She said she wanted to \u201cget a solid answer on the difference of her situation and mines.\u201d<\/p>\n<blockquote class=\"twitter-tweet\" data-width=\"550\" data-dnt=\"true\">\n<p lang=\"en\" dir=\"ltr\">Can we get a solid answer on the difference of her situation and mines? The test was conducted in December, so there are questions about the timing of the information\u2019s release, but in any case, RUSADA later lifted the temporary suspension, only to be challenged by WADA, the International Olympic Committee (IOC) and the International Skating Union (ISU).<\/p>\n<p>On Friday, the Court of Arbitration for Sport (CAS)\u2014an international body that resolves these types of Olympic disputes\u2014released a <a href=\"https:\/\/www.tas-cas.org\/fileadmin\/user_upload\/CAS_Ad_Hoc_Media_Release_Beijing_8.pdf\" target=\"_blank\" rel=\"noopener\">statement<\/a> rejecting the challenges, permitting Valieva to continue to participate. However, some penalties were imposed by IOC, such as the fact that there will be no medal ceremony held for her event if she finishes in the top three.<\/p>\n<p>While Richardson said she felt that race may have played a factor in the two different outcomes, CAS said that the reason was principally related to the fact that the 15-year-old skater is a minor and therefore a \u201cprotected person\u201d who is subject to a different standard under WADA code.<\/p>\n<p>\u201cThe RUSADA Anti-Doping Rules and the WADC are silent with respect to provisional suspension imposed on protected persons, while these rules have specific provisions for different standards of evidence and for lower sanctions in the case of protected persons,\u201d it said.<\/p>\n<p>\u201cThe CAS Ad hoc Division was requested to determine the narrow issue as to whether a provisional suspension should be imposed on the athlete. It was not requested to rule on the merits of this case, nor to examine the legal consequences relating to the results of the team event in figure skating, as such issues will be examined in other proceedings,\u201d it continued.<\/p>\n<p>Richard Pound, the first president of WADA, told Marijuana Moment in a phone interview on Monday that \u201ccertainly, in the Olympics, there\u2019s not a racial bias in anything that we do.\u201d<\/p>\n<p>\u201cI think the key for the Russian is that she\u2019s a minor,\u201d he said.<\/p>\n<p>Still, some U.S. sports commentators are taken aback by the CAS decision. But the details and ongoing questions about this case notwithstanding, it\u2019s the latest example of how the intersection of drugs and sports is becoming a broader question.<\/p>\n<p>Richardson, for her part, said last year that she\u2019d feel \u201cblessed and proud\u201d if the attention her case raised would <a href=\"https:\/\/www.marijuanamoment.net\/shacarri-richardson-says-shed-be-blessed-if-her-marijuana-suspension-led-to-end-of-the-ban-for-other-athletes\/\" target=\"_blank\" rel=\"noopener\">affect a policy change for other athletes<\/a>. Even the White House and President Joe Biden himself weighed in on the case, with the president suggesting that there\u2019s a question about <a href=\"https:\/\/www.marijuanamoment.net\/biden-suggests-anti-marijuana-rules-banning-athletes-like-shacarri-richardson-could-change\/\" target=\"_blank\" rel=\"noopener\">whether the marijuana ban should \u201cremain the rules.\u201d<\/a><\/p>\n<p>Pound commented on the extreme penalty for Richardson\u2019s positive cannabis test, saying he doesn\u2019t understand why regulators \u201cdidn\u2019t just say, \u2018sorry, about your mother, but for god\u2019s sake, be careful with this stuff because it\u2019s still on the list and you\u2019re exposing yourself to the possible sanctions,\u201d rather than outright suspend her.<\/p>\n<p><a href=\"https:\/\/www.marijuanamoment.net\/how-u-s-bullying-in-the-1990s-led-to-the-olympics-marijuana-ban-behind-richardsons-suspension\/\" target=\"_blank\" rel=\"noopener\">In an earlier interview with Marijuana Moment<\/a> last year, he said that the the U.S. bears much responsibility for the enactment of the cannabis ban.<\/p>\n<p>Outside of international sports, domestic athletic organizations in the U.S. have started to adopt different policies with respect to marijuana.<\/p>\n<p>For example, NFL\u2019s\u00a0<a href=\"https:\/\/www.marijuanamoment.net\/new-nfl-policy-would-end-suspensions-for-testing-positive-for-any-drug-not-just-marijuana\/\" target=\"_blank\" rel=\"noopener\">drug testing policy already changed demonstrably<\/a> in 2020 as part of a collective bargaining agreement.<\/p>\n<p>NFL players no longer face the possibility of being suspended from games over positive tests for any drug\u2014not just marijuana\u2014under a collective bargaining agreement. Instead, they will face a fine. The threshold for what constitutes a positive THC test was also increased under the deal.<\/p>\n<p>The NBA announced late last year that is extending its policy of\u00a0<a href=\"https:\/\/www.marijuanamoment.net\/nba-players-wont-be-tested-for-marijuana-next-year-as-league-weighs-permanent-change\/\" target=\"_blank\" rel=\"noopener\">not randomly drug testing players for marijuana<\/a>\u00a0through the 2021-2022 season. The association won\u2019t be subjecting players to random drug testing for THC; however, they will continue to test \u201cfor cause\u201d cases where players have histories of substance use.<\/p>\n<p>In a similar vein, the MLB decided in 2019 to\u00a0<a href=\"https:\/\/www.marijuanamoment.net\/mlb-officially-removes-marijuana-from-banned-substances-list-for-baseball-players\/\" target=\"_blank\" rel=\"noopener noreferrer\">remove cannabis from the league\u2019s list of banned substances<\/a>.
