Donald Payne (D-NJ) said in a press release last week that he\u2019s \u201coutraged to hear that Black-owned businesses have been shut out of the state\u2019s cannabis marketplace,\u201d noting that black people are significantly more likely to face arrests over marijuana despite comparable rates of use among different races.<\/p>\n<p>\u201cNew Jersey has a chance to correct this inequality and allow people abused by the system to finally benefit from it with a fair distribution of cannabis business licenses,\u201d he said. \u201cInstead, we are seeing the same inequality with these licenses that we see in marijuana arrests.\u201d<\/p>\n<blockquote class=\"twitter-tweet\" data-width=\"550\" data-dnt=\"true\">\n<p lang=\"en\" dir=\"ltr\">I am outraged to hear that none of the 56 NJ cannabis business licenses were awarded to a Black-owned business.  These entrepreneurs have been shut out of New Jersey&#8217;s cannabis market. Donald Payne Jr (@RepDonaldPayne) <a href=\"https:\/\/twitter.com\/RepDonaldPayne\/status\/1487173647177588747?ref_src=twsrc%5Etfw\" target=\"_blank\" rel=\"nofollow noopener\">January 28, 2022<\/a><\/p>\n<\/blockquote>\n<p \/>\n<p>While New Jersey\u2019s medical cannabis program has been in effect for more than a decade, the adult-use market has yet to come online as regulators work on <a href=\"https:\/\/www.marijuanamoment.net\/new-jersey-voters-approve-marijuana-legalization-referendum\/\" target=\"_blank\" rel=\"noopener\">implementing a 2020 voter-approved reform referendum<\/a>.<\/p>\n<p>Gov. Phil Murphy (D) \u201cpromised that the state\u2019s cannabis industry would right the wrongs of the past as it concerns social justice,\u201d Payne <a href=\"https:\/\/payne.house.gov\/media\/press-releases\/rep-payne-jr-s-statement-new-jersey-s-denial-cannabis-licenses-black-owned\" target=\"_blank\" rel=\"noopener\">said<\/a>. \u201cNow, New Jersey needs to uphold this promise.\u201d<\/p>\n<p>The statement from the congressman\u2019s office comes as African American Chamber of Commerce of New Jersey is also sounding the alarm about the current lack of diversity in the state\u2019s marijuana industry.<\/p>\n<p>Following the vote to legalize recreational cannabis in the state, the New Jersey Cannabis Regulatory Commission (CRC) saw a flood of hundreds of applications to start marijuana businesses. Advocates had hoped that the promise of the reform\u2014to help correct the harms of criminalization that have disproportionately impacted communities of color\u2014would be proactively met.<\/p>\n<p>\u201cBased on conversations I\u2019ve had, with stakeholders, out of the 56 licenses awarded to date, none has been awarded to a Black-owned business. People need to know what\u2019s going on,\u201d African American Chamber of Commerce of New Jersey President John Harmon <a href=\"https:\/\/myemail.constantcontact.com\/Press-Release---Black-Entrepreneurs--Excluded-from-NJ-s-Cannabis-Business.html?soid=1103630347928&amp;aid=9UT0hQ5HRNc\" target=\"_blank\" rel=\"noopener\">said<\/a> in a press release.<\/p>\n<p>\u201cMany Black-owned businesses have been trying to get into the cannabis industry since 2012 when cannabis for medicinal purposes became legal in New Jersey,\u201d he said. \u201cNo Black-owned business received a license back then, and none has received a license since the legalization of cannabis for recreational use thus far.\u201d<\/p>\n<p style=\"padding-left: 40px\">\u201cThe CRC needs to expedite its review and award of the licenses submitted. Minimally, the CRC must immediately score and notify applicants of their conditional status. If necessary, additional resources must be allocated to the license review process so that applicants cease to be adversely impacted financially by an unjustifiably protracted process.\u201d<\/p>\n<p>Payne said that he joins the commerce organization in \u201ctheir outrage that this inequality continues to plague our state, our society, and our country.\u201d<\/p>\n<p>New Jersey isn\u2019t the only state that has faced pushback from not efficiently meeting equity goals as legal cannabis markets launch.<\/p>\n<p>Illinois, for one, has <a href=\"https:\/\/www.marijuanamoment.net\/illinois-marijuana-sales-near-1-billion-in-2021-with-sizable-september-numbers\/\" target=\"_blank\" rel=\"noopener\">faced criticism from advocates and lawsuits<\/a> from marijuana business applicants who feel officials haven\u2019t done enough to ensure diversity among business owners in the industry.<\/p>\n<p>Gov. J.B. Pritzker\u2019s signed a bill last year that\u2019s meant to build upon the state\u2019s legalization law by <a href=\"https:\/\/www.marijuanamoment.net\/illinois-marijuana-equity-licensing-bill-heads-to-governors-desk\/\" target=\"_blank\" rel=\"noopener\">creating more cannabis business licensing opportunities<\/a>\u00a0to help people from disproportionately impacted communities enter into the marijuana industry. Regulators have since held a series of lotteries to award additional dispensary licenses, but losing companies have since filed legal challenges to the process.<\/p>\n<p>Meanwhile, New York has been taken steps to ensure that equity is built into its adult-use marijuana program that was signed into law last year.<\/p>\n<p>For example, Gov. Kathy Hochul (D) announced this month that\u00a0her administration is <a href=\"https:\/\/www.marijuanamoment.net\/new-york-governor-announces-200-million-marijuana-fund-to-promote-industry-equity\/\" target=\"_blank\" rel=\"noopener\">creating a $200 million public-private fund<\/a> to specifically help promote social equity in the state\u2019s burgeoning marijuana market.<\/p>\n<p>Colorado officials recently announced that the state has achieved a <a href=\"https:\/\/www.marijuanamoment.net\/colorado-meets-marijuana-industry-diversity-goal-ahead-of-schedule\/\" target=\"_blank\" rel=\"noopener\">\u201cwildly important goal\u201d of increasing diversity<\/a> in the legal marijuana industry\u2014but the data shows there\u2019s still a way to go before cannabis business ownership is on par with the state\u2019s population demographics.<\/p>\n<p>Nearly 17 percent of the state\u2019s cannabis businesses are now minority-owned as of January 1, the Marijuana Enforcement Division (MED) reported.
