Jared Polis (D) says he will soon be announcing a clemency plan for more people with marijuana convictions, focusing on those who are eligible for relief under a new law that increased the cannabis possession limit for adults.<\/p>\n<p>The governor, who directed state law enforcement to\u00a0<a href=\"https:\/\/www.marijuanamoment.net\/colorado-governor-signs-bill-to-double-marijuana-possession-limit-and-calls-for-pardons-review\/\" target=\"_blank\" rel=\"noopener\">identify people with prior convictions<\/a> for the new, two-ounce limit in May, said the plan is in \u201cthe final stages of being completed\u201d and he expects it to be announced \u201cin the next few days.\u201d<\/p>\n<p>At that point, \u201cwe\u2019ll be able to roll out what we\u2019re doing with regard to to any clemency or pardons that we typically do in the Christmas period,\u201d Polis said.<\/p>\n<p \/>\n<p>A pardon application form for people convicted of marijuana possession over one ounce (the previous limit) but no more than two ounces (the new limit) was recently made available on the Colorado Bureau of Investigation website, Westword <a href=\"https:\/\/www.westword.com\/marijuana\/colorado-preparing-pardons-marijuana-offenses-13067754\" target=\"_blank\" rel=\"noopener\">reported<\/a>.<\/p>\n<p>Polis signed an executive order last year that\u00a0<a href=\"https:\/\/www.marijuanamoment.net\/colorado-governor-grants-thousands-of-marijuana-pardons-with-new-clemency-powers\/\" target=\"_blank\" rel=\"noopener\">granted clemency to almost 3,000 people<\/a>\u00a0convicted of possessing one ounce or less of marijuana. And while earlier legislation that enabled him to do that in an expedited way applied to possession cases involving up to two ounces, his office declined to pardon those with more than one ounce on their records because that amount violated the existing state law.<\/p>\n<p>There was nothing written into the new law that calls for a proactive review of cases that may qualify for clemency given the possession threshold increase, but Polis said on Wednesday that that will be an area of focus for his clemency announcement.<\/p>\n<p>Meanwhile, a separate Colorado law that impacts the state\u2019s medical cannabis program <a href=\"https:\/\/www.marijuanamoment.net\/new-marijuana-laws-take-effect-across-the-u-s-with-the-new-year\/\" target=\"_blank\" rel=\"noopener\">is set to take effect on January 1<\/a>.<\/p>\n<p>Patients will soon be limited to purchasing up to eight grams of concentrate per day. The previous limit was 40 grams of concentrate daily. They will be able to buy more than the daily limit if a doctor certifies that it\u2019s medically necessary and they have a designated primary dispensary to obtain the medicine.<\/p>\n<p>Dispensaries will also be required to provide educational materials to patients, including a pamphlet that will be distributed at the point of sale to provide guidance and warnings about the use of marijuana concentrates.\u00a0Additionally, medical cannabis businesses couldn\u2019t advertise directly to people aged 18 to 20, and any advertising for concentrates will have to include a warning about the risks of overconsumption.<\/p>\n<p>When it comes to cannabis clemency, Polis isn\u2019t the only governor using executive authority to provide relief.<\/p>\n<p>The governor of Wisconsin announced on Tuesday that he granted 30 pardons, primarily to <a href=\"https:\/\/www.marijuanamoment.net\/wisconsin-governor-grants-marijuana-and-drug-related-pardons-setting-state-clemency-record\/\" target=\"_blank\" rel=\"noopener\">people convicted of non-violent marijuana or other drug offenses<\/a>. That raises the total number of pardons issued so far by Gov. Tony Evers (D) to 337 during his first three years in office, the most granted by a governor in the state\u2019s history at this point into a first term.