{"id":50234,"date":"2021-09-30T13:23:33","date_gmt":"2021-09-30T21:23:33","guid":{"rendered":"https:\/\/cannabiscultivatornews.com\/home\/index.php\/2021\/09\/30\/19-year-old-new-hampshire-lawmaker-prepares-bills-to-decriminalize-psilocybin-and-all-drugs\/"},"modified":"2021-09-30T13:46:12","modified_gmt":"2021-09-30T21:46:12","slug":"19-year-old-new-hampshire-lawmaker-prepares-bills-to-decriminalize-psilocybin-and-all-drugs","status":"publish","type":"post","link":"https:\/\/cannabiscultivatornews.com\/home\/index.php\/2021\/09\/30\/19-year-old-new-hampshire-lawmaker-prepares-bills-to-decriminalize-psilocybin-and-all-drugs\/","title":{"rendered":"19-Year-Old New Hampshire Lawmaker Prepares Bills To Decriminalize Psilocybin And All Drugs"},"content":{"rendered":"<p><img loading=\"lazy\" src=\"https:\/\/cannabiscultivatornews.com\/home\/wp-content\/uploads\/2021\/09\/MM_Bill_Tracker_V5_blank-76.jpg\" width=\"1500\" height=\"1500\"> <\/p>\n<p>As New Hampshire lawmakers push to enact marijuana legalization in the state, broader drug policy reform may also be on the horizon, with one of the youngest state legislators in the U.S. now pushing for the decriminalization of psilocybin as well as all currently illicit substances.<\/p>\n<p>The Granite State\u2019s legislature is currently under GOP control, and that\u2019s created complications for lawmakers hoping to join their neighbors in ending cannabis prohibition and establishing a regulated sales system. Rep. Tony Labranche (D) wants to see that policy change enacted, but he also has his eyes set on ending the drug war more holistically.<\/p>\n<p>The 19-year-old state representative spoke with Marijuana Moment this week about his plans to push legislation to end the criminalization of people who use or possess so-called magic mushrooms and also generally decriminalize possession of any controlled substance.<\/p>\n<p>\u201cIt\u2019s the right thing to do. Personally, I don\u2019t think anybody who suffers from substance use disorder should be criminalized, period,\u201d Labranche said. \u201cIn some cases, like magic mushrooms, those aren\u2019t the hard drugs that are dangerous. And I believe that people should have the right to use it and it should be legalized.\u201d<\/p>\n<p>Whether the legislature currently has the appetite to advance the bold drug reform proposals that Labranche is championing is yet to be seen. But at the very least, he\u2019s helping to advance the conversation\u2014and it\u2019s a dialogue that\u2019s increasingly being led by a younger generation of lawmakers.<\/p>\n<p>Earlier this year, for example, a 20-year-old Kansas lawmaker introduced <a href=\"https:\/\/www.marijuanamoment.net\/20-year-old-kansas-lawmaker-files-drug-decriminalization-bill\/\" target=\"_blank\" rel=\"noopener\">a bill to broadly decriminalize drug possession<\/a> in the state.<\/p>\n<p>Both Labranche and Kansas Rep. [Addiction is]\u00a0a public health issue, it should not be a criminal justice issue.\u201d<\/p>\n<p>SpaceX founder Elon Musk also recently discussed the shifting political dynamics of psychedelics and predicted that, as younger generations assume positions of power in government, there will be a <a href=\"https:\/\/www.marijuanamoment.net\/elon-musk-says-people-should-be-open-to-psychedelics-and-predicts-the-next-generation-of-politicians-will-normalize-the-substances\/\" target=\"_blank\" rel=\"noopener\">greater societal embrace of the therapeutic potential<\/a> of such substances.<\/p>\n<p>Labranche told Marijuana Moment that he was \u201cespecially pleased\u201d to see Oregon voters approve a <a href=\"https:\/\/www.marijuanamoment.net\/oregon-voters-approve-ballot-measure-to-decriminalize-all-drugs-and-fund-treatment-services\/\" target=\"_blank\" rel=\"noopener\">2020 ballot initiative to decriminalize drug possession<\/a>. He said that\u2019s \u201cthe aim of what I would like New Hampshire to be like one day.