Chuck Grassley (R-IA) in July, thanking him for sponsoring bipartisan legislation meant to <a href=\"https:\/\/www.marijuanamoment.net\/bipartisan-marijuana-research-bill-reintroduced-in-the-senate\/\" target=\"_blank\" rel=\"noopener\">promote research into marijuana<\/a> and noting that DEA has so far denied statutory exemptions for state cannabis laws despite having made an exception for peyote when used in religious ceremonies of the Native American Church.<\/p>\n<p>\u201cIowa needs an exemption for cannabis just like the one the DEA currently maintains for peyote,\u201d the activist wrote to the senator.<\/p>\n<p>Earlier this month, Grassley\u2019s office sent a response. While most of the August 6 letter focuses on the senator\u2019s marijuana research bill\u2014which he said would \u201cfacilitate future legitimate medical research that can be done on CBD and marijuana that could lead to safe and effective drugs for patients\u201d\u2014he also addressed the exemption issue.<\/p>\n<p>\u201cI will also follow-up with the DEA on your point about an exemption for marijuana under 21 C.F.R. \u00a7 1307.03 and seek further clarification for you,\u201d wrote Grassley, who serves as ranking member of the Senate Judiciary Committee and is a former chairman of the panel.<\/p>\n<p>Because of his experience in Judiciary and as co-chair of the Senate Caucus On International Narcotics Control, Grassley is \u201cthe guy that I would want to follow up on this,\u201d Olsen told Marijuana Moment. \u201cHe has the mental capacity to figure it out.\u201d<\/p>\n<p>In the letter to Grassley, who has long opposed recreational marijuana legalization, Olsen also flagged a recent statement from conservative U.S. Supreme Court Justice Clarence Thomas, who denounced the <a href=\"https:\/\/www.marijuanamoment.net\/supreme-court-justice-clarence-thomas-slams-feds-marijuana-stance-as-contradictory-and-unstable\/\" target=\"_blank\" rel=\"noopener\">federal government\u2019s inconsistent approach to cannabis policy<\/a> and suggested that outright national prohibition may be unconstitutional.<\/p>\n<p>Olsen has led the charge to seek the exemption for Iowa\u2019s limited medical cannabis law, even after DEA <a href=\"https:\/\/www.marijuanamoment.net\/dea-denies-request-to-protect-iowa-medical-marijuana-program-but-state-still-considering-action\/\" target=\"_blank\" rel=\"noopener\">rejected a request he submitted<\/a> last year. But his advocacy has also prompted Iowa regulators to similarly pursue a federal carve-out for the state program. It hasn\u2019t been a simple process, however.<\/p>\n<p>Last year, the legislature approved a bill that requires the state to seek the protections for its medical cannabis program from DEA. After months of inaction, Olsen <a href=\"https:\/\/www.marijuanamoment.net\/iowa-governor-sued-over-delay-in-asking-for-federal-medical-marijuana-exemption-from-dea\/\" target=\"_blank\" rel=\"noopener\">filed suit against the governor<\/a>, alleging that she failed to ensure that the law was effectively carried out because the Department of Public Health had unnecessarily delayed the mandated request.<\/p>\n<p>Weeks after the lawsuit was filed, the state department sent letters to DEA, the Food and Drug Administration, the Centers for Medicare and Medicaid Services and the Department of Education <a href=\"https:\/\/www.marijuanamoment.net\/iowa-asks-dea-to-guarantee-protections-for-medical-marijuana-program-after-facing-activist-lawsuit\/\" target=\"_blank\" rel=\"noopener\">seeking a policy carve-out for Iowa\u2019s limited medical cannabis market<\/a>.<\/p>\n<p>In the letters, the department simply quoted the statute of the law and said it \u201crespectfully requests the guarantee as directed by the Iowa General Assembly.\u201d After being informed via a court filing that the department had made good on its obligation, Olsen agreed that his lawsuit was no longer relevant.<\/p>\n<p>Regulators\u00a0<a href=\"https:\/\/www.marijuanamoment.net\/iowa-officials-to-seek-federal-marijuana-exemption-from-dea\/\" target=\"_blank\" rel=\"noopener\">said in a report last year that the department<\/a>\u00a0would \u201cmove forward with seeking an exception for cannabis as a schedule I substance in Iowa from the DEA, in attempt to minimize conflict between State and Federal Law.\u201d<\/p>\n<p>DEA regulations stipulate that the agency\u2019s administrator \u201cmay grant an exemption in his discretion, but in no case shall he\/she be required to grant an exception to any person which is otherwise required by law or the regulations.\u201d<\/p>\n<p>Olsen\u2019s hope is that Grassley\u2019s response letter could help motivate state regulators to personally push Iowa\u2019s congressional delegation to take the exemption more seriously and reach out to DEA to protect medical cannabis patients in the state.<\/p>\n<p>He plans to raise the issue\u2014and showcase the senator\u2019s letter\u2014at a meeting of the state Medical Cannabidiol Board on Friday.
