Earl Blumenauer (D-OR) and former Republican Rep. Ryan Costello (R-PA) participated in a panel hosted by the Psychedelic Medicine Coalition (PMC) on Thursday where they talked about the challenges and opportunities of advancing drug policy reform in Congress as the state and local movement expands.<\/p>\n<p>Blumenauer was asked about his experience with DEA on the issue and said that the agency has \u201ca very troubled history with the failed war on drugs,\u201d noting the waste of government resources that have poured into the effort. He said that DEA\u2019s focus on scheduling drugs \u201cflies in the face of what we need to have done with our research efforts.\u201d<\/p>\n<p>\u201cA criminal justice enforcement agency is not well-equipped\u201d to handle this complex drug policy issue, the congressman <a href=\"https:\/\/www.eventbrite.com\/e\/national-psychedelic-policy-roundtable-tickets-239768924307\" target=\"_blank\" rel=\"noopener\">said<\/a>. \u201cI\u2019d like to just get them out of the equation. If I had my way, we would redirect resources in ways that would be much more effective and realistic.\u201d<\/p>\n<div class=\"fb-video\" data-allowfullscreen=\"true\" data-href=\"https:\/\/www.facebook.com\/PsychedelicMedicineCoalition\/videos\/679152563095002\" \/>\n<p>\u201cWe have a wide range of things we need to be doing to be able to promote true understanding of what the properties are of scheduled drugs, being able to understand promising therapies, to be able to research them in an unbiased way and to be able to get the results of that information out the door,\u201d he said. \u201cThat just simply isn\u2019t the mission of the DEA.\u201d<\/p>\n<p>Blumenauer recently <a href=\"https:\/\/www.marijuanamoment.net\/bipartisan-congressional-lawmakers-tell-dea-to-allow-psilocybin-treatment-for-terminal-patients\/\" target=\"_blank\" rel=\"noopener\">led a congressional letter on psychedelics policy<\/a> that was sent to DEA Administrator Anne Milgram, who was appointed by President Joe Biden and confirmed by the Senate over the summer. He and bipartisan colleagues urged the agency to allow terminally ill patients to use psilocybin as an investigational treatment without the fear of federal prosecution.<\/p>\n<p>\u201cI mean, that is a classic example of what\u2019s wrong here,\u201d the congressman said on Thursday, discussing the letter. \u201cWe shouldn\u2019t have to fight to have the application of the right-to-try law for terminally ill people for a very promising therapy. That could make a huge difference for them. What\u2019s wrong with this picture?\u201d<\/p>\n<p>Congress and 41 states have adopted right-to-try laws, which allow\u00a0<a href=\"https:\/\/www.marijuanamoment.net\/bill-on-trumps-desk-would-allow-marijuana-and-maybe-mdma-for-some-patients\/\" target=\"_blank\" rel=\"noopener\">patients with terminal conditions to try investigational medications<\/a> that have not been approved for general use. Lawmakers said that DEA \u201chas failed to abide\u201d by the law.<\/p>\n<p>DEA\u2019s refusal to allow psilocybin access for these patients <a href=\"https:\/\/www.marijuanamoment.net\/dea-sued-by-therapists-who-want-permission-to-give-psilocybin-mushrooms-to-patients\/\" target=\"_blank\" rel=\"noopener\">resulted in a lawsuit that was filed in March<\/a>\u00a0by a Washington State doctor who sought federal guidance to treat terminal patients with psilocybin mushrooms and was told there wasn\u2019t a legal avenue for him to do so.<\/p>\n<p>The lawsuit is currently before the U.S. Court of Appeals for the Ninth Circuit, which heard oral arguments in the case in September. Washington State\u2019s attorney general\u2019s office <a href=\"https:\/\/www.marijuanamoment.net\/washington-officials-join-cancer-patients-in-federal-court-argument-pushing-dea-to-allow-psilocybin-access\/\" target=\"_blank\" rel=\"noopener\">joined the plaintiffs in support of psilocybin access<\/a>. DEA argued that the court should dismiss the suit because it lacked jurisdiction.<\/p>\n<p>Blumenauer also said that while he\u2019s yet to meet with Milgram, he looks forward to doing so and will convey that the psilocybin case \u201cis a golden opportunity for that agency to get in step with what the trends are, with the medical research, with the promising therapies for areas that we desperately need, new and powerful approaches to use the benefit of the research to be able to do a reset, to not be trapped in the failed war on drug mentality.\u201d<\/p>\n<p>DEA has i<a href=\"https:\/\/www.marijuanamoment.net\/dea-boosts-psilocybin-mdma-and-dmt-production-levels-again-in-final-quotas-for-2021\/\" target=\"_blank\" rel=\"noopener\">ncreased production quotas for the production<\/a> of certain psychedelics like psilocybin in an effort to promote research, but its scheduling decisions have continued to represent obstacles for scientists. And the agency is currently facing criticism from advocates and researchers over a proposal to place several psychedelic substances in Schedule I under the Controlled Substances Act.<\/p>\n<p>Blumenauer also talked about the \u201cvery thoughtful, very deliberate\u201d process underway in his home state of Oregon to <a href=\"https:\/\/www.marijuanamoment.net\/oregon-psilocybin-panel-teams-up-with-harvard-to-research-psychedelic-history-and-impacts-of-reform\/\" target=\"_blank\" rel=\"noopener\">implement a historic voter-approved initiative<\/a> legalizing psilocybin therapy.
