{"id":49323,"date":"2021-08-09T10:33:44","date_gmt":"2021-08-09T18:33:44","guid":{"rendered":"https:\/\/cannabiscultivatornews.com\/home\/index.php\/2021\/08\/09\/hemp-memo-from-u-s-financial-regulator-raises-financing-concerns-within-industry\/"},"modified":"2021-08-09T13:45:22","modified_gmt":"2021-08-09T21:45:22","slug":"hemp-memo-from-u-s-financial-regulator-raises-financing-concerns-within-industry","status":"publish","type":"post","link":"https:\/\/cannabiscultivatornews.com\/home\/index.php\/2021\/08\/09\/hemp-memo-from-u-s-financial-regulator-raises-financing-concerns-within-industry\/","title":{"rendered":"Hemp Memo From U.S. Financial Regulator Raises Financing Concerns Within Industry"},"content":{"rendered":"<\/p>\n<p>A recent advisory memo from a federal financial regulatory agency is causing a stir among some legal hemp companies, who say they\u2019re concerned the advice will make it more difficult to obtain business loans to expand and stay competitive in the growing national market.<\/p>\n<p>The Farm Credit Administration (FCA) issued the informational memo on July 12, addressing financial institutions that are considering whether to extend credit to hemp producers and processors. In it, Kevin Kramp, the director of the agency\u2019s Office of Regulatory Policy, outlined a number of issues lenders should examine when weighing financing decisions.<\/p>\n<p>Of particular note to many currently operating companies, Kramp implied that lenders not make loans to hemp growers unless they\u2019re enrolled in a state system that\u2019s been approved by the U.S. Department of Agriculture (USDA). Under the 2018 Farm Bill, which federally legalized hemp\u2014a category of cannabis containing a concentration of less than 0.3 percent THC\u2014states are required to submit their regulatory plans to USDA for approval.<\/p>\n<p>\u201cIf your institution decides to proceed with financing hemp, you should consider collecting, analyzing, and documenting the following information from each applicant,\u201d the memo advises. First on the list is a \u201ccopy of the USDA-approved plan issued by the state or tribe.\u201d<\/p>\n<p>While many states and federally recognized tribes have since submitted those plans, 20 states are still operating under an earlier provision: a hemp pilot program created by the 2014 Farm Bill. That program, which is still valid and would be <a href=\"https:\/\/www.marijuanamoment.net\/senate-committee-urges-rethink-of-hemp-thc-limit-and-pushes-cbd-regulations\/\" target=\"_blank\" rel=\"noopener\">further extended under pending legislation that has passed the House and is pending in the Senate<\/a>, requires less federal oversight than the new USDA-approved programs.<\/p>\n<p>The <a href=\"https:\/\/ww3.fca.gov\/readingrm\/infomemo\/Lists\/InformationMemorandums\/Attachments\/282\/FinancingHempInfoMemoJuly2021.pdf\" target=\"_blank\" rel=\"noopener\">FCA memo<\/a> mentions the pilot program only in passing, as part of its background section. It\u2019s written in past-tense and does not explain how a hemp producer\u2019s participation in a pilot program might figure into a lender\u2019s decision.<\/p>\n<p>That\u2019s what has hemp companies concerned. According to Agri-Pulse, an agricultural trade publication that <a href=\"https:\/\/www.agri-pulse.com\/articles\/16276-farm-credit-usda-actions-on-lending-have-hemp-industry-concerned\" target=\"_blank\" rel=\"noopener\">first reported<\/a> the industry\u2019s response to the new memo, the National Industry Hemp Council (NIHC) says the guidance will limit access to capital for many businesses operating legally. The industry group is also worried about a USDA Rural Development grant that is similarly limited to hemp growers in states with USDA-approved plans.<\/p>\n<p>Rick Fox, co-chair for NIHC\u2019s Government Affairs Committee, told Agri-Pulse that the memo \u201cwill likely deter lenders from financing any such hemp producers out of perceived risk\u201d despite an apparent lack of statutory basis for that guidance.