It\u2019s the latest in a string of reform measures that lawmakers from both sides of the aisle have been promoting in recent days.<\/p>\n<p>Sens. Dan Laughlin (R) and Sharif Street (D) unveiled the nearly 240-page legislation months after <a href=\"https:\/\/www.marijuanamoment.net\/bipartisan-pennsylvania-senators-team-up-on-new-marijuana-legalization-bill\/\" target=\"_blank\" rel=\"noopener\">first outlining some key details<\/a> back in February. It would allow adults 21 and older to purchase and possess up to 30 grams of cannabis, five grams of marijuana concentrate products and 500 milligrams of THC contained in cannabis-infused products.<\/p>\n<blockquote class=\"twitter-tweet\" data-width=\"550\" data-dnt=\"true\">\n<p lang=\"en\" dir=\"ltr\">Full bill coming tomorrow, here\u2019s the two chapters we heard the most about. Amen Brown (D) on Tuesday <a href=\"https:\/\/www.marijuanamoment.net\/bipartisan-pennsylvania-lawmakers-team-up-on-marijuana-legalization-bill-as-push-for-reform-in-the-state-heats-up\/\" target=\"_blank\" rel=\"noopener\">announced his intent to file a reform bill<\/a> that he\u2019ll be working on with <a href=\"https:\/\/www.marijuanamoment.net\/gop-pennsylvania-senator-with-federal-law-enforcement-background-to-file-marijuana-legalization-bill\/\" target=\"_blank\" rel=\"noopener\">Sen. Mike Regan (R), who expressed his support for the policy change a day earlier<\/a>.<\/p>\n<p>Last week, a separate pair of state lawmakers\u2014Reps. Jake Wheatley (D) and Dan Frankel (D)\u2014<a href=\"https:\/\/www.marijuanamoment.net\/pennsylvania-lawmakers-unveil-marijuana-legalization-bill-with-focus-on-social-equity\/\" target=\"_blank\" rel=\"noopener\">formally unveiled a legalization bill they\u2019re proposing<\/a>.<\/p>\n<p>While each measure generally seeks and end to marijuana criminalization by creating a regulated, commercial model for cannabis, there are some provisions that make each piece of legislation unique. For example, the proposals vary in how they would approach taxes, revenue and social equity.<\/p>\n<p>With respect to social justice, the new bipartisan Senate bill filed on Friday calls on the courts to \u201ccompile records that can be automatically expunged\u201d within six month of enactment. Eligible cases would be those related to low-level possession, including those for distribution (but not sales).<\/p>\n<p>The board would also be required to \u201cdevelop and implement a comprehensive social equity and economic development program in partnership with the Commonwealth Financing Authority.\u201d<\/p>\n<p>Under the measure, people would need to pay the state\u2019s six percent sales tax, as well as a 10 percent excise tax, when purchasing marijuana products. Revenue from those taxes would go to counties (10 percent), municipalities (10 percent), and 80 percent would support a Cannabis Regulation Fund that also promote social equity.<\/p>\n<p>Of that 80 percent, up to two percent would be allocated to regulators with a newly established Cannabis Regulatory Control Board, which would also take over the state\u2019s medical cannabis program, for implementation costs. Board members would be appointed by the governor and legislative leaders.<\/p>\n<p>A Cannabis Business Development Fund would also receive $3 million in marijuana tax dollars annually as part of that 80 percent allocation. That fund is designed to provide low-interest rate loans and grants \u201cto qualified social and economic equity applicants.\u201d<\/p>\n<p>Social and economic equity applicants are defined under the legislation as those with at least 75 percent ownership by individuals who have lived in a disproportionately impacted community for at least five of the last 10 years or those with at least 75 percent ownership by people who have been arrested or convicted over offenses that would be made eligible for expungements under the bill.<\/p>\n<p>The bill would also \u201cpay for outreach that may be provided or targeted to attract and support social and economic equity applicants\u201d and fund \u201cjob training and technical assistance for residents in disproportionately impacted areas.\u201d<\/p>\n<p>Any remaining tax dollars would go to the state general fund.