allows-medical-marijuana-delivery-under-coronavirus-emergency-order\/\" target=\"_blank\" rel=\"noopener\">expand on prior emergency legislation that the Council approved<\/a>\u00a0at the height of the coronavirus pandemic to extend registration eligibility for the medical cannabis program. Patients under 65 with registrations will continue to be validated through at least September 30.<\/p>\n<p>In 2019, another D.C. lawmaker\u00a0<a href=\"https:\/\/www.marijuanamoment.net\/dc-lawmaker-proposes-same-day-medical-marijuana-access-and-social-use-spaces\/\" target=\"_blank\" rel=\"noopener\">proposed a separate medical cannabis reform bill<\/a>\u00a0meant to ease the registration process for patients. Instead of having to wait several weeks for regulators to process their medical cannabis approvals, patients would simply fill out an application with the city health department and would then automatically qualify to legally purchase marijuana on a provisional basis.<\/p>\n<p>The legislation\u2019s author, at-large Councilmember David Grosso (I), introduced a similar bill in 2017, though that version allowed residents to\u00a0<a href=\"https:\/\/www.marijuanamoment.net\/dc-lawmaker-wants-to-let-people-get-medical-marijuana-without-doctor-approval\/\" target=\"_blank\" rel=\"noopener\">self-certify as medical marijuana patients<\/a>\u2014without the need to involve a doctor\u2014by signing an affidavit, and it didn\u2019t have the stipulation that their qualifications could be later rejected.<\/p>\n<p>These latest reform developments in D.C. come as the jurisdictions prepares to implement adult-use cannabis sales, which they\u2019ve been blocked from doing so due to a congressional rider despite D.C. voters approving legalization in 2014.<\/p>\n<p>Lawmakers held a joint hearing in November\u00a0<a href=\"https:\/\/www.marijuanamoment.net\/d-c-lawmakers-hold-joint-hearing-on-marijuana-legalization-bill-in-anticipation-of-end-to-federal-ban\/\" target=\"_blank\" rel=\"noopener\">on a pair of bills to authorize the legal sale of recreational marijuana<\/a>\u00a0and significantly expand the existing medical cannabis program in the nation\u2019s capital.<\/p>\n<p>A provision of the bill that could have led to a broad crackdown on the city\u2019s unregulated market for recreational cannabis was removed, much to the relief of advocates who\u00a0criticized the proposed measure over a component that would have punished businesses that \u201cgift\u201d marijuana in a manner that effectively circumvents the local prohibition on retail cannabis sales.<\/p>\n<p>Marijuana possession and gifting is legal under a voter-approved 2014 initiative\u2014but there currently isn\u2019t a regulated market and people aren\u2019t allowed to accept any form of renumeration for gifting.<\/p>\n<p>The U.S. House\u00a0<a href=\"https:\/\/www.marijuanamoment.net\/house-approves-marijuana-banking-employment-and-d-c-sales-provisions-in-large-scale-spending-bill\/\" target=\"_blank\" rel=\"noopener\">passed Fiscal Year 2022 spending legislation<\/a>\u00a0that would remove the block on D.C. marijuana sales in July. The Senate has not yet advanced its version of the bill through the Appropriations Committee or on the floor, though panel leaders released a draft measure in October that would\u00a0<a href=\"https:\/\/www.marijuanamoment.net\/democratic-senators-bill-would-let-dc-legalize-marijuana-sales-in-contrast-to-bidens-proposed-blockade\/\" target=\"_blank\" rel=\"noopener\">similarly let D.C. legalize marijuana commerce<\/a>.<\/p>\n<p>Democratic congressional leaders have been taking those steps toward deleting the rider despite the fact that <a href=\"https:\/\/www.marijuanamoment.net\/biden-budget-keeps-medical-marijuana-protections-but-would-block-d-c-from-legalizing-recreational-sales\/\" target=\"_blank\" rel=\"noopener\">President Joe Biden\u2019s budget proposal sought to continue the Republican-led ban<\/a>.<\/p>\n<p>Rep. Eleanor Holmes Norton (D-DC), who represents the District in Congress, said in November that she is\u00a0<a href=\"https:\/\/www.marijuanamoment.net\/on-eve-of-dc-marijuana-hearing-congresswoman-is-optimistic-that-federal-blockade-will-be-removed\/\" target=\"_blank\" rel=\"noopener\">\u201ccloser than ever\u201d to removing the blockade<\/a>\u00a0on cannabis commerce in her district.<\/p>\n<p>That said, it\u2019s not clear if a forthcoming funding bill for the rest of 2022 will continue the rider or not.