<\/p>\n<p>FCA, for its part, said that its guidance was simply advice and \u201cdefinitely not an absolute.\u201d<\/p>\n<p>\u201cWhat we tried to convey in this memo was that if you as an institution are going to finance hemp, these are things you should consider,\u201d said Lori Markowitz, a senior policy analyst at FCA. Markowitz told Agri-Pulse that NIHC should contact FCA to discuss the concern.<\/p>\n<p>It\u2019s not clear the degree to which the memo might actually chill lending to hemp companies still operating under pilot programs. A spokesperson for the Farm Credit Council, a trade association representing farm lenders, said it had contacted some members who told the agency that the memo hadn\u2019t yet raised any concerns.<\/p>\n<p>Federal hemp-related regulations have caused tension during the years since Congress legalized the crop. USDA announced in 2019 that it was <a href=\"https:\/\/www.marijuanamoment.net\/usda-says-hemp-farmers-now-qualify-for-federal-crop-insurance\/\" target=\"_blank\" rel=\"noopener\">developing regulations to offer direct and guaranteed loans<\/a> to the industry, guidelines it <a href=\"https:\/\/www.marijuanamoment.net\/usda-unveils-guidelines-for-federal-loans-to-hemp-business\/\" target=\"_blank\" rel=\"noopener\">unveiled in April 2020<\/a>. Six months later, it issued a new notice to stakeholders about the policy change\u2014then\u00a0<a href=\"https:\/\/www.marijuanamoment.net\/usda-releases-then-rescinds-hemp-loan-notice-following-congressional-action\/\" target=\"_blank\" rel=\"noopener\">abruptly rescinded that notice<\/a>.<\/p>\n<p>As with the current kerfuffle, that misunderstanding was related to the 2014 hemp pilot programs. USDA said its guidance \u201cwas developed with the understanding that operators would no longer be authorized to produce hemp under the 2014 Farm Bill Pilot Program,\u201d even though the pilot program had <a href=\"https:\/\/www.marijuanamoment.net\/hemp-advocates-secure-major-win-in-new-house-government-funding-measure\/\" target=\"_blank\" rel=\"noopener\">already been renewed by Congress<\/a>.<\/p>\n<p>Last week, the Senate Appropriations Committee <a href=\"https:\/\/www.marijuanamoment.net\/senate-committee-urges-rethink-of-hemp-thc-limit-and-pushes-cbd-regulations\/\" target=\"_blank\" rel=\"noopener\">approved report language attached to a spending bill<\/a> noting the \u201cgrowing interest for U.S. hemp and hemp-based products for a variety of uses\u201d and directing FCA \u201cto work with the institutions under its jurisdiction to provide access to guaranteed loans for hemp producers and businesses.\u201d<\/p>\n<p>These are just some of the latest developments in federal hemp policy since the crop was broadly legalized.<\/p>\n<p>Last month, USDA requested permission to learn more about the hemp industry, asking the White House for <a href=\"https:\/\/www.marijuanamoment.net\/usda-seeks-white-house-permission-for-national-hemp-survey\/\" target=\"_blank\" rel=\"noopener\">approval to survey about 20,000 farmers<\/a> to collect data on hemp production.<\/p>\n<p>The survey description is broad, and it\u2019s unclear what specific information USDA would be requesting. But the title, \u201dHemp Acreage and Production Survey,\u201d indicates that it would help both quantify and qualify current hemp cultivation overseen by the department.\u00a0Hemp businesses, including farms, would be involved in the survey, the notice said. Public comments are due by Aug. 16.<\/p>\n<p>There\u2019s still much to learn about the burgeoning market, even as USDA <a href=\"https:\/\/www.marijuanamoment.net\/usda-approves-hemp-regulatory-plans-from-rhode-island-and-another-indian-tribe\/\" target=\"_blank\" rel=\"noopener\">continues to approve state regulatory plans<\/a> for the crop.
