{"id":50318,"date":"2021-10-05T10:45:56","date_gmt":"2021-10-05T18:45:56","guid":{"rendered":"https:\/\/cannabiscultivatornews.com\/home\/index.php\/2021\/10\/05\/new-york-marijuana-regulators-hold-first-legalization-implementation-meeting-and-approve-patient-access-to-flower-cannabis\/"},"modified":"2021-10-05T13:45:35","modified_gmt":"2021-10-05T21:45:35","slug":"new-york-marijuana-regulators-hold-first-legalization-implementation-meeting-and-approve-patient-access-to-flower-cannabis","status":"publish","type":"post","link":"https:\/\/cannabiscultivatornews.com\/home\/index.php\/2021\/10\/05\/new-york-marijuana-regulators-hold-first-legalization-implementation-meeting-and-approve-patient-access-to-flower-cannabis\/","title":{"rendered":"New York Marijuana Regulators Hold First Legalization Implementation Meeting And Approve Patient Access To Flower Cannabis"},"content":{"rendered":"<\/p>\n<p>New York\u2019s Cannabis Control Board (CCB) held its first meeting on Tuesday, a key step toward implementing the state\u2019s adult-use marijuana program.<\/p>\n<p>Regulators announced that some changes to the state\u2019s existing medical cannabis program that were included in the recreational legalization law enacted earlier this year will take effect immediately. Dispensaries will now be allowed to sell flower marijuana products to qualified patients, for example. But home cultivation for patients remains prohibited for the time being because officials have failed to meet a deadline to develop rules for such activity.<\/p>\n<p>It\u2019s unclear when home grow regulations will be put into place, but former New York Assemblywoman Tremaine Wright (D), who chairs CCB, said they body is \u201cvery committed to drafting these regulations and issuing them for public comments, and expect it to be an agenda item on one of the upcoming board meetings.\u201d She did not provide specifics on when to expect that to happen, however.<\/p>\n<p>Members of the board, who were recently <a href=\"https:\/\/www.marijuanamoment.net\/new-york-marijuana-regulatory-board-is-officially-completed-with-governors-final-appointments\/\" target=\"_blank\" rel=\"noopener\">appointed by the governor and legislative leaders<\/a>, also discussed ethical considerations for regulators, approved key staff hires and talked about next steps for the panel.<\/p>\n<p>While the conversation was largely preliminary\u2014and lasted just over a half hour\u2014the board signed off on some regulatory positions such as a chief equity officer. Jason Starr, who served as assistant counsel to former New York Gov. Andrew Cuomo (D) and also worked at the New York Civil Liberties Union, will assume that role.<\/p>\n<p>The panel also announced that the state\u2019s medical marijuana program would be immediately affected. Patients will be able to access flower cannabis products at existing dispensaries, and the $50 registration fee for patients and caregivers is being permanently waived, for example. Lawmakers who sponsored the legalization bill had argued that those changes to the law could be self-executing and did not require the regulatory body to be seated to be enacted, but Cuomo\u2019s administration had a different view.<\/p>\n<p>Gov. Kathy Hochul (D), who replaced Cuomo after he resigned amid a sexual harassment scandal, has repeatedly emphasized her interest in <a href=\"https:\/\/www.marijuanamoment.net\/getting-new-york-marijuana-legalization-rolling-is-a-priority-new-governors-office-says\/\" target=\"_blank\" rel=\"noopener\">efficiently implementing the legalization law<\/a> that was signed in March.<\/p>\n<p>At a recent event, she touted the fact that <a href=\"https:\/\/www.marijuanamoment.net\/new-york-governor-says-marijuana-legalization-will-create-thousands-of-jobs-and-touts-regulatory-appointments\/\" target=\"_blank\" rel=\"noopener\">she had quickly made regulatory appointments<\/a> that had been delayed under her predecessor. \u201cI believe there\u2019s thousands and thousands of jobs\u201d that could be created in the new industry, the governor said.