<\/p>\n<p>In May, Pennsylvania Gov. Tom Wolf (D) pardoned a doctor who was <a href=\"https:\/\/www.marijuanamoment.net\/pennsylvania-governor-pardons-doctor-convicted-for-growing-medical-marijuana-for-dying-wife\/\" target=\"_blank\" rel=\"noopener\">arrested, prosecuted and jailed for growing marijuana<\/a>\u00a0that he used to provide relief for his dying wife. That came months after he\u00a0<a href=\"https:\/\/www.marijuanamoment.net\/pennsylvania-governor-grants-69-marijuana-pardons-as-lawmakers-move-bipartisan-legalization-bill\/\" target=\"_blank\" rel=\"noopener\">granted expedited pardons for low-level cannabis offenses<\/a>\u00a0for 69 people.<\/p>\n<p>Pennsylvania Lt. Gov. John Fetterman (D) said recently that one of his key goals in his final year in office is to ensure that as many eligible people as possible submit\u00a0<a href=\"https:\/\/www.bop.pa.gov\/Apply%20for%20Clemency\/Pages\/Expedited-Review-Program.aspx\" target=\"_blank\" rel=\"noopener\">applications<\/a>\u00a0to have the courts\u00a0<a href=\"https:\/\/www.marijuanamoment.net\/pennsylvanias-lieutenant-governor-wants-to-process-as-many-marijuana-pardons-as-possible-before-leaving-office\/\" target=\"_blank\" rel=\"noopener\">remove their cannabis records and restore opportunities<\/a>\u00a0to things like housing, student financial aid and employment.<\/p>\n<p>Illinois Gov. J.B. Pritzker (D) <a href=\"https:\/\/www.marijuanamoment.net\/illinois-governor-announces-half-a-million-marijuana-expungements-and-pardons\/\" target=\"_blank\" rel=\"noopener\">announced more than 500,000 expungements and pardons<\/a>\u00a0for people with low-level marijuana offenses on their records. The massive clemency and records clearing sweep came about one year after the state\u2019s legal cannabis market launched.<\/p>\n<p>In June, more than 15,000 people who were convicted for low-level marijuana possession in Nevada\u00a0<a href=\"https:\/\/www.marijuanamoment.net\/nevada-pardons-more-than-15000-people-with-marijuana-convictions-under-governors-resolution\/\" target=\"_blank\" rel=\"noopener noreferrer\">were automatically pardoned under a resolution<\/a> from Gov. Steve Sisolak (D) and the Board of Pardons Commissioners.<\/p>\n<p>Washington State Gov. Jay Inslee (D) has also\u00a0<a href=\"https:\/\/www.marijuanamoment.net\/washington-governor-will-pardon-people-with-marijuana-possession-convictions-he-announces\/\" target=\"_blank\" rel=\"noopener noreferrer\">issued pardons for cannabis offenses<\/a>.<\/p>\n<p>At the federal level, President Joe Biden has been facing pressure from numerous advocates and lawmakers to use his executive power to grant relief to those with marijuana convictions on their records.<\/p>\n<p>White House Press Secretary Jen Psaki said last week that the president has\u00a0<a href=\"https:\/\/www.marijuanamoment.net\/biden-has-every-intention-of-using-clemency-power-and-is-looking-at-people-with-drug-convictions-white-house-says\/\" target=\"_blank\" rel=\"noopener\">\u201cevery intention of using his clemency power,\u201d<\/a>\u00a0but she declined to give specifics about when any presidential action might actually happen.<\/p>\n<p>\u201cBiden needs to lean on his executive authority now. He has been delaying and underutilizing it so far,\u201d Rep. Alexandria Ocasio-Cortez (D-NY) said last week, adding that he could use his authority to\u00a0<a href=\"https:\/\/www.marijuanamoment.net\/aoc-calls-on-biden-to-use-executive-authority-on-marijuana-policy-as-presidents-agenda-stalls-in-congress\/\" target=\"_blank\" rel=\"noopener\">advance a number of progressive causes<\/a>\u00a0like marijuana reform.