{"id":52114,"date":"2022-01-04T14:15:29","date_gmt":"2022-01-04T22:15:29","guid":{"rendered":"https:\/\/cannabiscultivatornews.com\/home\/index.php\/2022\/01\/04\/federal-marijuana-monopoly-finally-ends-as-two-companies-harvest-cannabis-approved-by-dea\/"},"modified":"2022-01-05T01:45:20","modified_gmt":"2022-01-05T09:45:20","slug":"federal-marijuana-monopoly-finally-ends-as-two-companies-harvest-cannabis-approved-by-dea","status":"publish","type":"post","link":"https:\/\/cannabiscultivatornews.com\/home\/index.php\/2022\/01\/04\/federal-marijuana-monopoly-finally-ends-as-two-companies-harvest-cannabis-approved-by-dea\/","title":{"rendered":"Federal Marijuana Monopoly Finally Ends As Two Companies Harvest Cannabis Approved By DEA"},"content":{"rendered":"<p><img loading=\"lazy\" src=\"https:\/\/cannabiscultivatornews.com\/home\/wp-content\/uploads\/2022\/01\/66293319834__AE1A9887-20DA-436E-AC56-16070192EAE7-e1641332028164-1.jpg\" width=\"636\" height=\"382\"> <\/p>\n<p>The federal monopoly on cannabis manufacturing for research has finally been broken, with two companies telling Marijuana Moment this week that they\u2019ve harvested cannabis with the blessing of the Drug Enforcement Administration (DEA).<\/p>\n<p>For more than 50 years, only a single facility at the University of Mississippi has been permitted under a federal agreement to grow marijuana for study purposes. In recent years, DEA said it would be taking steps to end that monopoly and authorize additional manufacturers. Several companies <a href=\"https:\/\/www.marijuanamoment.net\/dea-finally-ready-to-end-federal-marijuana-research-monopoly-agency-notifies-grower-applicants\/\" target=\"_blank\" rel=\"noopener\">received conditional approvals for their applications<\/a> in May.<\/p>\n<p>Two of those companies\u2014Groff North America Hemplex and the Biopharmaceutical Research Company (BRC)\u2014say they\u2019ve officially received registrations from DEA and have started growing and harvesting plants. But for the time being, they are only approved to grow the crops for internal quality control and calibration purposes, with the intent of later being approved to sell products to DEA to be distributed for clinical research and drug development.<\/p>\n<p>In any case, researchers say this development represents a significant step forward, with DEA making initial moves to oversee the production of research-grade cannabis on a scale that hasn\u2019t been seen before.<\/p>\n<p>\u201cAll of these steps are incremental steps that lead to our production at BRC, and certainly all of our peers in the federally legal cannabis industry,\u201d George Hodgin, CEO of BRC, told Marijuana Moment. \u201cThese steps are taking place because of the loud drumbeat of the advocates of the cannabis community over the past decades.\u201d<\/p>\n<div id=\"attachment_53847\" style=\"width: 646px\" class=\"wp-caption alignnone\"><img aria-describedby=\"caption-attachment-53847\" loading=\"lazy\" class=\"wp-image-53847 size-full\" src=\"https:\/\/cannabiscultivatornews.com\/home\/wp-content\/uploads\/2022\/01\/66293319834__AE1A9887-20DA-436E-AC56-16070192EAE7-e1641332028164.jpg\" alt=\"\" width=\"636\" height=\"382\" \/><\/p>\n<p id=\"caption-attachment-53847\" class=\"wp-caption-text\">Via BRC.<\/p>\n<\/div>\n<p>Advocates, lawmakers and health officials alike have been strongly pushing for expanded cannabis research, with many complaining that the current supply of government-grown marijuana for studies is insufficient and that its products are <a href=\"https:\/\/www.marijuanamoment.net\/government-grown-marijuana-is-genetically-closer-to-hemp-than-cannabis-sold-in-dispensaries-another-study-finds\/\" target=\"_blank\" rel=\"noopener\">chemically dissimilar from what\u2019s available at dispensaries<\/a> in state-legal markets.<\/p>\n<p>National Institute on Drug Abuse (NIDA) Director Nora Volkow told Marijuana Moment that it would be \u201cvaluable\u201d for researchers to access cannabis from such retailers to better understand the risks and benefits of what consumers are taking in states across the country. In November, President Joe Biden <a href=\"https:\/\/www.marijuanamoment.net\/biden-signs-infrastructure-bill-promoting-marijuana-research-by-encouraging-access-to-dispensary-products\/\" target=\"_blank\" rel=\"noopener\">signed a massive infrastructure bill<\/a> that includes provisions aimed at providing researchers with that access.<\/p>\n<p>In the interim, getting DEA on board with authorizing additional manufacturers could help close the research gap on cannabis as federal prohibition continues to impede efforts to study the plant.