{"id":49819,"date":"2021-09-07T11:47:52","date_gmt":"2021-09-07T19:47:52","guid":{"rendered":"https:\/\/cannabiscultivatornews.com\/home\/index.php\/2021\/09\/07\/new-ruling-in-cbd-trademarking-case-highlights-challenges-of-fdas-rulemaking-delays\/"},"modified":"2021-09-07T13:45:47","modified_gmt":"2021-09-07T21:45:47","slug":"new-ruling-in-cbd-trademarking-case-highlights-challenges-of-fdas-rulemaking-delays","status":"publish","type":"post","link":"https:\/\/cannabiscultivatornews.com\/home\/index.php\/2021\/09\/07\/new-ruling-in-cbd-trademarking-case-highlights-challenges-of-fdas-rulemaking-delays\/","title":{"rendered":"New Ruling In CBD Trademarking Case Highlights Challenges Of FDA\u2019s Rulemaking Delays"},"content":{"rendered":"<\/p>\n<p>A new ruling in a federal trademarking case for a CBD bevegage company underscores how the Food and Drug Administration\u2019s (FDA) slow-walking of rules for certain hemp-derived products is creating headaches for the burgeoning industry.<\/p>\n<p>A company that sells CBD-infused teas submitted an \u201cintent to use\u201d trademark application <a href=\"https:\/\/www.marijuanamoment.net\/cbd-companys-appeal-could-let-marijuana-and-psychedelics-companies-trademark-businesses-pre-legalization\/\" target=\"_blank\" rel=\"noopener\">but was denied by the U.S. Patent and Trademark Office (USPTO)<\/a> in May\u2014and that decision was reaffirmed by an appeals board last week.<\/p>\n<p>While hemp-derived cannabidiol was legalized under the 2018 Farm Bill, the Trademark Trial and Appeal Board (TTAB) said it remains illicit to sell as a beverage under the Food, Drug, and Cosmetic Act because FDA still hasn\u2019t issued rules allowing it, and, therefore, the application couldn\u2019t be granted.<\/p>\n<p>Petitioners attempted to make the <a href=\"https:\/\/ttabvue.uspto.gov\/ttabvue\/v?pno=88640009&amp;pty=EXA&amp;eno=15\" target=\"_blank\" rel=\"noopener\">case<\/a> that Joy Tea has bona fide intent to use in lawful commerce because a federal policy change is forthcoming. FDA has said repeatedly that it is working to develop regulations to allow CBD in the food supply\u2014but the TTAB didn\u2019t accept that as sufficient evidence.<\/p>\n<p>Larry Sandell, an\u00a0<a href=\"https:\/\/www.marijuanamoment.net\/what-cannabis-entrepreneurs-need-to-know-about-intellectual-property\/\" target=\"_blank\" rel=\"noopener\">intellectual property attorney at Mei &amp; Mark LLP<\/a> who is representing Joy Tea, told Marijuana Moment that the decision ignores the fact that pharmaceutical companies are regularly afforded the benefit of the doubt and are able to trademark drugs in development that haven\u2019t been formally permitted by regulatory bodies.<\/p>\n<p>\u201cWe\u2019re not seeking registration. All we\u2019re saying is we intend to use it in legal commerce in the future,\u201d he said. \u201cThat intention to have future legal commerce is grounded in a belief that it will be legal in the near future.\u201d<\/p>\n<p>There\u2019s good reason to anticipate that policy change, especially within the three-year window that \u201cintent to use\u201d approvals are contingent upon. Not only has FDA itself said it is exploring regulatory pathways to allow for such CBD commerce, <a href=\"https:\/\/www.marijuanamoment.net\/hemp-and-cbd-could-be-marketed-as-dietary-supplements-under-bipartisan-congressional-bill\/\" target=\"_blank\" rel=\"noopener\">but bipartisan lawmakers have<\/a> <a href=\"https:\/\/www.marijuanamoment.net\/senate-bill-would-allow-cbd-infused-foods-drinks-and-dietary-supplements\/\" target=\"_blank\" rel=\"noopener\">introduced legislation this session to force a change<\/a>.<\/p>\n<p>FDA was mandated under appropriations legislation enacted in 2019 to <a href=\"https:\/\/www.marijuanamoment.net\/congress-attaches-marijuana-hemp-and-cbd-provisions-to-federal-spending-bills\/\" target=\"_blank\" rel=\"noopener noreferrer\">provide an update on its regulatory approach to CBD<\/a>, and it did so in March of last year. The update stated that \u201cFDA is currently evaluating issuance of a risk-based enforcement policy that would provide greater transparency and clarity regarding factors FDA intends to take into account in prioritizing enforcement decisions.\u201d<\/p>\n<p>In any case, the trademark appeals board said that the \u201cissue in this appeal is narrow and simple: whether an applicant for a federal trademark registration can have a bona fide intent to use its mark in commerce on goods that are currently prohibited under federal law but that may, perhaps, become lawful in the future.\u201d<\/p>\n<p>\u201cIn the present situation, where some of Applicant\u2019s goods are prohibited under federal law, the record clearly indicates that it is not possible for Applicant to have \u2018an intention to use the mark consistent with the [Trademark] Act\u2019s definition of use in commerce\u2019 which requires \u2018the bona fide use of a mark in the ordinary course of trade.&#8217;\u201d<\/p>\n<p>Petitioners pointed out the seeming double-standard for traditional pharmaceutical companies that apply for \u201cintent to use\u201d trademarks for non-FDA-approved drugs.
