Andrew Cuomo (D) signed an adult-use legalization bill into law last year, adults 21 and older were immediately permitted to <a href=\"https:\/\/www.marijuanamoment.net\/cops-cant-arrest-you-for-smoking-marijuana-on-sidewalks-nypd-says-in-post-legalization-memo\/\" target=\"_blank\" rel=\"noopener\">possess and publicly consume cannabis<\/a>, as well as gift marijuana to other adults as long as they weren\u2019t being compensated.<\/p>\n<p>But as regulators work to set up rules to authorize licensed retailers, some businesses are apparently taking advantage of the grey area by offering \u201cfree\u201d cannabis gifts to adult consumers who buy other lawful products and services.<\/p>\n<p>New York\u2019s Office of Cannabis Management (OCM) said in a press release on Tuesday that it has sent cease-and-desist letters to more than two dozen companies that are reportedly taking advantage of the gifting provision or otherwise illegally selling cannabis without a license.<\/p>\n<p>Those businesses could lose future licensing opportunities and face fines if they continue the activity, OCM said.<\/p>\n<p>\u201cWe have an obligation to protect New Yorkers from known risks and to strengthen the foundation of the legal, regulated market we are building,\u201d Cannabis Control Board (CCB) Chair Tremaine Wright said in a press release. \u201cWe will meet the goals of the MRTA to build an inclusive, equitable and safe industry. Therefore, these violators must stop their activity immediately, or face the consequences.\u201d<\/p>\n<blockquote class=\"twitter-tweet\" data-width=\"550\" data-dnt=\"true\">\n<p lang=\"en\" dir=\"ltr\">Today, we sent more than two dozen letters to illicit operators warning them that they&#8217;re putting at risk their ability to obtain a license for the legal market while also facing fines and possible criminal penalties: <a href=\"https:\/\/t.co\/5kL96JskGu\" target=\"_blank\" rel=\"nofollow noopener\">https:\/\/t.co\/5kL96JskGu<\/a><\/p>\n<p>\u2014 NYS Office of Cannabis Management (@nys_cannabis) <a href=\"https:\/\/twitter.com\/nys_cannabis\/status\/1491112993807306752?ref_src=twsrc%5Etfw\" target=\"_blank\" rel=\"nofollow noopener\">February 8, 2022<\/a><\/p>\n<\/blockquote>\n<p \/>\n<p>\u201cWe want to make sure these operators fully understand the law and the consequences they face and now that these letters have been sent, we fully expect them to cease and desist their activities \u2013 if they don\u2019t, we will take action,\u201d OCM Executive Director Chris Alexander <a href=\"https:\/\/cannabis.ny.gov\/news\/office-cannabis-management-announces-enforcement-action\" target=\"_blank\" rel=\"noopener\">said<\/a>.<\/p>\n<p style=\"padding-left: 40px\">\u201cNew York State is building a legal, regulated cannabis market that will ensure products are tested and safe for consumers while providing opportunities for those from communities most impacted by the over criminalization of the cannabis prohibition, and illegal operations undermine our ability to do that. We encourage New Yorkers to not partake in illicit sales where products may not be safe and we will continue to work to ensure that New Yorkers have a pathway to sell legally in the new industry.\u201d<\/p>\n<p>The regulatory gray space isn\u2019t unique to New York as it works to implement legalization.<\/p>\n<p>Following voter approval of a legalization referendum in New Jersey, the state attorney general <a href=\"https:\/\/www.marijuanamoment.net\/new-jersey-attorney-general-cracks-down-on-gift-marijuana-schemes-involving-overpriced-snacks\/\" target=\"_blank\" rel=\"noopener\">similarly sent warning letters to companies<\/a> that were effectively circumventing the state\u2019s marijuana laws by \u201cgifting\u201d cannabis in exchange for non-marijuana-related purchases such as overpriced cookies, brownies and stickers.<\/p>\n<p>The same regulatory dilemma is playing out in Washington, D.C., where voters approved a measure to legalize marijuana possession, cultivation and gifting in 2014 at the same time that the jurisdiction has been prevented from using its local tax dollars to implement commercial sales due to an ongoing congressional rider.<\/p>\n<p>D.C. lawmakers held a joint hearing in November <a href=\"https:\/\/www.marijuanamoment.net\/d-c-lawmakers-hold-joint-hearing-on-marijuana-legalization-bill-in-anticipation-of-end-to-federal-ban\/\" target=\"_blank\" rel=\"noopener\">on a pair of bills to authorize the legal sale of recreational marijuana<\/a> and significantly expand the existing medical cannabis program in the nation\u2019s capital if that rider is lifted.<\/p>\n<p>Back in New York, lawmakers have introduced several proposals to build upon the legalization law as the state prepares to approve retailers.<\/p>\n<p><strong>\u2014<br \/>\n<strong>Marijuana Moment is already <a href=\"https:\/\/www.marijuanamoment.net\/bills\/\" target=\"_blank\" rel=\"noopener\">tracking more than 1,000 cannabis, psychedelics and drug policy bills<\/a> in state legislatures and Congress this year. <a href=\"https:\/\/www.patreon.com\/marijuanamoment\" target=\"_blank\" rel=\"noopener\">Patreon supporters<\/a> pledging at least $25\/month get access to our interactive maps, charts and hearing calendar so they don\u2019t miss any developments.