<\/p>\n<p>BRC completed its first harvest in November and is now working on its \u201csecond batch of cannabis crops under our DEA licensure. Another company, Groff, also completed its first harvest under a similar arrangement last week.<\/p>\n<p>Frank Haughton, CEO of Brighterside Vertical Farms, which was contracted by Groff to cultivate cannabis, told Marijuana Moment that \u201cthe purpose of this first harvest was to get our genetics in the door, get plants in the ground, and really show the DEA that this is something that is possible. This is something that can be done the same as any other drug ingredient.\u201d<\/p>\n<p>\u201cThat\u2019s where we\u2019re at with Groff,\u201d he said. \u201cIt\u2019s was really proving the concept, getting it there and now creating a pathway to hopefully becoming a sort of a domestic supplier as [Food and Drug Administration] approvals go through after these experiments are done.\u201d<\/p>\n<p>Researchers have also credited DEA for <a href=\"https:\/\/www.marijuanamoment.net\/dea-boosts-psilocybin-mdma-and-dmt-production-levels-again-in-final-quotas-for-2021\/\" target=\"_blank\" rel=\"noopener\">increasing yearly production quotas for Schedule I drugs<\/a> like marijuana and certain psychedelics. The agency has emphasized its interest in promoting research and said its decision to call for greater production yields is directly responsive to increased demand among scientists and the need to support efforts to develop effective therapeutics.<\/p>\n<p>\u201cThe DEA granted us everything we asked for,\u201d BRC\u2019s Hodgin said. \u201cI think that what you saw over the past year, with respect to the DEA increasing the production quotas of controlled substances that includes cannabis, that regulatory action is directly, positively affecting the producers like us.\u201d<\/p>\n<p>While DEA has taken steps to support marijuana research, there\u2019s a new push in Congress for the agency to allow terminally ill patients to <a href=\"https:\/\/www.marijuanamoment.net\/congressman-asks-colleagues-to-demand-dea-allow-psilocybin-treatment-for-terminal-patients\/\" target=\"_blank\" rel=\"noopener\">use psilocybin as an investigational treatment<\/a> without the fear of federal prosecution.<\/p>\n<p>A recent Dear Colleague letter that\u2019s been circulated by Rep. Earl Blumenauer (D-OR) notes that there are state and federal right-to-try (RTT) laws that should make it so certain patients can obtain the psychedelic given that it\u2019s shown early potential in ongoing clinical trials.<\/p>\n<p>Yet DEA has denied access,\u00a0<a href=\"https:\/\/www.marijuanamoment.net\/dea-sued-by-therapists-who-want-permission-to-give-psilocybin-mushrooms-to-patients\/\" target=\"_blank\" rel=\"noopener\">resulting in a lawsuit that was filed in March<\/a>\u00a0by a Washington State doctor who sought federal guidance to treat terminal patients with psilocybin mushrooms and was told there wasn\u2019t a legal avenue for him to do so.<\/p>\n<p>The lawsuit against DEA is currently before the U.S. Court of Appeals for the Ninth Circuit, which heard oral arguments in the case in September. Washington State\u2019s attorney general\u2019s office\u00a0<a href=\"https:\/\/www.marijuanamoment.net\/washington-officials-join-cancer-patients-in-federal-court-argument-pushing-dea-to-allow-psilocybin-access\/\" target=\"_blank\" rel=\"noopener\">joined the plaintiffs in support of psilocybin access<\/a>. DEA argued that the court should dismiss the suit because it lacked jurisdiction.<\/p>\n<p>DEA and NIDA also recently said they are in favor of a White House proposal to <a href=\"https:\/\/www.marijuanamoment.net\/dea-backs-white-house-plan-to-streamline-research-on-marijuana-psychedelics-and-other-schedule-i-drugs\/\" target=\"_blank\" rel=\"noopener\">streamline the process of researching Schedule I drugs<\/a> like marijuana and certain psychedelics.<\/p>\n<p>In general, what\u00a0<a href=\"https:\/\/www.marijuanamoment.net\/bidens-drug-czar-wants-to-make-it-easier-to-research-marijuana-psychedelics-and-other-schedule-i-substances\/\" target=\"_blank\" rel=\"noopener\">the Biden administration is proposing is to align the research requirements<\/a>\u00a0for Schedule I drugs with those of less-restricted Schedule II drugs. Scientists and lawmakers have consistently pointed out that the existing rules for studying Schedule I controlled substances are excessively burdensome, limiting vital research.<\/p>\n<p>Separately in August, a federal appeals court dismissed a petition to <a href=\"https:\/\/www.marijuanamoment.net\/court-dismisses-dea-marijuana-rescheduling-case-but-judge-says-cannabis-reclassification-may-be-coming-anyway\/\" target=\"_blank\" rel=\"noopener\">require the DEA to reevaluate cannabis\u2019s scheduling<\/a>\u00a0under the Controlled Substances Act.