<\/p>\n<p>Advocates are encouraged by the appointments and Hochul\u2019s attention to the issue. And now with the board filled out and having held an introductory <a href=\"https:\/\/cannabis.ny.gov\/system\/files\/documents\/2021\/09\/cannabis-control-board-public-meeting-notice-oct-5.pdf\" target=\"_blank\" rel=\"noopener\">meeting<\/a>, the work begins to create rules for marijuana business licensing. Members will have broad authority to establish licensing regulations, and activists will be watching closely to see the extent to which social equity applicants will be prioritized.<\/p>\n<p>CCB is responsible for overseeing the independent Office of Cannabis Management within the New York State Liquor Authority, which is also responsible for regulating the state\u2019s medical marijuana and hemp industries.<\/p>\n<p>As it stands, adults 21 and older can possess up to three ounces of cannabis or 24 grams of concentrates in New York\u2014and they can also\u00a0<a href=\"https:\/\/www.marijuanamoment.net\/cops-cant-arrest-you-for-smoking-marijuana-on-sidewalks-nypd-says-in-post-legalization-memo\/\" target=\"_blank\" rel=\"noopener\">smoke marijuana in public anywhere tobacco can be smoked<\/a>\u2014but there aren\u2019t any shops open for business yet.<\/p>\n<p>The first licensed recreational marijuana retailers in New York <a href=\"http:\/\/marijuanamoment.net\/new-yorks-first-marijuana-retail-license-applications-are-now-being-accepted-by-an-indian-tribe\/\" target=\"_blank\" rel=\"noopener\">may actually be located on Indian territory<\/a>, with one tribe officially opening applications for prospective licensees earlier this month.<\/p>\n<p>In July, a New York senator filed a bill to\u00a0<a href=\"https:\/\/www.marijuanamoment.net\/new-york-senators-bill-would-let-farmers-get-a-head-start-on-growing-marijuana\/\" target=\"_blank\" rel=\"noopener\">create a provisional marijuana licensing category<\/a>\u00a0so that farmers could begin cultivating and selling cannabis ahead of the formal rollout of the adult-use program. The bill has been referred to the Senate Rules Committee.<\/p>\n<p>Because the implementation process has been drawn out, however, one GOP senator wants to give local jurisdictions another year to decide\u00a0<a href=\"https:\/\/www.marijuanamoment.net\/new-york-senator-wants-to-give-cities-more-time-to-ban-marijuana-businesses-as-regulations-develop\/\" target=\"_blank\" rel=\"noopener\">whether they will opt out of allowing marijuana businesses<\/a>\u00a0to operate in their area\u2014a proposal that advocates say is unnecessary and would create undue complications for the industry.<\/p>\n<p>Under the law as enacted, municipalities must determine whether they will opt out of permitting marijuana retailers or social consumption sites by December 31, 2021. Sen. George Borrello (R) introduced legislation earlier this month that would push that deadline back one year.<\/p>\n<p>Legalization activists aren\u2019t buying the argument, however.<\/p>\n<p>Adding pressure to get the market up and running is the fact that regulators in neighboring New Jersey\u00a0<a href=\"https:\/\/www.marijuanamoment.net\/new-jersey-regulators-approve-rules-for-adult-use-marijuana-market-nearly-one-year-after-legalization-vote\/\" target=\"_blank\" rel=\"noopener\">recently released rules for its adult-use marijuana program<\/a>, which is being implemented after voters approved a legalization referendum last year.<\/p>\n<p>The state comptroller recently projected that New York stands to eventually\u00a0<a href=\"https:\/\/www.marijuanamoment.net\/new-york-will-generate-245-million-in-marijuana-revenue-annually-by-2024-state-official-estimates\/\" target=\"_blank\" rel=\"noopener\">generate $245 million in annual marijuana revenue<\/a>, which they say will help\u00a0<a href=\"https:\/\/www.marijuanamoment.net\/new-york-officials-say-marijuana-tax-revenue-will-help-fill-budget-gap-from-declining-cigarette-sales\/\" target=\"_blank\" rel=\"noopener\">offset losses from declining tobacco sales<\/a>.<\/p>\n<p>For the first year of cannabis sales, the state is expected to see just $20 million in tax and fee collections.
