And that would include offenses like simple cannabis possession that have been made legal under the state\u2019s new law.<\/p>\n<p>It\u2019s a move that advocates say would undermine the social justice objectives of legalization and defies the intent of lawmakers who advanced legislation to implement legalization after voters approved it on the ballot last year.<\/p>\n<p>Under the rules proposed by the Montana Department of Revenue (DOR) on Wednesday, regulators listed a series of factors that are \u201cgrounds for suspension or revocation of a worker permit.\u201d<\/p>\n<p>That includes any \u201cconviction, guilty plea, or plea of no contest to a criminal offense within three years of the application or renewal.\u201d DOR specified that the prohibition involves a violation of \u201cany provision of the marijuana laws,\u201d including those of other states.<\/p>\n<p>A public hearing on the proposed <a href=\"https:\/\/content.govdelivery.com\/attachments\/MTDOR\/2021\/11\/01\/file_attachments\/1983250\/42-1040pro-arm.pdf\" target=\"_blank\" rel=\"noopener\">rules<\/a> is scheduled for November 30, and comments are being accepted until December 6.<\/p>\n<p>The broad employment language is distinct from what workers in other state-legal cannabis markets are subjected to. And because of racial disparities in the criminal justice system\u2014particularly as it concerns enforcement of drug laws\u2014advocates have voiced concern that DOR\u2019s rules would further drive disparities.<\/p>\n<p>\u201cMontana DOR just flushed restorative justice down the toilet with absurd their new rules, and to add insult to injury they want to make it harder to be a budtender or marijuana worker now when we are in the middle of an employment crisis,\u201d Pepper Peterson of the Montana Cannabis Guild said in an email to Marijuana Moment.<\/p>\n<p>He said new that proposed rules \u201ccontradict legislative negotiations and intent and just appear to be a massive power grab by the DOR.\u201d<\/p>\n<p>Montana voters <a href=\"https:\/\/www.marijuanamoment.net\/montana-voters-approve-marijuana-legalization-ballot-measure\/\" target=\"_blank\" rel=\"noopener\">approved adult-use legalization last year<\/a>, and the <a href=\"https:\/\/www.marijuanamoment.net\/montana-governor-signs-marijuana-legalization-implementation-bill\/\" target=\"_blank\" rel=\"noopener\">governor signed implementation legislation<\/a> in May.<\/p>\n<p>That bill did stipulate that people seeking employment in the cannabis sector must report to regulators whether they have a felony conviction, a violation of a cannabis law in another state or any citation related to selling alcohol or tobacco to someone underage\u2014but it didn\u2019t say they were automatically disqualified.<\/p>\n<p>DOR appears to have reinterpreted the policy in a way that\u2019s significantly more restrictive by including a much broader array of convictions as automatic bans.<\/p>\n<p>That said, the department\u2019s proposed rules and the implementation legislation both say that there\u2019s an appeals process for those working in the cannabis market.<\/p>\n<p>Rep. Katie Sullivan (D), who serves on the Legislature\u2019s Economic Affairs Interim Committee that has oversight over the department\u2019s rulemaking, <a href=\"https:\/\/dailymontanan.com\/2021\/11\/03\/draft-marijuana-employee-permitting-rule-troubles-industry\/\" target=\"_blank\" rel=\"noopener\">told<\/a> The Daily Montanan that \u201cthere\u2019s a lot going into the rules that\u2019s kind of new.\u201d<\/p>\n<p>\u201cWe definitely have to be really careful and read everything,\u201d she said.<\/p>\n<p>Regulators also <a href=\"https:\/\/www.marijuanamoment.net\/montana-officials-loosen-proposed-marijuana-advertising-restrictions\/\" target=\"_blank\" rel=\"noopener\">faced pushback earlier this year<\/a> over proposed rules on advertising for marijuana businesses.<\/p>\n<p>While not directly related to cannabis industry employment eligibility, the decision by Montana\u2019s DOR stand in stark contrast to what other legal states are doing with respect to marijuana and workplace issues.<\/p>\n<p>The New York Department of Labor recently clarified that employers overall are <a href=\"https:\/\/www.marijuanamoment.net\/new-york-employers-cant-drug-test-most-workers-for-marijuana-state-announces\/\" target=\"_blank\" rel=\"noopener\">no longer allowed to drug test most workers for marijuana<\/a>, for example.<\/p>\n<p>Congressional lawmakers in the Senate and House have both included language in recent appropriations reports urging a review of employment policies for federal agencies with respect to personal use of cannabis. The <a href=\"https:\/\/www.marijuanamoment.net\/house-approves-marijuana-banking-employment-and-d-c-sales-provisions-in-large-scale-spending-bill\/\" target=\"_blank\" rel=\"noopener\">House version passed in July<\/a>, while\u00a0<a href=\"https:\/\/www.marijuanamoment.net\/democratic-senators-bill-would-let-dc-legalize-marijuana-sales-in-contrast-to-bidens-proposed-blockade\/\" target=\"_blank\" rel=\"noopener\">the Senate Democrats\u2019 report was released on Monday<\/a>.<\/p>\n<p>The Office of Personnel Management (OPM) recently issued a memo to federal agencies that says admitting to\u00a0past marijuana use\u00a0<a href=\"https:\/\/www.marijuanamoment.net\/marijuana-use-wont-automatically-block-people-from-federal-jobs-biden-administration-memo-says\/\" target=\"_blank\" rel=\"noopener\">should not automatically disqualify people<\/a>\u00a0from being employed in the federal government.<\/p>\n<p>Meanwhile, the Biden administration came under criticism this year after it was reported that it had fired or otherwise punished dozens of staffers who admitted to prior marijuana use.
