Ed Perlmutter (D-CO) noted that he\u2019s getting complaints from constituents who aren\u2019t receiving their mail on time due to worker shortages, saying that one under-appreciated factor behind the problem is that \u201cyou cannot be in the employ of the federal government or the post office if you have any kind of THC or cannabis in your system.\u201d<\/p>\n<p>\u201cIt stays in the system for 30, 60 days sometimes, is what I\u2019ve been told,\u201d he said.<\/p>\n<p>Perlmutter, the sponsor of a bipartisan marijuana banking reform bill that <a href=\"https:\/\/www.marijuanamoment.net\/house-marijuana-banking-bill-sponsor-is-confident-it-will-advance-through-senate-despite-obstacles\/\" target=\"_blank\" rel=\"noopener\">passed the House for the sixth time this month<\/a>, urged his colleagues to \u201cjust to kind of keep that in the back of the mind,\u201d adding that \u201cin Colorado, that [federal cannabis ban] can kind of cut the potential staffing numbers down.\u201d<\/p>\n<p \/>\n<p>He also jokingly mentioned that he could see a fellow committee member Rep. Mark DeSaulnier (D-CA) smiling on camera as he discussed the issue.<\/p>\n<p>The chair followed up by <a href=\"https:\/\/rules.house.gov\/bill\/117\/hr-3076\" target=\"_blank\" rel=\"noopener\">asking<\/a> if DeSaulnier if he would yield \u201cfor any cannabis-related questions,\u201d and the congressman replied, that \u201cas a former bartender in San Francisco in the 70s. I won\u2019t.\u201d However, after thanking members for their work on the <a href=\"https:\/\/rules.house.gov\/bill\/117\/hr-3076\" target=\"_blank\" rel=\"noopener\">legislation<\/a>, he joked that he would \u201cyield back, because I\u2019ve got a case of the munchies.\u201d<\/p>\n<p>The lighthearted exchange gets at the heart of a serious issue that advocates have been working to resolve. Federal prohibition and strict drug testing policies within government agencies have arguably had a chilling effect on employment, preventing qualified people from applying for certain jobs and putting current federal workers in jeopardy of losing their jobs if they consume a product that\u2019s increasingly legal in states across the country.<\/p>\n<p>Meanwhile, the director of national intelligence (DNI) said in a recent memo that federal employers <a href=\"https:\/\/www.marijuanamoment.net\/top-federal-intelligence-official-loosens-marijuana-restrictions-for-workers-and-addresses-cannabis-stocks\/\" target=\"_blank\" rel=\"noopener\">shouldn\u2019t outright reject security clearance applicants<\/a> over past marijuana use and should use discretion when it comes to those with cannabis investments in their stock portfolios.<\/p>\n<p>The FBI updated its hiring policies last year to make it so candidates are only automatically disqualified from joining the agency if they <a href=\"https:\/\/www.marijuanamoment.net\/fbi-loosens-marijuana-employment-policy-for-would-be-agents\/\" target=\"_blank\" rel=\"noopener\">admit to having used marijuana within one year<\/a>\u00a0of applying. Previously, prospective employees of the agency could not have used cannabis within the past three years.<\/p>\n<p>However, it\u2019s since <a href=\"https:\/\/www.marijuanamoment.net\/fbi-clarifies-that-using-marijuana-more-than-24-times-disqualifies-would-be-agents\/\" target=\"_blank\" rel=\"noopener\">further revised the policy to add a stipulation<\/a> that applicants are ineligible if they\u2019ve used cannabis more than 24 times after turning 18.<\/p>\n<p>Then-FBI Director James Comey suggested in 2014 that he wanted to\u00a0<a href=\"https:\/\/www.marijuanamoment.net\/james-comey-weighs-in-on-marijuana-legalization\/\" target=\"_blank\" rel=\"noopener\">loosen the agency\u2019s employment policies as it concerns marijuana<\/a>, as potential skilled workers were being passed over due to the requirement.<\/p>\n<p>The federal legalization of hemp has also prompted several agencies to update their employment policies.<\/p>\n<p>The Department of Defense, for example, made clear that\u00a0<a href=\"https:\/\/www.marijuanamoment.net\/u-s-military-reiterates-that-cbd-is-off-limits-to-service-members\/\" target=\"_blank\" rel=\"noopener noreferrer\">CBD is off limits for service members<\/a>.