Carol McGuire (R), in a 241-113 vote. This comes one day after the chamber narrowly rejected a separate, broader legalization proposal that would have regulated commercial production and sales.<\/p>\n<p>The approved measure that is now advancing to the Senate will not allow cannabis commerce, but adults 21 and older would be allowed to possess and give away up to three-fourths of an ounce of marijuana and grow up to six plants, three of which could be mature.<\/p>\n<p>The <a href=\"https:\/\/www.gencourt.state.nh.us\/bill_status\/billinfo.aspx?id=25&amp;inflect=2\" target=\"_blank\" rel=\"noopener\">bill<\/a> is virtually identical to an earlier version that also <a href=\"https:\/\/www.marijuanamoment.net\/new-hampshire-house-approves-marijuana-legalization-bill\/\" target=\"_blank\" rel=\"noopener\">passed the House under Democratic control<\/a> in 2020. The previous bill died in Senate committee.<\/p>\n<blockquote class=\"twitter-tweet\" data-width=\"550\" data-dnt=\"true\">\n<p lang=\"en\" dir=\"ltr\">The <a href=\"https:\/\/twitter.com\/NHHouseGOP?ref_src=twsrc%5Etfw\" target=\"_blank\" rel=\"nofollow noopener\">@NHHouseGOP<\/a> and <a href=\"https:\/\/twitter.com\/NHHouseDems?ref_src=twsrc%5Etfw\" target=\"_blank\" rel=\"nofollow noopener\">@NHHouseDems<\/a> may not agree on much these days, but they agree it should be legal for adults to grow and possess cannabis for personal use. Max Abramson (R) said ahead of Thursday\u2019s vote. \u201cAnd outside of the 1950s B horror movies, it has never been the job of government to protect you from a plant.\u201d<\/p>\n<p>Under the measure, there are penalties for public consumption, violating restrictions on home cultivation such as by growing in a publicly visible space and extracting cannabis in a dangerous manner.<\/p>\n<p>\u201cThis is truly a bipartisan issue with strong and wide support from Granite Staters,\u201d Rep. Mark Warden (R) said. \u201cThe war on cannabis is a war on people. Those people are our neighbors and our constituents.\u201d<\/p>\n<p>New Hampshire lawmakers have had their pick of marijuana reform legislation, with <a href=\"https:\/\/www.marijuanamoment.net\/new-hampshire-lawmakers-file-multiple-marijuana-legalization-bills-ahead-of-2022-session\/\" target=\"_blank\" rel=\"noopener\">at least six new cannabis legalization proposals<\/a> having been recently filed for the 2022 session. On Wednesday, the chamber defeated <a href=\"https:\/\/www.gencourt.state.nh.us\/bill_status\/billinfo.aspx?id=13&amp;inflect=2\" target=\"_blank\" rel=\"noopener\">one<\/a> bill that would have established a retail market for adult-use cannabis.<\/p>\n<p>Rep. Joshua Adjutant (D),\u00a0Renny Cushing (D)\u00a0and\u00a0Andrew Prout (R)\u2014each filed separate bills to\u00a0<a href=\"https:\/\/www.marijuanamoment.net\/new-hampshire-lawmakers-take-first-step-to-put-marijuana-legalization-on-2022-ballot\/\" target=\"_blank\" rel=\"noopener\">put marijuana legalization on the state\u2019s 2022 ballot<\/a>.<\/p>\n<p>It would take a supermajority 60 percent vote in both chambers to advance any of the proposed constitutional amendments. But while that may be a tall task in the GOP-controlled legislature, if they\u2019re successful, it would enable lawmakers to avoid a likely veto on statutory reform legislation from anti-legalization Gov. Chris Sununu (R).<\/p>\n<p>Should legislators approve placing a constitutional amendment to legalize cannabis on the ballot, 67 percent of voters would then have to vote in favor for it to be enacted. Recent polling\u00a0<a href=\"https:\/\/www.marijuanamoment.net\/strong-bipartisan-majority-supports-marijuana-legalization-in-new-hampshire-poll-finds\/\" target=\"_blank\" rel=\"noopener\">indicates that residents are ready for the reform<\/a>, with three in four New Hampshirites favoring legalization.<\/p>\n<p>There are also new 2022 bills to\u00a0expand\u00a0the state\u2019s existing law that decriminalizes low-level cannabis possession and to\u00a0prevent police from using the smell of marijuana as probable cause for a search. Bills to decriminalize psilocybin mushrooms and more widely reduce penalties for non-violent drug offenses <a href=\"https:\/\/www.marijuanamoment.net\/new-hampshire-lawmakers-file-psilocybin-and-broader-drug-decriminalization-bills-for-2022\/\" target=\"_blank\" rel=\"noopener\">have also been introduced<\/a>.<\/p>\n<p><span style=\"font-family: -apple-system, BlinkMacSystemFont, 'segoe ui', Roboto, Oxygen-Sans, Ubuntu, Cantarell, 'helvetica neue', sans-serif\">While the governor remains opposed to adult-use legalization, advocates are encouraged that he signed a bill in August\u00a0<\/span><a style=\"font-family: -apple-system, BlinkMacSystemFont, 'segoe ui', Roboto, Oxygen-Sans, Ubuntu, Cantarell, 'helvetica neue', sans-serif\" href=\"https:\/\/www.marijuanamoment.net\/new-hampshire-governor-signs-bill-allowing-medical-marijuana-to-treat-opioid-use-disorder-and-letting-out-of-state-patients-shop\/\" target=\"_blank\" rel=\"noopener\">adding opioid use disorder as a qualifying condition<\/a><span style=\"font-family: -apple-system, BlinkMacSystemFont, 'segoe ui', Roboto, Oxygen-Sans, Ubuntu, Cantarell, 'helvetica neue', sans-serif\">\u00a0for the state\u2019s medical cannabis program and also allows out-of-state patients to access dispensaries.<\/span><\/p>\n<p>In 2017, Sununu signed\u00a0<a href=\"https:\/\/www.marijuanamoment.net\/new-hampshire-marijuana-decriminalization-takes-effect\/\" target=\"_blank\" rel=\"noopener\">a bill decriminalizing marijuana possession<\/a>\u00a0in the Granite State, though he continues to oppose adding a legal commercial cannabis sales component.<\/p>\n<p>Separately, a New Hampshire Senate committee in March heard testimony on a House-passed bill to allow medical marijuana patients to\u00a0<a href=\"https:\/\/www.marijuanamoment.net\/new-hampshires-medical-marijuana-dispensaries-now-support-letting-patients-grow-their-own\/\" target=\"_blank\" rel=\"noopener\">grow a limited number of plants for personal use<\/a>.