<\/strong><br \/>\n<a href=\"https:\/\/www.marijuanamoment.net\/bills\/\" target=\"_blank\" rel=\"noopener\"><img loading=\"lazy\" class=\"alignnone wp-image-9128 size-medium\" src=\"https:\/\/cannabiscultivatornews.com\/home\/wp-content\/uploads\/2022\/02\/MM_Bill_Tracker_V5_blank-32.jpg\" alt=\"\" width=\"300\" height=\"300\" \/><\/a><br \/>\n<strong>Learn more about our <a href=\"https:\/\/www.marijuanamoment.net\/bills\/\" target=\"_blank\" rel=\"noopener\">marijuana bill tracker<\/a> and become a <a href=\"https:\/\/www.patreon.com\/marijuanamoment\/\" target=\"_blank\" rel=\"noopener\">supporter on Patreon<\/a> to get access.<br \/>\n\u2014<\/strong><\/strong><\/p>\n<p>Just last week, for example, a New York senator filed a bill that would <a href=\"https:\/\/www.marijuanamoment.net\/new-york-senator-files-marijuana-recycling-bill-to-mitigate-environmental-impact-of-new-industry\/\" target=\"_blank\" rel=\"noopener\">promote recycling in the marijuana industry<\/a> once retail sales officially launch.<\/p>\n<p>Sen. Michelle Hinchey (D) is sponsoring the legislation, which would require cannabis shops to apply a $1 deposit for any marijuana products sold in single-use plastic containers and also reimburse consumers for that fee if they return the container.<\/p>\n<p>The senator is also behind a separate bill filed last year that would\u00a0<a href=\"https:\/\/www.marijuanamoment.net\/new-york-bill-would-encourage-marijuana-packaging-made-from-hemp-as-a-sustainable-plastic-alternative\/\" target=\"_blank\" rel=\"noopener\">prioritize hemp-based packaging over synthetic plastics<\/a>\u00a0for marijuana products.<\/p>\n<p>The recycling bill is <a href=\"https:\/\/www.marijuanamoment.net\/marijuana-packaging-recycling-bill-filed-in-new-york-days-after-legalization-takes-effect\/\" target=\"_blank\" rel=\"noopener\">identical to an Assembly version filed<\/a>\u00a0by Assemblywoman Patricia Fahy (D) last year.<\/p>\n<p>Another\u00a0 New York senator separately filed a bill in December to make it so that gay, lesbian and bisexual people can <a href=\"https:\/\/www.marijuanamoment.net\/new-york-senator-files-bill-to-extend-marijuana-equity-benefits-to-gay-lesbian-and-bisexual-people\/\" target=\"_blank\" rel=\"noopener\">qualify as social equity applicants<\/a>\u00a0under the state\u2019s marijuana law.<\/p>\n<p>Sen. Jeremy Cooney (D) introduced the legislation, shortly after filing a separate bill to\u00a0<a href=\"https:\/\/www.marijuanamoment.net\/new-york-senator-files-bill-to-extend-marijuana-equity-benefits-to-transgender-and-non-binary-people\/\" target=\"_blank\" rel=\"noopener\">include transgender and non-binary people<\/a>\u00a0in the cannabis social equity program. He\u2019s also behind other recent marijuana reform proposals related to cannabis business tax benefits and licensing.<\/p>\n<p>In July, Cooney filed a bill to\u00a0<a href=\"https:\/\/www.marijuanamoment.net\/new-york-senators-bill-would-let-farmers-get-a-head-start-on-growing-marijuana\/\" target=\"_blank\" rel=\"noopener\">create a provisional marijuana licensing category<\/a>\u00a0so that farmers could begin cultivating and selling cannabis ahead of the formal rollout of the adult-use program.<\/p>\n<p>Cooney is also sponsoring a newly filed bill to allow licensed cannabis companies to\u00a0<a href=\"https:\/\/www.marijuanamoment.net\/new-york-bill-would-allow-marijuana-industry-to-deduct-business-expenses-on-state-taxes\/\" target=\"_blank\" rel=\"noopener\">deduct certain business expenses<\/a>\u00a0on their state tax returns.<\/p>\n<p>Gov. Kathy Hochul (D), who replaced Cuomo after he resigned amid a sexual harassment scandal, has repeatedly emphasized her interest in\u00a0<a href=\"https:\/\/www.marijuanamoment.net\/getting-new-york-marijuana-legalization-rolling-is-a-priority-new-governors-office-says\/\" target=\"_blank\" rel=\"noopener\">efficiently implementing the legalization law<\/a>.<\/p>\n<p>Hochul released a State of the State book last month that called for\u00a0<a href=\"https:\/\/www.marijuanamoment.net\/new-york-governor-announces-200-million-marijuana-fund-to-promote-industry-equity\/\" target=\"_blank\" rel=\"noopener\">the creation of a $200 million public-private fund<\/a>\u00a0to specifically help promote social equity in the state\u2019s burgeoning marijuana market.<\/p>\n<p>The governor said that while cannabis business licenses have yet to be approved since legalization was signed into law last year, the market stands to generate billions of dollars, and it\u2019s important to \u201ccreate opportunities for all New Yorkers, particularly those from historically marginalized communities.\u201d<\/p>\n<p>That proposal was\u00a0<a href=\"https:\/\/www.marijuanamoment.net\/new-york-will-generate-more-than-1-25-billion-in-marijuana-revenue-over-next-six-years-governors-budget-estimates\/\" target=\"_blank\" rel=\"noopener\">also cited in Hochul\u2019s executive budget<\/a>, which was released last month.