<\/p>\n<p>Regulators would be responsible for issuing licenses for the cultivation, micro-cultivation, dispensing and testing of marijuana. Gov. John Fetterman (D), <a href=\"https:\/\/www.marijuanamoment.net\/top-pennsylvania-official-who-champions-marijuana-legalization-weighs-2022-senate-run\/\" target=\"_blank\" rel=\"noopener\">who is running for U.S. Senate<\/a>, told Marijuana Moment in a phone interview on Monday that he\u2019s optimistic about the prospects of reform with these latest proposals, though he acknowledged that there may be disputes between legislators over how tax revenue should be distributed.<\/p>\n<p>Gov. Tom Wolf (D), for his part, told KDKA on Tuesday that a bipartisan approach to legalization \u201cwould be a great thing. I think the time is right.\u201d<\/p>\n<p>Meanwhile, the Philadelphia City Council has\u00a0<a href=\"https:\/\/www.marijuanamoment.net\/philadelphia-will-vote-on-marijuana-referendum-calling-for-statewide-legalization-next-month\/\" target=\"_blank\" rel=\"noopener\">placed a referendum on the local November ballot<\/a>\u00a0urging the state to enact legalization. The hope is that the local vote could further motivate the legislature to move ahead with legalization.<\/p>\n<p>While broad cannabis legalization proposals have not moved forward in the Republican-led legislature, Pennsylvania senators heard testimony last month on <a href=\"https:\/\/www.marijuanamoment.net\/pennsylvania-senators-will-consider-dui-protections-for-medical-marijuana-patients-at-hearing\/\" target=\"_blank\" rel=\"noopener\">a bill to protect medical marijuana patients<\/a>\u00a0from being prosecuted under the state\u2019s \u201czero tolerance\u201d DUI laws.<\/p>\n<p>Sen. Camera Bartolotta (R)\u00a0<a href=\"https:\/\/www.marijuanamoment.net\/police-would-have-to-prove-actual-impairment-in-medical-marijuana-duis-under-new-pennsylvania-bill\/\" target=\"_blank\" rel=\"noopener\">first introduced an earlier version<\/a>\u00a0of the\u00a0bill\u00a0in June 2020. She said at the time that the state needs to \u201censure that the legal use of this medicine does not give rise to a criminal conviction.\u201d<\/p>\n<p>Months after the standalone reform legislation was introduced, the Pennsylvania House approved\u00a0<a href=\"https:\/\/www.marijuanamoment.net\/pennsylvania-house-votes-to-protect-medical-marijuana-patients-from-dui-charges\/\" target=\"_blank\" rel=\"noopener\">a separate amendment that would enact the policy change<\/a>.<\/p>\n<p>Separately this week, a bipartisan coalition of Pennsylvania lawmakers introduced a bill that\u2019s meant to <a href=\"https:\/\/www.marijuanamoment.net\/gop-pennsylvania-lawmaker-files-psilocybin-research-bill-for-veterans-and-first-responders\/\" target=\"_blank\" rel=\"noopener\">promote research into the therapeutic potential of psilocybin mushrooms<\/a> for mental health conditions such as post-traumatic stress disorder.<\/p>\n<p>Outside the legislature, Wolf\u00a0<a href=\"https:\/\/www.marijuanamoment.net\/pennsylvania-governor-says-marijuana-legalization-is-a-priority-in-budget-negotiations-with-lawmakers\/\" target=\"_blank\" rel=\"noopener\">said earlier this year that marijuana legalization was a priority<\/a>\u00a0as he negotiated the annual budget with lawmakers. However, his formal spending request didn\u2019t contain legislative language to actually accomplish the cannabis policy change.<\/p>\n<p>Wolf, who signed\u00a0<a href=\"https:\/\/www.marijuanamoment.net\/pennsylvania-governor-signs-medical-marijuana-expansion-bill-into-law\/\" target=\"_blank\" rel=\"noopener\">a medical cannabis expansion bill in June<\/a>, has repeatedly called for legalization and\u00a0<a href=\"https:\/\/www.marijuanamoment.net\/pennsylvania-governor-again-calls-on-lawmakers-to-legalize-marijuana\/\" target=\"_blank\" rel=\"noopener\">pressured the Republican-controlled legislature to pursue the reform<\/a>\u00a0since\u00a0<a href=\"https:\/\/www.marijuanamoment.net\/pennsylvania-governor-comes-out-in-support-of-marijuana-legalization\/\" target=\"_blank\" rel=\"noopener\">coming out in favor of the policy in 2019<\/a>. Shortly after he did that, a lawmaker filed a separate bill to\u00a0<a href=\"https:\/\/www.marijuanamoment.net\/bill-to-legalize-marijuana-through-state-run-model-introduced-in-pennsylvania\/\" target=\"_blank\" rel=\"noopener noreferrer\">legalize marijuana through a state-run model<\/a>.<\/p>\n<p>In May,\u00a0<a href=\"https:\/\/www.marijuanamoment.net\/pennsylvania-governor-pardons-doctor-convicted-for-growing-medical-marijuana-for-dying-wife\/\" target=\"_blank\" rel=\"noopener\">Wolf pardoned a doctor<\/a>\u00a0who was arrested, prosecuted and jailed for growing marijuana that he used to provide relief for his dying wife.
