Again, as was the case with a <a href=\"https:\/\/www.marijuanamoment.net\/senators-marijuana-amendment-to-defense-bill-would-streamline-research\/\" target=\"_blank\" rel=\"noopener\">separate recently introduced research-related proposal<\/a>, it\u2019s not the cannabis banking legislation that stakeholders have been waiting for\u2014but it would have broad implications for federal policy nonetheless.<\/p>\n<p>The new amendment\u2014filed Sens. Brian Schatz (D-HI), Bernie Sanders (I-VT), Tim Kaine (D-VA), Jeff Merkley (D-OR), Ron Wyden (D-OR), Jacky Rosen (D-NV), Alex Padilla (D-CA) and Gary Peters (D-MI)\u2014would add language to the National Defense Authorization Act (NDAA) to federally legalize medical marijuana for military veterans who comply with a state program where they live.<\/p>\n<p>Physicians with U.S. Department of Veterans Affairs (VA) would also be allowed for the first time to issue such recommendations.<\/p>\n<p>Further, it would require VA to study the therapeutic potential of marijuana for pain and reducing opioid misuse.<\/p>\n<p>Separately on Thursday, the House Veterans\u2019 Affairs Committee approved a bill that would require VA to conduct <a href=\"https:\/\/www.marijuanamoment.net\/congressional-lawmakers-approve-marijuana-research-bill-for-veterans-in-committee-vote\/\" target=\"_blank\" rel=\"noopener\">clinical trials on the medical benefits of cannabis for military veterans<\/a> with PTSD and chronic pain.<\/p>\n<p>The Senate defense legislation amendment is identical to a standalone bill\u2014the <a href=\"https:\/\/www.marijuanamoment.net\/bipartisan-bills-to-legalize-medical-marijuana-for-military-veterans-introduced-in-congress\/\" target=\"_blank\" rel=\"noopener\">Veterans Medical Marijuana Safe Harbor Act<\/a>\u2014that Schatz filed in April. Dianne Feinstein (D-CA) are also pushing to attach language to the large-scale legislation that deals with <a href=\"https:\/\/www.marijuanamoment.net\/senators-marijuana-amendment-to-defense-bill-would-streamline-research\/\" target=\"_blank\" rel=\"noopener\">removing barriers to research on marijuana\u2019s effects<\/a>. It\u2019s intended to streamline the application process for researchers who want to investigate cannabis as well as manufacture the plant to be used in studies.<\/p>\n<p>That amendment is identical to <a href=\"https:\/\/www.marijuanamoment.net\/bipartisan-marijuana-research-bill-reintroduced-in-the-senate\/\" target=\"_blank\" rel=\"noopener\">standalone legislation that the senators filed<\/a>\u00a0in February, alongside Sen. Chuck Grassley (R-IA). The Senate\u00a0<a href=\"https:\/\/www.marijuanamoment.net\/senate-passes-marijuana-research-bill-one-week-after-house-approves-similar-legislation\/\" target=\"_blank\" rel=\"noopener\">unanimously approved an earlier version of that bill late last year<\/a>, but it was not taken up by the House by the end of the session.<\/p>\n<p>The research proposal\u00a0would also clarify that physicians are allowed to discuss the risks and benefits of marijuana with patients and require the U.S. Department of Health and Human Services (HHS) to submit a report on those potential health benefits, as well one on barriers to cannabis research and how to overcome those obstacles.<\/p>\n<p>Dozens of other amendments have filed for NDAA so far, and industry stakeholders are eager to see if the Senate follows the lead of the House and inserts language meant to <a href=\"https:\/\/www.marijuanamoment.net\/house-officially-passes-defense-bill-with-marijuana-banking-protections-but-key-senators-may-block-path-ahead\/\" target=\"_blank\" rel=\"noopener\">protect banks that service state-legal marijuana businesses<\/a>.<\/p>\n<p>For now, the research and veterans amendments are the only cannabis-related measures that have been submitted, but it\u2019s not yet clear when the overall bill will come to the Senate floor. If no senator files a banking amendment, the issue\u2019s fate will be decided by a bicameral conference committee charged with reconciling the differences between the two chambers\u2019 versions of the bill before sending a final proposal to the president.<\/p>\n<p>Senate leadership has spent a lot of time thinking about marijuana policy priorities this session, with Majority Leader Chuck Schumer (D-NY), Senate Finance Committee Chairman Ron Wyden (D-OR) and Sen. Cory Booker (D-NJ) saying repeatedly that they think comprehensive reform should advance before banking.<\/p>\n<p>That said, Schumer did say during a recent podcast interview that he\u2019s open to\u00a0<a href=\"https:\/\/www.marijuanamoment.net\/chuck-schumer-says-key-senators-have-agreement-not-to-advance-marijuana-banking-reform-before-legalization\/\" target=\"_blank\" rel=\"noopener\">approving banking as part of the defense legislation<\/a>\u00a0if it contains social equity components. Booker, for his part, has been more obstinate,\u00a0<a href=\"https:\/\/www.marijuanamoment.net\/cory-booker-vows-to-block-marijuana-banking-until-senate-passes-comprehensive-legalization\/\" target=\"_blank\" rel=\"noopener\">saying he \u201cwill lay myself down\u201d to block<\/a>\u00a0any other senators who seek to pass marijuana banking legislation ahead of broad, justice-focused legalization.<\/p>\n<p>Meanwhile, Feinstein, Schatz and Grassley separately filed the research amendment as\u00a0<a href=\"https:\/\/www.marijuanamoment.net\/new-marijuana-and-cbd-research-amendment-could-be-added-to-senates-infrastructure-bill-this-week\/\" target=\"_blank\" rel=\"noopener\">part of a massive infrastructure bill earlier this year<\/a>, but it was not given consideration on the floor.<\/p>\n<p>House lawmakers, for their part,\u00a0<a href=\"https:\/\/www.marijuanamoment.net\/house-approves-marijuana-research-bill-days-after-voting-to-federally-legalize-cannabis\/\" target=\"_blank\" rel=\"noopener\">also passed legislation last year to expand cannabis research<\/a>, but that bill did not advance in the Senate. The House bill, which would <a href=\"https:\/\/www.marijuanamoment.net\/new-bipartisan-marijuana-research-bill-in-congress-would-let-scientists-study-dispensary-products\/\" target=\"_blank\" rel=\"noopener\">allow scientists to study the marijuana that consumers are actually purchasing at dispensaries<\/a>, was reintroduced last month.<\/p>\n<p>Congressional legislators are also advancing a separate strategy to open up dispensary cannabis to researchers.
