{"id":50137,"date":"2021-09-24T06:54:46","date_gmt":"2021-09-24T14:54:46","guid":{"rendered":"https:\/\/cannabiscultivatornews.com\/home\/index.php\/2021\/09\/24\/most-kansas-city-government-workers-will-no-longer-face-pre-employment-marijuana-tests-following-city-council-vote\/"},"modified":"2021-09-24T13:47:12","modified_gmt":"2021-09-24T21:47:12","slug":"most-kansas-city-government-workers-will-no-longer-face-pre-employment-marijuana-tests-following-city-council-vote","status":"publish","type":"post","link":"https:\/\/cannabiscultivatornews.com\/home\/index.php\/2021\/09\/24\/most-kansas-city-government-workers-will-no-longer-face-pre-employment-marijuana-tests-following-city-council-vote\/","title":{"rendered":"Most Kansas City Government Workers Will No Longer Face Pre-Employment Marijuana Tests Following City Council Vote"},"content":{"rendered":"<\/p>\n<p>Most government workers in Kansas City, Missouri will no longer face pre-employment drug tests for marijuana under an ordinance that the City Council approved on Thursday.<\/p>\n<p>The measure, which was <a href=\"https:\/\/www.marijuanamoment.net\/kansas-city-mayor-files-ordinance-to-ban-pre-employment-marijuana-testing-for-most-city-workers\/\" target=\"_blank\" rel=\"noopener\">introduced by Mayor Quinton Lucas (D)<\/a> in July, was passed by local lawmakers in an 11-2 vote.<\/p>\n<p>\u201cIt shall be unlawful for the City of Kansas City to require a prospective employee to submit to testing for the presence of marijuana in the prospective employee\u2019s system as a condition of employment,\u201d the text of the ordinance states.<\/p>\n<p>Lucas, who last year filed a since-enacted measure to\u00a0<a href=\"https:\/\/www.marijuanamoment.net\/kansas-city-lawmakers-vote-to-remove-all-local-penalties-for-marijuana-possession\/\" target=\"_blank\" rel=\"noopener noreferrer\">remove all local criminal penalties for cannabis possession<\/a>, celebrated the latest development.<\/p>\n<blockquote class=\"twitter-tweet\" data-width=\"550\" data-dnt=\"true\">\n<p lang=\"en\" dir=\"ltr\">Opportunities should not be foreclosed unnecessarily. <\/p>\n<p>Glad to see passage of our law eliminating pre-employment screening for marijuana at Kansas City government for most positions. <\/p>\n<p>One step of many in becoming a fairer city.<\/p>\n<p>\u2014 Mayor Q (@QuintonLucasKC) <a href=\"https:\/\/twitter.com\/QuintonLucasKC\/status\/1441154877019889666?ref_src=twsrc%5Etfw\" target=\"_blank\" rel=\"nofollow noopener\">September 23, 2021<\/a><\/p>\n<\/blockquote>\n<p \/>\n<p>\u201cOpportunities should not be foreclosed unnecessarily. Glad to see passage of our law eliminating pre-employment screening for marijuana at Kansas City government for most positions,\u201d he said. \u201cOne step of many in becoming a fairer city.\u201d<\/p>\n<p>There are some <a href=\"https:\/\/clerk.kcmo.gov\/LegislationDetail.aspx?ID=5068394&amp;GUID=9AFEEC88-F6E2-4EE0-9614-A5C53FA02000\" target=\"_blank\" rel=\"noopener\">exceptions<\/a> to the policy change. Law enforcement, workers who require a commercial driver\u2019s license and those who are involved in the supervision of \u201cchildren, medical patients, disabled or other vulnerable individuals\u201d can still be screened for cannabis.<\/p>\n<p>Last year, the mayor announced a pardon program for those with previous convictions for possession of marijuana or paraphernalia.<\/p>\n<p>Drug testing for cannabis has become a hot topic of late since the Olympics\u00a0<a href=\"https:\/\/www.marijuanamoment.net\/white-house-declines-to-defend-runner-suspended-from-olympics-over-marijuana-test-while-lawmakers-step-up\/\" target=\"_blank\" rel=\"noopener\">suspension of U.S. runner Sha\u2019Carri Richardson<\/a>, with more people arguing that use of the plant shouldn\u2019t lead to punishments, especially given the ongoing rise of the legalization movement. The World Anti-Doping Agency recent announced that it would <a href=\"https:\/\/www.marijuanamoment.net\/world-anti-doping-agency-reviews-marijuana-ban-for-athletes-following-pushback-after-richardson-suspension\/\" target=\"_blank\" rel=\"noopener\">review its marijuana policy for athletes next year<\/a>.<\/p>\n<p>The Biden administration has come under fire this year for terminating or otherwise punishing staffers who were honest about their past cannabis use as part of the background check process.<\/p>\n<p>White House Press Secretary Jen Psaki has said that nobody in the White House was\u00a0<a href=\"https:\/\/www.marijuanamoment.net\/white-house-says-biden-hasnt-fired-staff-for-marijuana-use-that-was-casual-or-years-ago\/\" target=\"_blank\" rel=\"noopener\">fired for \u201cmarijuana usage from years ago,\u201d<\/a>\u00a0nor has anyone been terminated \u201cdue to casual or infrequent use during the prior 12 months.\u201d However, she\u2019s consistently declined to speak to the extent to which staff have been suspended or placed in a remote work program because they were honest about their history with marijuana on a federal form that\u2019s part of the background check process.<\/p>\n<p>In June, a powerful congressional committee released a report that urges federal agencies to reconsider policies that result in the firing of employees <a href=\"https:\/\/www.marijuanamoment.net\/federal-agencies-should-reconsider-firing-workers-for-marijuana-congressional-committee-urges\/\" target=\"_blank\" rel=\"noopener\">who use marijuana legally in accordance with state law<\/a>.<\/p>\n<p>Separate standalone legislation has been previously introduced by Rep. Charlie Crist (D-FL) to\u00a0<a href=\"https:\/\/www.marijuanamoment.net\/bipartisan-bill-shields-federal-workers-from-being-fired-for-marijuana\/\" target=\"_blank\" rel=\"noopener\">provide protections for federal workers<\/a>\u00a0who consume cannabis in compliance with state law, but it never received a hearing or a vote and has not been refiled so far this Congress.<\/p>\n<p>As of last year, New York City employers are no longer able to\u00a0<a href=\"https:\/\/www.marijuanamoment.net\/new-york-city-ban-on-pre-employment-marijuana-testing-takes-effect-but-not-for-all-workers\/\" target=\"_blank\" rel=\"noopener\">require pre-employment drug testing for marijuana<\/a>\u00a0as a part of the hiring process\u2014though there are a series of exemptions to the policy.
