{"id":52615,"date":"2022-01-31T13:18:54","date_gmt":"2022-01-31T21:18:54","guid":{"rendered":"https:\/\/cannabiscultivatornews.com\/home\/index.php\/2022\/01\/31\/virginia-psilocybin-decriminalization-bill-defeated-in-senate-committee-after-top-gop-lawmaker-flips-support\/"},"modified":"2022-01-31T13:45:32","modified_gmt":"2022-01-31T21:45:32","slug":"virginia-psilocybin-decriminalization-bill-defeated-in-senate-committee-after-top-gop-lawmaker-flips-support","status":"publish","type":"post","link":"https:\/\/cannabiscultivatornews.com\/home\/index.php\/2022\/01\/31\/virginia-psilocybin-decriminalization-bill-defeated-in-senate-committee-after-top-gop-lawmaker-flips-support\/","title":{"rendered":"Virginia Psilocybin Decriminalization Bill Defeated In Senate Committee After Top GOP Lawmaker Flips Support"},"content":{"rendered":"<p><img loading=\"lazy\" src=\"https:\/\/cannabiscultivatornews.com\/home\/wp-content\/uploads\/2022\/01\/MM_Bill_Tracker_V5_blank-123.jpg\" width=\"1500\" height=\"1500\"> <\/p>\n<p>In another setback from Virginia psychedelics activists, a key Senate committee on Monday defeated a bill that would have decriminalized psilocybin and psilocyn in the Commonwealth.<\/p>\n<p>Advocates were hopeful that the measure would pass in the Senate Judiciary Committee, which <a href=\"https:\/\/www.marijuanamoment.net\/virginia-psilocybin-decriminalization-bill-enjoys-bipartisan-support-in-senate-committee-but-revisions-are-forthcoming\/\" target=\"_blank\" rel=\"noopener\">first held a hearing on the proposal earlier this month<\/a> where bipartisan lawmakers voiced support and the sponsor agreed to file an amendment that would put a focus on the therapeutic application of the psychedelic.<\/p>\n<p>Sen. Ghazala Hashmi (D), did offer an amendment to her bill saying that psilocybin decriminalization would only apply to people who\u2019ve consulted with a doctor, nurse, counselor or social worker\u2014as opposed to broadly decriminalizing for people 21 and older as originally drafted. Dawn Adams to decriminalize a wider array of psychedelics that was also amended to focus on the medical use of the substances, but members of <a href=\"https:\/\/www.marijuanamoment.net\/virginia-house-committee-pushes-back-psychedelics-decriminalization-bill-until-2023-but-senate-proposal-still-pending\/\" target=\"_blank\" rel=\"noopener\">a subcommittee approved a motion to carry the measure over until 2023<\/a> to further tweak it and build support.<\/p>\n<p>Given that the House is newly controlled by Republicans, that measure\u2019s prospects seemed somewhat slimmer than than more dialed-back Senate proposal.<\/p>\n<p>Misinformation seemed to be a theme in both the House and Senate committees. Members raised concerns about whether the proposal would lead to magic mushrooms dispensaries or increased impaired driving, even though the bill would neither facilitate retail sales nor permit unlawful activity like driving under the influence.<\/p>\n<p>Neither bill as drafted or amended would have legalized psychedelics for medical or recreational use; rather it would have made possession of the entheogens punishable by a $100 fine, instead of a Class 5 felony as it\u2019s currently designated.<\/p>\n<p>Any dollars collected from psychedelics possession violations would have gone to the state\u2019s Drug Offender Assessment and Treatment Fund, which supports substance misuse treatment programs and drug courts.<\/p>\n<p>At a recent virtual event organized by the reform group Decriminalize Nature Virginia,\u00a0<a href=\"https:\/\/www.marijuanamoment.net\/virginia-lawmakers-tout-benefits-of-psychedelics-as-activists-prepare-push-for-statewide-reform\/\" target=\"_blank\" rel=\"noopener\">the sponsors of both bills participated as hosts<\/a>, sharing their perspectives about the growing body of research indicating that psychedelics could be powerful tools to combat conditions like treatment-resistant depression and post-traumatic stress disorder (PTSD).<\/p>\n<p>Even if the legislature had approved either piece of legislation, it would likely have faced resistance from the state\u2019s new Republican governor, Glenn Youngkin, who has expressed concerns about <a href=\"https:\/\/www.marijuanamoment.net\/incoming-virginia-gop-governor-wont-overturn-legal-marijuana-possession-but-casts-doubt-on-sales\/\" target=\"_blank\" rel=\"noopener\">implementing a commercial marijuana market<\/a>\u00a0in line with what the Democratic legislature and outgoing governor approved last year.<\/p>\n<p>These psychedelics reform proposals are some of the latest to be introduced in state legislatures this session as the decriminalization movement spreads.<\/p>\n<p>In Oregon, where voters approved a historic 2020 initiative to legalize therapeutic psilocybin program, as well as another to broadly decriminalize currently illicit drugs, lawmakers introduced a bill last week\u00a0<a href=\"https:\/\/www.marijuanamoment.net\/oregon-lawmakers-file-psilocybin-equity-bill-as-state-implements-legal-use-program\/\" target=\"_blank\" rel=\"noopener\">meant to promote equity into the program<\/a>.<\/p>\n<p>Two Republican Oklahoma lawmakers recently filed bills meant to promote research into the therapeutic potential of psilocybin, and one of the measures would further\u00a0<a href=\"https:\/\/www.marijuanamoment.net\/oklahoma-republicans-file-bills-to-decriminalize-psilocybin-and-encourage-research-on-medical-benefits\/\" target=\"_blank\" rel=\"noopener\">decriminalize low-level possession of the psychedelic<\/a>.<\/p>\n<p>A GOP Utah lawmaker also introduced a bill this month that would set up a task force to study and make recommendations\u00a0<a href=\"https:\/\/www.marijuanamoment.net\/gop-utah-lawmaker-files-bill-to-require-task-force-study-into-psychedelic-therapy-for-mental-health\/\" target=\"_blank\" rel=\"noopener\">on the therapeutic potential of psychedelic drugs<\/a>\u00a0and possible regulations for their lawful use.<\/p>\n<p>In Kansas, A lawmaker also recently filed a bill to\u00a0<a href=\"https:\/\/www.marijuanamoment.net\/controversial-kansas-lawmaker-files-bill-to-legalize-psilocybin-possession-and-cultivation\/\" target=\"_blank\" rel=\"noopener\">legalize the low-level possession and cultivation<\/a>\u00a0of psilocybin mushrooms.<\/p>\n<p>A Republican Missouri lawmaker introduced a bill this month to give residents with serious illnesses legal\u00a0<a href=\"https:\/\/www.marijuanamoment.net\/missouri-patients-could-use-psychedelic-treatments-under-new-gop-right-to-try-bill\/\" target=\"_blank\" rel=\"noopener\">access to a range of psychedelic drugs<\/a>\u00a0like psilocybin, ibogaine and LSD \u00a0through an expanded version of the state\u2019s existing right-to-try law.<\/p>\n<p>California Sen. Scott Wiener (D) told Marijuana Moment in a recent interview that his bill to\u00a0<a href=\"https:\/\/www.marijuanamoment.net\/california-senator-says-bill-to-legalize-psychedelics-possession-has-50-50-chance-to-pass-this-year\/\" target=\"_blank\" rel=\"noopener\">legalize psychedelics possession<\/a>\u00a0stands a 50\/50 chance of reaching the governor\u2019s desk this year.
