It\u2019s being sponsored by Reps. Kathleen Rice (D-NY), Morgan Griffith (R-VA), Angie Craig (D-MN) and Dan Crenshaw (R-TX).<\/p>\n<p>While hemp and its derivatives were federally legalized under the 2018 Farm Bill, there are currently no rules in place to allow for the lawful marketing of CBD-infused foods and beverages. That\u2019s despite the fact that such products are widely available in markets across the U.S.\u2014just without regulations.<\/p>\n<p>Under the bill, FDA would be required to develop rules and hold a public comment period on the maximum amount of hemp-derived CBD that could be added to a food item or beverage per serving, labeling and packaging requirements and the \u201cconditions of intended use,\u201d according to the text of the legislation.<\/p>\n<p>\u201cCBD products are exploding in popularity, but the lack of federal regulation surrounding them has put consumers at risk and left businesses looking for clarity,\u201d Rice said in a press release. \u201cThe bipartisan CBD Product Safety and Standardization Act will establish the clear regulatory framework needed to provide stability for business and ensure unsafe products stay off the shelves.\u201d<\/p>\n<p>Griffith said that demand for CBD products \u201chas surged, but Food and Drug Administration regulations do not reflect this new reality.\u201d<\/p>\n<p>\u201cAs a result, adulterated or unsafe products are available that threaten consumer health, and businesses lack clarity,\u201d the congressman said. \u201cThe CBD Product Safety and Standardization Act would require the FDA to address the issue and ensure more certainty in the CBD marketplace.\u201d<\/p>\n<p>The industry groups Consumer Brands Association and U.S. Hemp Roundtable each <a href=\"https:\/\/mailchi.mp\/1018b21766e5\/new-us-house-bill-introduced-to-regulate-cbd-now\" target=\"_blank\" rel=\"noopener\">expressed<\/a> support for the bipartisan reform proposal.<\/p>\n<p>\u201cYears after CBD was decriminalized, a lack of clear federal standards in the CBD industry has left businesses guessing and customers at risk,\u201d Craig <a href=\"https:\/\/hempsupporter.com\/assets\/uploads\/RELEASE-Rice-Leads-Introduction-of-Bipartisan-CBD-Product-Safety-and-Standardization-Act.pdf\" target=\"_blank\" rel=\"noopener\">said<\/a>. \u201cIt\u2019s clear that this growing industry needs regulatory clarity in order to continue selling their products safely and effectively.\u201d<\/p>\n<p>Bipartisan senators <a href=\"https:\/\/www.marijuanamoment.net\/senate-bill-would-allow-cbd-infused-foods-drinks-and-dietary-supplements\/\" target=\"_blank\" rel=\"noopener\">introduced a bill in May that would similarly<\/a> exempt \u201chemp, hemp-derived cannabidiol, or a substance containing any other ingredient derived from hemp\u201d from certain restrictions that have blocked the emergence of legal consumable hemp products while the FDA has slow-walked regulations.<\/p>\n<p><strong>\u2014<br \/>\n<strong>Marijuana Moment is already <a href=\"https:\/\/www.marijuanamoment.net\/bills\/\" target=\"_blank\" rel=\"noopener\">tracking more than 1,200 cannabis, psychedelics and drug policy bills<\/a> in state legislatures and Congress this year. <a href=\"https:\/\/www.patreon.com\/marijuanamoment\" target=\"_blank\" rel=\"noopener\">Patreon supporters<\/a> pledging at least $25\/month get access to our interactive maps, charts and hearing calendar so they don\u2019t miss any developments.<\/strong><br \/>\n<a href=\"https:\/\/www.marijuanamoment.net\/bills\/\" target=\"_blank\" rel=\"noopener\"><img loading=\"lazy\" class=\"alignnone wp-image-9128 size-medium\" src=\"https:\/\/cannabiscultivatornews.com\/home\/wp-content\/uploads\/2021\/12\/MM_Bill_Tracker_V5_blank-8.jpg\" alt=\"\" width=\"300\" height=\"300\" \/><\/a><br \/>\n<strong>Learn more about our <a href=\"https:\/\/www.marijuanamoment.net\/bills\/\" target=\"_blank\" rel=\"noopener\">marijuana bill tracker<\/a> and become a <a href=\"https:\/\/www.patreon.com\/marijuanamoment\/\" target=\"_blank\" rel=\"noopener\">supporter on Patreon<\/a> to get access.<br \/>\n\u2014<\/strong><\/strong><\/p>\n<p>Griffith, who is a co-sponsor of this latest bill, also joined bipartisan colleagues in reintroducing separate legislation in February that would allow hemp and CBD derived from the crop <a href=\"https:\/\/www.marijuanamoment.net\/hemp-and-cbd-could-be-marketed-as-dietary-supplements-under-bipartisan-congressional-bill\/\" target=\"_blank\" rel=\"noopener\">to be marketed and sold as dietary supplements<\/a>.<\/p>\n<p>Earlier this year, FDA withdrew draft guidance on CBD enforcement that it had\u00a0<a href=\"https:\/\/www.marijuanamoment.net\/fda-submits-new-cbd-enforcement-guidance-to-white-house-for-review\/\" target=\"_blank\" rel=\"noopener\">submitted for review to the White House under the Trump administration<\/a>. There are few details about what the proposal included, but it was expected to give the industry a better understanding of the federal perspective when it comes to marketing cannabis products.<\/p>\n<p>The decision to withdraw it came shortly after President Joe Biden was inaugurated and his chief of staff sent out a government-wide memo calling on federal agencies to pull pending rules.<\/p>\n<p>The agency was mandated under appropriations legislation enacted in 2019 to\u00a0<a href=\"https:\/\/www.marijuanamoment.net\/congress-attaches-marijuana-hemp-and-cbd-provisions-to-federal-spending-bills\/\" target=\"_blank\" rel=\"noopener noreferrer\">provide an update on its regulatory approach to CBD<\/a>, and it did so in March of last year.