<\/p>\n<p>The Air Force\u00a0<a href=\"https:\/\/www.marijuanamoment.net\/defense-department-official-stresses-cbd-ban-for-military-members\/\" target=\"_blank\" rel=\"noopener noreferrer\">issued a notice<\/a>\u00a0in 2019 stipulating that its\u00a0<a href=\"https:\/\/www.marijuanamoment.net\/air-force-issues-notice-banning-cbd-use-regardless-of-legal-status\/\" target=\"_blank\" rel=\"noopener noreferrer\">members are prohibited from using the compound.<\/a><\/p>\n<p>The Navy told its ranks that\u00a0<a href=\"https:\/\/www.marijuanamoment.net\/navy-bans-sailors-from-using-cbd-despite-federal-hemp-legalization-new-memo-says\/\" target=\"_blank\" rel=\"noopener noreferrer\">they\u2019re barred from using CBD<\/a>\u00a0regardless of its legal status.<\/p>\n<p>And the Coast Guard said in 2019 that\u00a0<a href=\"https:\/\/www.marijuanamoment.net\/coast-guard-issues-order-barring-active-duty-members-from-visiting-marijuana-shops\/\" target=\"_blank\" rel=\"noopener noreferrer\">sailors can\u2019t use marijuana<\/a>\u00a0or visit state-legal dispensaries.<\/p>\n<p>NASA said that CBD products\u00a0<a href=\"https:\/\/www.marijuanamoment.net\/nasa-warns-employees-that-using-cbd-products-could-get-them-fired\/\" target=\"_blank\" rel=\"noopener noreferrer\">could contain unauthorized THC concentrations<\/a>\u00a0that could jeopardize jobs if employees fail a drug test.<\/p>\n<p>The Substance Abuse and Mental Health Services Administration\u00a0<a href=\"https:\/\/www.marijuanamoment.net\/this-is-why-federal-agencies-are-warning-employees-about-cbd\/\" target=\"_blank\" rel=\"noopener noreferrer\">issued guidance to federal agency drug program coordinators<\/a>\u00a0in 2019, expressing concern about excess THC in CBD products, which seems to have prompted the various departments to clarify their rules.<\/p>\n<p>The Department of Transportation took a different approach in 2020, stating in a notice that\u00a0<a href=\"https:\/\/www.marijuanamoment.net\/department-of-transportation-says-safety-sensitive-workers-wont-be-tested-for-cbd\/\" target=\"_blank\" rel=\"noopener noreferrer\">it would not be testing drivers for CBD<\/a>.<\/p>\n<p>For its part, the Drug Enforcement Administration continues to enforce its policy of automatically disqualifying applicants who\u2019ve used marijuana in the prior three years before applying.<\/p>\n<p>And while the Biden administration has instituted a policy of\u00a0<a href=\"https:\/\/www.marijuanamoment.net\/marijuana-use-wont-automatically-block-people-from-federal-jobs-biden-administration-memo-says\/\" target=\"_blank\" rel=\"noopener\">granting waivers to certain workers<\/a>\u00a0who admit to prior cannabis use, it\u2019s come under fire from advocates following reports that it fired or otherwise punished dozens of staffers who were honest about their history with marijuana.<\/p>\n<p>White House Press Secretary Jen Psaki has previously\u00a0<a href=\"https:\/\/www.marijuanamoment.net\/marijuana-use-wont-automatically-block-people-from-federal-jobs-biden-administration-memo-says\/\" target=\"_blank\" rel=\"noopener\">attempted to minimize the fallout<\/a>, without much success, and her office released a statement in March stipulating that\u00a0<a href=\"https:\/\/www.marijuanamoment.net\/white-house-says-biden-hasnt-fired-staff-for-marijuana-use-that-was-casual-or-years-ago\/\" target=\"_blank\" rel=\"noopener\">nobody was fired for \u201cmarijuana usage from years ago,\u201d<\/a>\u00a0nor has anyone been terminated \u201cdue to casual or infrequent use during the prior 12 months.\u201d<\/p>\n<p>A powerful congressional committee\u00a0<a href=\"https:\/\/www.marijuanamoment.net\/federal-agencies-should-reconsider-firing-workers-for-marijuana-congressional-committee-urges\/\" target=\"_blank\" rel=\"noopener\">released a report over the summer<\/a>\u00a0that urges federal agencies to reconsider policies that result in the firing of employees who use marijuana legally in accordance with state law.<\/p>\n<p>Separately, USPS released a final rule last year that asserting that even devices designed for federally legal hemp derivatives like CBD <a href=\"https:\/\/www.marijuanamoment.net\/usps-releases-final-rule-banning-mailing-of-hemp-cbd-and-marijuana-vapes\/\" target=\"_blank\" rel=\"noopener\">generally cannot be shipped through the U.S.
