The top Democrat in the Florida Senate filed a bill on Friday that would require the state to research the medical benefits of psychedelics such as psilocybin and MDMA.<\/p>\n
If enacted, the state Department of Health would be directed to \u201cconduct a study evaluating the therapeutic efficacy of alternative therapies\u201d such as those substances, as well as ketamine, \u201cin treating mental health and other medical conditions,\u201d including depression, anxiety, post-traumatic stress disorder (PTSD), bipolar disorder, chronic pain and migraines.<\/p>\n
The proposal, sponsored by Senate Minority Leader Lauren Book (D) is modeled on legislation enacted into law in Texas earlier this year<\/a> that similarly instructs officials in that state to research the therapeutic value of certain psychedelics, although that bill had a narrower focus on helping military veterans with PTSD.<\/p>\n A companion version of the Florida measure is being carried in the House by Rep. Michael Grieco (D).<\/p>\n \u201cThis is one of the rare times it would be ok to Texas our Florida, since the Lone Star State is one of many who embrace the FDA\u2019s breakthrough designation for alternate mental health therapies such as psilocybin,\u201d Grieco told Marijuana Moment. \u201cThis bill will send our state in the right direction, especially amongst our veterans, for patients who are resistant to traditional mental health therapies.\u201d<\/p>\n Proud to work with @Mike_Grieco<\/a> on this important piece of legislation; that will help individuals living with PTSD have a natural pathway to wellness. https:\/\/t.co\/kqbocsF2Od<\/a><\/p>\n \u2014 Lauren Book (@LeaderBookFL) September 25, 2021<\/a><\/p>\n<\/blockquote>\n\n Book said in a press release that the legislation \u201cprovides a natural pathway to wellness for patients with debilitating post-traumatic stress disorder and treatment-resistant depression.\u201d<\/p>\n \u201cPsilocybin treatment is a safe alternative for those who have exhausted all other avenues for mental health and wellbeing, and I am proud to sponsor legislation to ensure Floridians have medical access to this life-saving natural treatment,\u201d she said.<\/p>\n Grieco added in the release that \u201cFlorida does not have to be the last state to catch up with science every time.\u201d<\/p>\n \u201cBetween medical marijuana and climate change, our state seems to never miss an opportunity to miss an opportunity,\u201d he said. \u201cThe science regarding psilocybin is real, cannot be ignored, and soon will be a universally-accepted form of treatment in the U.S. Veterans and veterans organizations should be watching closely on behalf of folks suffering from addiction, PTSD and depression.\u201d<\/p>\n \u2014 The governor of Connecticut signed a bill in June that includes language requiring the state to carry out a study into the therapeutic potential of psilocybin mushrooms<\/a>.<\/p>\n Under the Florida legislation\u2014SB 348<\/a> and HB 193<\/a>\u2014officials would have to submit a report and recommendations to the governor and top lawmakers by September 1, 2023.<\/p>\n Earlier this year, Grieco filed a more far-reaching bill that would have created a broader program of legal access to psilocybin for therapeutic use<\/a>, similar to the ballot measure approved by Oregon voters<\/a> last year. That legislation failed to advance through committee, however.<\/p>\n \u201cAfter authoring a very ambitious 59-page bill last year, one that started a broader conversation,\u201d Grieco said, \u201cI am ready to work with both my Republican and Democratic colleagues to create a framework designed to help those patients who need it.\u201d<\/p>\n Last week, Florida activists filed a marijuana legalization initiative<\/a> they hope to place on the 2022 ballot. The move comes after the state Supreme Court invalidated two prior measures<\/a> the justices deemed to be \u201cmisleading.\u201d<\/p>\n Meanwhile, Florida isn\u2019t the only state where psychedelics policy moves are being made.<\/p>\n Jurisdictions across the country are increasingly removing or reducing penalties around drug possession and consumption, especially when it comes to psychedelics. Since Denver in 2019 became the first U.S. city to decriminalize psilocybin mushrooms, a number of states and municipalities have made similar changes to dismantle the drug war.<\/p>\n Oregon voters passed a pair of initiatives last November to\u00a0legalize psilocybin therapy<\/a>\u00a0and\u00a0decriminalize possession of all drugs<\/a>. On the local level, activists in\u00a0Portland are mounting\u00a0a push to have local lawmakers pass a resolution<\/a>\u00a0decriminalizing the cultivation, gifting and ceremonial use of a wide range of psychedelics.<\/p>\n Washington, D.C. voters also approved a ballot measure last year to\u00a0deprioritize enforcement of laws criminalizing psychedelics<\/a>.<\/p>\n In California this month, activists were cleared to begin collecting signatures for a historic initiative to legalize psilocybin mushrooms<\/a> in the state. Oakland<\/a>\u00a0and\u00a0Santa Cruz<\/a>\u00a0have already enacted psychedelics decriminalization.<\/p>\n Detroit currently stands to become one of the next major cities to decriminalize psychedelics, with the reform proposal making the local ballot for this November<\/a>.<\/p>\n Elsewhere in Michigan, the Ann Arbor City Council has already elected to make enforcement of laws prohibition psychedelics like psilocybin, ayahuasca and DMT\u00a0among the city\u2019s lowest priorities<\/a>\u2014and lawmakers recently followed up by declaring September\u00a0Entheogenic Plants and Fungi Awareness Month<\/a>. Advocates have also introduced a reform resolution to the Grand Rapids City Council.<\/p>\n Massachusetts cities that have enacted the policy change include\u00a0Northampton<\/a>,\u00a0Somerville<\/a>\u00a0and\u00a0Cambridge<\/a>. In July, state lawmakers heard testimony about a bill to create a task force charged with\u00a0studying the implications of legalizing psychedelics like psilocybin and ayahuasca<\/a>.<\/p>\n In Seattle, the City Council is considering a resolution to decriminalize psychedelics<\/a>.<\/p>\n A New York lawmaker introduced a bill in June that would require the state to establish an institute to similarly\u00a0research the medical value of psychedelics<\/a>.<\/p>\n The Maine House of Representatives\u00a0passed a drug decriminalization bill<\/a>\u00a0this year, but it later\u00a0died in the Senate<\/a>.<\/p>\n In Oakland, the first city where a city council voted to broadly deprioritize criminalization of entheogenic substances, lawmakers\u00a0approved a follow-up resolution<\/a>\u00a0in December that calls for the policy change to be adopted statewide and for local jurisdictions to be allowed to permit healing ceremonies where people could use psychedelics.<\/p>\n Meanwhile, Denver activists who successfully led the 2019 campaign to make the city\u00a0the first in the U.S. to decriminalize psilocybin possession<\/a>\u00a0have set their eyes on broader reform<\/a>, with plans in the works to end the criminalization of noncommercial gifting and communal use of the psychedelic.<\/p>\n In a setback for advocates, the U.S. House of Representatives recently voted against a proposal from Rep. Alexandria Ocasio-Cortez (D-NY) that\u00a0would have removed a spending bill rider<\/a>\u00a0that advocates say has restricted federal funds for research into Schedule I drugs, including psychedelics such as psilocybin, MDMA and ibogaine. However, it picked up considerably more votes this round than\u00a0when the congresswoman first introduced it<\/a>\u00a0in 2019.<\/p>\n Report provisions of separate, House-passed spending legislation also touch on the need to\u00a0expand cannabis and psychedelics research<\/a>. The panel urged NIDA to support expanded marijuana studies, for example.