\u201d<\/p>\n<p>The representative recognized, however, that his state has a ways to go before it could become a leader in drug policy reform. He said that marijuana legalization alone represents a steep tasks and, \u201cI don\u2019t see it happening in the near future due to the current political climate.\u201d However, \u201cincremental steps are the right way to go.\u201d<\/p>\n<p>The New Hampshire Supreme Court ruled last year that a man convicted of possession of psilocybin mushrooms was wrongfully tried because <a href=\"https:\/\/www.marijuanamoment.net\/new-hampshire-supreme-court-upholds-religious-freedom-to-use-psychedelic-mushrooms\/\" target=\"_blank\" rel=\"noopener\">his use of the psychedelic was part of his religious practices<\/a>.<\/p>\n<p>The text of Labranche\u2019s proposed reforms is not yet available, but he has <a href=\"http:\/\/www.gencourt.state.nh.us\/lsr_search\/Default.aspx\" target=\"_blank\" rel=\"noopener\">filed<\/a> requests with the Office of Legislative Services to have the measures prepared for introduction for the 2022 session.<\/p>\n<div class=\"fb-post\" data-href=\"https:\/\/www.facebook.com\/permalink.php?story_fbid=4223966354387726&amp;id=862840737166988\" data-width=\"552\" \/>\n<p>Another lawmaker, Rep. Stacie-Marie Laughton (D), also requested to have a bill drafted with the goal of \u201crepealing the prohibitions on the possession of controlled drugs and increasing funding for substance abuse services.\u201d<\/p>\n<p>In the meantime, New Hampshire lawmakers have put forward a new strategy to legalize cannabis in the state that involves placing a proposed constitutional amendment <a href=\"https:\/\/www.marijuanamoment.net\/new-hampshire-lawmakers-take-first-step-to-put-marijuana-legalization-on-2022-ballot\/\" target=\"_blank\" rel=\"noopener\">on the ballot for voters to decide on in 2022<\/a>.<\/p>\n<p>Standalone legalization legislation that\u2019s been retained from this year is also set to be taken up when lawmakers reconvene early in 2022, and advocates are hopeful that it will advance based on prior votes in the House. The chamber <a href=\"https:\/\/www.marijuanamoment.net\/new-hampshire-house-approves-marijuana-legalization-bill\/\" target=\"_blank\" rel=\"noopener\">passed a legalization bill last year<\/a>, but it died in a Senate committee.<\/p>\n<p>Gov. Chris Sununu (R) remains opposed to adult-use legalization, but advocates are encouraged that he recently signed a bill <a href=\"https:\/\/www.marijuanamoment.net\/new-hampshire-governor-signs-bill-allowing-medical-marijuana-to-treat-opioid-use-disorder-and-letting-out-of-state-patients-shop\/\" target=\"_blank\" rel=\"noopener\">adding opioid use disorder as a qualifying condition<\/a>\u00a0for the state\u2019s medical cannabis program and also allows out-of-state patients to access dispensaries.<\/p>\n<p>In 2017, the governor signed\u00a0<a href=\"https:\/\/www.marijuanamoment.net\/new-hampshire-marijuana-decriminalization-takes-effect\/\" target=\"_blank\" rel=\"noopener\">a bill decriminalizing marijuana possession<\/a> in the Granite State, though he continues to argue against adding a legal commercial cannabis sales component.<\/p>\n<p>Separately, a New Hampshire Senate committee in March heard testimony on a House-passed bill to allow medical marijuana patients to\u00a0<a href=\"https:\/\/www.marijuanamoment.net\/new-hampshires-medical-marijuana-dispensaries-now-support-letting-patients-grow-their-own\/\" target=\"_blank\" rel=\"noopener\">grow a limited number of plants for personal use<\/a>.