<\/p>\n<p>Meanwhile, the mayor said last April that\u00a0<a href=\"https:\/\/www.marijuanamoment.net\/d-c-is-ready-to-legalize-marijuana-sales-as-soon-as-congress-gets-out-of-the-way-mayor-says\/\" target=\"_blank\" rel=\"noopener\">local officials are prepared to move forward<\/a>\u00a0with\u00a0<a href=\"https:\/\/www.marijuanamoment.net\/washington-d-c-could-allow-marijuana-sales-under-mayors-new-bill-and-democratic-control-of-congress\/\" target=\"_blank\" rel=\"noopener\">implementing a legal system of recreational marijuana sales<\/a>\u00a0in the nation\u2019s capital just as soon as they can get over the final \u201churdle\u201d of congressional interference.<\/p>\n<p>Bowser introduced a cannabis commerce bill last February, though her measure was not on the agenda for November\u2019s hearing alongside the\u00a0<a href=\"https:\/\/www.marijuanamoment.net\/top-washington-d-c-lawmaker-files-competing-legal-marijuana-bill-days-after-mayor-unveils-her-plan\/\" target=\"_blank\" rel=\"noopener\">cannabis legalization proposal\u00a0put forward by Mendelson<\/a>.<\/p>\n<p>Under the chairman\u2019s bill, at least half of marijuana business licensees would issued to social equity applicants, defined as people who faced previous convictions for cannabis-related offenses or have lived in areas with high levels of poverty, unemployment or marijuana arrests for 10 of the past 20 years.<\/p>\n<p>The tax rate for adult-use marijuana products would be set at 13 percent, while medical cannabis would be taxed at six percent.<\/p>\n<p>Thirty percent of tax revenue from cannabis sales would go toward a Cannabis Equity and Opportunity Fund, which would \u201cprovide loans, grants and technical assistance to these applicants.<\/p>\n<p>Fifty percent of tax revenue would go to a community reinvestment fund that would provide grants to \u201corganizations addressing issues such as economic development, homeless prevention, support for returning citizens, and civil legal aid in areas with high poverty, unemployment, and gun violence.<\/p>\n<p>The courts would be required to identify and expunge records for people convicted of marijuana offenses made legal under the law. People who are actively incarcerated could have their sentence \u201cmodified, vacated, or set aside.<\/p>\n<p>There are also consumer protections written into the legislation, ensuring that people using cannabis in compliance with the law don\u2019t lose benefits, employment or other social services.<\/p>\n<p>Local marijuana activists also proposed an amendment to Mendelson\u2019s legalization bill that would\u00a0<a href=\"https:\/\/www.marijuanamoment.net\/marijuana-could-be-sold-at-d-c-farmers-markets-under-amendment-unveiled-by-local-activists\/\" target=\"_blank\" rel=\"noopener\">allow small entrepreneurs to sell cannabis at farmers markets<\/a>. It\u2019s not clear when D.C. lawmakers will convene again to vote on proposed changes and the overall legislation.<\/p>\n<p>The separate medical cannabis\u00a0bill that the Council considered late last year would allow patients to obtain marijuana from any registered dispensary in the District, instead of just one that they\u2019re registered with under current law. A summary says that dispensaries could also \u201coperate safe use treatment facilities as well as offer tastings and demonstrations and\/or classes with the proper endorsements\u201d under the proposal.<\/p>\n<p>Further, delivery and curbside pickup would be permitted. The cap on the number of plants that a cultivation center can grow would be eliminated, and the number of dispensaries permitted in the District would be increased. Additionally, the bill seeks to remove \u201ccertain prohibitions against returning citizens ability to take part in the medical marijuana industry.\u201d<\/p>\n<p>Last March, a federal oversight agency determined that the congressional rider blocking marijuana sales in D.C. does not preclude local officials from\u00a0<a href=\"https:\/\/www.marijuanamoment.net\/d-c-can-take-steps-toward-legalizing-marijuana-sales-amid-congressional-ban-feds-conclude\/\" target=\"_blank\" rel=\"noopener\">taking procedural steps to prepare<\/a>\u00a0for the eventual reform, such as holding hearings, even if they cannot yet enact it with the blockade pending.<\/p>\n<p>Separately, another group of activists\u00a0<a href=\"https:\/\/www.marijuanamoment.net\/activists-push-d-c-lawmakers-to-decriminalize-drugs-and-promote-harm-reduction-with-new-campaign\/\" target=\"_blank\" rel=\"noopener\">announced an effort to pressure local lawmakers enact<\/a>\u00a0broad drug decriminalization, with a focus on promoting harm reduction programs, in the nation\u2019s capital.