<\/p>\n<p>The congresswoman was among the first to suggest that Biden use executive authority to advance marijuana reform, joining 36 of her colleagues on a letter to the president in February that implored him to grant mass pardons to people with federal cannabis convictions.\u00a0Biden recently received\u00a0<a href=\"https:\/\/www.marijuanamoment.net\/congressional-lawmakers-want-urgent-update-from-biden-on-marijuana-pardons-as-holidays-approach\/\" target=\"_blank\" rel=\"noopener\">a follow-up letter demanding a status update<\/a>.<\/p>\n<p>A pair of Republican lawmakers last week sent Biden and Vice President Kamala Harris a separate letter\u00a0<a href=\"https:\/\/www.marijuanamoment.net\/gop-lawmakers-blast-biden-and-harris-over-continued-silence-on-marijuana-and-urge-rescheduling\/\" target=\"_blank\" rel=\"noopener\">criticizing their \u201clack of action\u201d and \u201ccontinued silence\u201d<\/a>\u00a0on marijuana reform and urging the administration to reschedule cannabis under federal law. They\u00a0<a href=\"https:\/\/www.marijuanamoment.net\/republican-lawmakers-tell-biden-to-keep-marijuana-campaign-promise-by-reclassifying-it-under-federal-law\/\" target=\"_blank\" rel=\"noopener\">first made the request in July<\/a>.<\/p>\n<p>These are just the latest examples of legislators taking a demand for reform directly to the president, who has disappointed advocates in his first year in office by declining to take meaningful steps to change the country\u2019s approach to cannabis despite campaigning on a pro-decriminalization and pro-rescheduling platform.<\/p>\n<p>Since the election, neither the president or vide president\u2014who sponsored a legalization bill while serving in the Senate\u2014have spoken about their cannabis campaign pledges. And so far, the only pardons to take place under the Biden administration have\u00a0<a href=\"https:\/\/www.marijuanamoment.net\/biden-pardons-turkeys-but-white-house-has-nothing-new-on-relief-for-marijuana-prisoners\/\" target=\"_blank\" rel=\"noopener\">benefited turkeys at a ceremonial Thanksgiving event<\/a>.<\/p>\n<p>That\u2019s despite the repeated pleas of lawmakers and advocates.<\/p>\n<p>Last month, a group of senators separately\u00a0<a href=\"https:\/\/www.marijuanamoment.net\/senators-urge-biden-to-grant-mass-pardon-for-thousands-of-marijuana-cases\/\" target=\"_blank\" rel=\"noopener\">sent a letter urging Biden to use his executive authority<\/a>\u00a0to grant a mass pardon for people with non-violent marijuana convictions.<\/p>\n<p>Sen. Elizabeth Warren (D-MA), who led that letter, said during a recent interview that Biden could boost the economy and promote racial equity\u00a0<a href=\"https:\/\/www.marijuanamoment.net\/elizabeth-warren-pushes-biden-to-do-mass-marijuana-pardons-with-the-stroke-of-a-pen\/\" target=\"_blank\" rel=\"noopener\">with the \u201cstroke of a pen\u201d by granting the relief<\/a>.<\/p>\n<p>A recently published Congressional Research Service (CRS) report affirmed that the president has it within his power to\u00a0<a href=\"https:\/\/www.marijuanamoment.net\/biden-administration-can-legalize-marijuana-without-waiting-for-lawmakers-congressional-researchers-say\/\" target=\"_blank\" rel=\"noopener\">grant mass pardons for cannabis offenses<\/a>. It also said that the administration can move to federally legalize cannabis without waiting for lawmakers to act.<\/p>\n<p>Relatedly, a\u00a0group of more than 150 celebrities, athletes, politicians, law enforcement professionals and academics\u00a0<a href=\"https:\/\/www.marijuanamoment.net\/drake-killer-mike-and-other-celebs-push-biden-to-issue-mass-marijuana-pardons\/\" target=\"_blank\" rel=\"noopener\">signed a letter that was delivered to Biden<\/a>\u00a0in September, urging him to issue a \u201cfull, complete and unconditional pardon\u201d to all people with non-violent federal marijuana convictions.<\/p>\n<p>Warren and Sen.
