{"id":52030,"date":"2021-12-29T06:12:03","date_gmt":"2021-12-29T14:12:03","guid":{"rendered":"https:\/\/cannabiscultivatornews.com\/home\/index.php\/2021\/12\/29\/new-hampshire-lawmakers-file-psilocybin-and-broader-drug-decriminalization-bills-for-2022\/"},"modified":"2021-12-29T13:45:52","modified_gmt":"2021-12-29T21:45:52","slug":"new-hampshire-lawmakers-file-psilocybin-and-broader-drug-decriminalization-bills-for-2022","status":"publish","type":"post","link":"https:\/\/cannabiscultivatornews.com\/home\/index.php\/2021\/12\/29\/new-hampshire-lawmakers-file-psilocybin-and-broader-drug-decriminalization-bills-for-2022\/","title":{"rendered":"New Hampshire Lawmakers File Psilocybin And Broader Drug Decriminalization Bills For 2022"},"content":{"rendered":"<p><img loading=\"lazy\" src=\"https:\/\/cannabiscultivatornews.com\/home\/wp-content\/uploads\/2021\/12\/MM_Bill_Tracker_V5_blank-89.jpg\" width=\"1500\" height=\"1500\"> <\/p>\n<p>As New Hampshire lawmakers gear up to <a href=\"https:\/\/www.marijuanamoment.net\/new-hampshire-lawmakers-file-multiple-marijuana-legalization-bills-ahead-of-2022-session\/\" target=\"_blank\" rel=\"noopener\">consider several marijuana legalization bills<\/a> in the upcoming legislative session, other legislators are turning their attention to psychedelics and broader drug policy reforms.<\/p>\n<p>Bills to decriminalize psilocybin mushrooms and more widely reduce penalties for non-violent drug offenses have been pre-filed for the 2022 session.<\/p>\n<p>Under the psychedelic fungus <a href=\"https:\/\/www.gencourt.state.nh.us\/bill_status\/legacy\/bs2016\/bill_status.aspx?lsr=2618&amp;sy=2022&amp;sortoption=&amp;txtsessionyear=2022&amp;txttitle=psilocybin\" target=\"_blank\" rel=\"noopener\">proposal<\/a>, sponsored by Rep. Tony Labranche (D) with a bipartisan list of cosponsors, adults who possess up to 12 grams of so-called magic mushrooms would be subject to a $100 fine, without the threat of jail time, for a first and second offense.<\/p>\n<p>\u201cNo person shall be subject to arrest for a violation of this section and shall be released provided the law enforcement officer does not have lawful grounds for arrest for a different offense,\u201d the bill reads.<\/p>\n<p>There would be a $300 fine for subsequent offenses, but they could be waived if a person completes a substance misuse assessment.<\/p>\n<p>Labranche previewed the reform proposal earlier this year, telling Marijuana Moment that he feels <a href=\"https:\/\/www.marijuanamoment.net\/19-year-old-new-hampshire-lawmaker-prepares-bills-to-decriminalize-psilocybin-and-all-drugs\/\" target=\"_blank\" rel=\"noopener\">substance use is a public health matter<\/a> that \u201cshould not be a criminal justice issue.\u201d<\/p>\n<p>Separately, Rep. Max Abramson (R) has pre-filed a broader <a href=\"https:\/\/www.gencourt.state.nh.us\/bill_status\/legacy\/bs2016\/bill_status.aspx?lsr=2674&amp;sy=2022&amp;sortoption=&amp;txtsessionyear=2022&amp;txttitle=drug\" target=\"_blank\" rel=\"noopener\">measure<\/a> that would repeal several state statutes relating to penalties for non-violent drug offenses.<\/p>\n<p>People found to be in possession of\u00a0cocaine, heroin, methamphetamine, LSD or PCP would face a fine of $40 per gram. A key Republican committee chairman and other leaders separately pre-filed a legalization bill.<\/p>\n<p>Recent polling\u00a0<a href=\"https:\/\/www.marijuanamoment.net\/strong-bipartisan-majority-supports-marijuana-legalization-in-new-hampshire-poll-finds\/\" target=\"_blank\" rel=\"noopener\">indicates that residents are ready for the reform<\/a>, with three in four New Hampshirites favoring legalization.<\/p>\n<p>Separately, standalone legalization legislation that\u2019s been retained from this year is set to be taken up when lawmakers reconvene early in 2022, and advocates are hopeful that it will advance based on prior votes in the House. The chamber <a href=\"https:\/\/www.marijuanamoment.net\/new-hampshire-house-approves-marijuana-legalization-bill\/\" target=\"_blank\" rel=\"noopener\">passed a legalization bill last year<\/a>, but it died in a Senate committee.<\/p>\n<p>While Gov. Chris Sununu (R) remains opposed to adult-use legalization, advocates are encouraged that he signed a bill last month <a href=\"https:\/\/www.marijuanamoment.net\/new-hampshire-governor-signs-bill-allowing-medical-marijuana-to-treat-opioid-use-disorder-and-letting-out-of-state-patients-shop\/\" target=\"_blank\" rel=\"noopener\">adding opioid use disorder as a qualifying condition<\/a>\u00a0for the state\u2019s medical cannabis program and also allows out-of-state patients to access dispensaries.<\/p>\n<p>In 2017, Sununu signed <a href=\"https:\/\/www.marijuanamoment.net\/new-hampshire-marijuana-decriminalization-takes-effect\/\" target=\"_blank\" rel=\"noopener\">a bill decriminalizing marijuana possession<\/a>\u00a0in the Granite State, though he continues to oppose adding a legal commercial cannabis sales component.<\/p>\n<p>Separately, a New Hampshire Senate committee in March heard testimony on a House-passed bill to allow medical marijuana patients to\u00a0<a href=\"https:\/\/www.marijuanamoment.net\/new-hampshires-medical-marijuana-dispensaries-now-support-letting-patients-grow-their-own\/\" target=\"_blank\" rel=\"noopener\">grow a limited number of plants for personal use<\/a>.
