{"id":50790,"date":"2021-10-27T07:06:25","date_gmt":"2021-10-27T15:06:25","guid":{"rendered":"https:\/\/cannabiscultivatornews.com\/home\/index.php\/2021\/10\/27\/new-jersey-governor-open-minded-to-allowing-marijuana-home-grow-as-state-works-to-implement-legalization\/"},"modified":"2021-10-27T13:45:51","modified_gmt":"2021-10-27T21:45:51","slug":"new-jersey-governor-open-minded-to-allowing-marijuana-home-grow-as-state-works-to-implement-legalization","status":"publish","type":"post","link":"https:\/\/cannabiscultivatornews.com\/home\/index.php\/2021\/10\/27\/new-jersey-governor-open-minded-to-allowing-marijuana-home-grow-as-state-works-to-implement-legalization\/","title":{"rendered":"New Jersey Governor \u2018Open-Minded\u2019 To Allowing Marijuana Home Grow As State Works To Implement Legalization"},"content":{"rendered":"<\/p>\n<p>The governor of New Jersey says he\u2019s open to giving adults the right to cultivate marijuana for personal use.<\/p>\n<p>The state is still in the process of implementing legalization following voter approval of the reform last November, and home cultivation is not currently permitted under the conforming legislation that <a href=\"https:\/\/www.marijuanamoment.net\/new-jersey-lawmakers-send-marijuana-compromise-bill-to-governors-desk-setting-stage-for-legal-sales\/\" target=\"_blank\" rel=\"noopener\">Gov. Phil Murphy (D) signed earlier this year<\/a>.<\/p>\n<p>But Murphy said in an interview with News 12 that he\u2019s \u201cnot sure there\u2019s a good answer\u201d as to why the state still criminalizes recreational consumers or medical cannabis patients who grow their own and that he\u2019s \u201copen-minded to considering adjusting\u201d the policy. The remarks were first <a href=\"https:\/\/headynj.com\/murphy-open-to-cannabis-home-cultivation-as-support-builds-slowly-for-medical-bill\/\" target=\"_blank\" rel=\"noopener\">noted<\/a> by Heady NJ.<\/p>\n<p>\u201cThat\u2019s not to say that I think we\u2019re not going to have a really good, smart regime\u201d under the program as it\u2019s already being implemented, he <a href=\"https:\/\/newjersey.news12.com\/live-ask-gov-murphy-october-22-2021\" target=\"_blank\" rel=\"noopener\">added<\/a>. Regulators are \u201cputting a world-class industry together. I\u2019m really impressed by it.\u201d<\/p>\n<p>\u201cAgain, equity is right at the center of it,\u201d the governor said in the interview, which was broadcast on Friday. \u201cBut there was a lot of legitimate interest in allowing, in some form or fashion, home grow. And I would just say I\u2019d be open minded to that discussion.\u201d<\/p>\n<p>There are home grow bills for both medical and recreational cannabis that have been introduced in the legislature, but they haven\u2019t advanced.<\/p>\n<p>Murphy also touted the fact that the courts have <a href=\"https:\/\/www.marijuanamoment.net\/new-jersey-has-expunged-a-third-of-a-million-marijuana-convictions-since-july\/\" target=\"_blank\" rel=\"noopener\">expunged more than 362,000 marijuana cases<\/a> since July 1, when a decriminalization law took effect that mandated the relief for people who have been caught up in prohibition enforcement.<\/p>\n<p>The day after the governor signed the legalization legislation, then-Attorney General Gurbir Grewal (D) directed prosecutors to <a href=\"https:\/\/www.marijuanamoment.net\/new-jersey-attorney-general-orders-marijuana-cases-to-be-dropped-following-legalization-bill-signing\/\" target=\"_blank\" rel=\"noopener\">drop cases for cannabis-related offenses<\/a>\u00a0and issued separate guidance for police on how to proceed under the updated laws.<\/p>\n<p>The attorney general also\u00a0<a href=\"https:\/\/www.marijuanamoment.net\/new-jersey-prosecutors-must-suspend-marijuana-possession-cases-state-attorney-general-says\/\" target=\"_blank\" rel=\"noopener\">encouraged prosecutorial discretion for marijuana cases<\/a>\u00a0in earlier memos prior to the bill\u2019s signing.<\/p>\n<p>Grewal further took steps to ensure that people aren\u2019t exploiting provisions of the legalization law before retail sales launch. In June, he <a href=\"https:\/\/www.marijuanamoment.net\/new-jersey-attorney-general-cracks-down-on-gift-marijuana-schemes-involving-overpriced-snacks\/\" target=\"_blank\" rel=\"noopener\">sent warning letters to companies<\/a>\u00a0that were effectively circumventing the state\u2019s marijuana laws by \u201cgifting\u201d cannabis in exchange for non-marijuana-related purchases such as overpriced cookies, brownies and stickers.<\/p>\n<p>Gifting is lawful between adults 21 and older under New Jersey\u2019s adult-use cannabis law, but a number of businesses have allegedly taken advantage of that policy by giving away \u201cfree\u201d cannabis products to those who purchase other items like snacks and baked goods.<\/p>\n<p>No retail marijuana businesses have been licensed since the state enacted recreational legalization this year.
