Jeff Merkley (D-OR), passed in the Senate Appropriations Committee on a voice vote. It would further prohibit VA from interfering with, or denying services to, veterans who participate in a state-legal medical cannabis program<\/p>\n<p>\u201cWe have now 36 states that have medical cannabis, and our veterans want to know from their VA doctor what their thoughts are on the pros and cons or appropriate role or challenges of this particular strategy for treating a variety of issues, including PTSD,\u201d Merkley said. \u201cI think it\u2019s really important that we not force our veterans to be unable to discuss this issue with their doctors.\u201d<\/p>\n<p><strong>Watch the senator discuss his amendment, starting 1:38:50 into the video below:\u00a0<\/strong><\/p>\n<p \/>\n<p><strong>Here\u2019s the text of the amendment, which is now part of a bill to fund the VA for Fiscal Year 2022:\u00a0<\/strong><\/p>\n<p style=\"padding-left: 40px\">SEC. ___ None of the funds appropriated or otherwise made available to the Department of Veterans Affairs in this Act may be used in a manner that would\u2014<\/p>\n<p style=\"padding-left: 40px\">(1) interfere with the ability of a veteran to participate in a medicinal marijuana program approved by a State;<\/p>\n<p style=\"padding-left: 40px\">(2) deny any services from the Department to a veteran who is participating in such a program;<\/p>\n<p style=\"padding-left: 40px\">or (3) limit or interfere with the ability of a health care provider of the Department to make appropriate recommendations, fill out forms, or take steps to comply with such a program.<\/p>\n<p>The senator <a href=\"https:\/\/www.marijuanamoment.net\/senators-approve-medical-marijuana-for-military-veterans\/\" target=\"_blank\" rel=\"noopener\">introduced a similar proposal in 2018<\/a> that also cleared the Appropriations Committee.<\/p>\n<p>The House on several occasions has approved legislation to allow VA doctors to issue medical marijuana recommendations to their patients, but it has never been enacted into law. Conor Lamb (D-PA) and Peter Meijer (R-MI) filed a bill\u2014titled the Fully Informed Veteran Act\u2014in May that would simply allow VA doctors to <a href=\"https:\/\/www.marijuanamoment.net\/military-veterans-could-discuss-state-marijuana-programs-with-va-doctors-under-new-bipartisan-congressional-bill\/\" target=\"_blank\" rel=\"noopener\">provide basic information and resources<\/a> about state-legal cannabis programs to veterans.<\/p>\n<p>A pair of Republican lawmakers introduced a congressional bill in April that\u2019s meant to\u00a0<a href=\"https:\/\/www.marijuanamoment.net\/gop-lawmakers-file-another-marijuana-research-bill-for-military-veterans\/\" target=\"_blank\" rel=\"noopener\">promote research into the medical potential of marijuana<\/a> for veterans.<\/p>\n<p>That was filed one day after a bipartisan Senate bill was introduced\u2014and on the same day that House members filed companion legislation\u2014to require VA to\u00a0<a href=\"https:\/\/www.marijuanamoment.net\/va-would-have-to-study-medical-marijuanas-benefits-for-veterans-under-new-bipartisan-bill-in-congress\/\" target=\"_blank\" rel=\"noopener\">conduct clinical trials into marijuana<\/a>\u00a0for the treatment of post-traumatic stress disorder (PTSD) and chronic pain in the population.<\/p>\n<p>Last year, the\u00a0<a href=\"https:\/\/www.marijuanamoment.net\/watch-live-first-congressional-marijuana-votes-of-2020\/\" target=\"_blank\" rel=\"noopener\">House Veterans\u2019 Affairs Committee approved a prior version of that bill<\/a>, as well as a separate proposal to allow VA doctors to issue medical cannabis recommendations to their patients in states where it\u2019s legal.<\/p>\n<p>Also in April, a bipartisan coalition of congressional lawmakers reintroduced legislation that would <a href=\"https:\/\/www.marijuanamoment.net\/bipartisan-bills-to-legalize-medical-marijuana-for-military-veterans-introduced-in-congress\/\" target=\"_blank\" rel=\"noopener\">federally legalize medical marijuana for military veterans<\/a>.<\/p>\n<p>A large-scale spending bill that passed the House last week includes report language that says federal health agencies should <a href=\"https:\/\/www.marijuanamoment.net\/congressional-lawmakers-push-for-psychedelics-research-for-veterans-in-new-report\/\" target=\"_blank\" rel=\"noopener\">pursue research into the therapeutic potential of psychedelics<\/a>\u00a0for military veterans suffering from a host of mental health conditions.<\/p>\n<p>It also acknowledges that VA has clarified that <a href=\"https:\/\/www.marijuanamoment.net\/veterans-working-in-marijuana-industry-arent-automatically-blocked-from-home-loans-va-says\/\" target=\"_blank\" rel=\"noopener\">veterans are eligible for home loan benefits<\/a> even if they work in a state-legal marijuana industry. However, it expresses disappointment that VA hasn\u2019t taken further action to communicate this policy to lenders and borrowers and directs the department to improve its communication and report back to Congress on its progress within 180 days of the enactment of the legislation<\/p>\n<p>Rep. Katherine Clark (D-MA) and other lawmakers have pressed VA on difficulties some veterans have faced in securing the benefit, with at least one constituent telling Clark that they were denied a home loan because of their work in the state-legal cannabis market. That\u00a0<a href=\"https:\/\/www.marijuanamoment.net\/lawmakers-press-va-on-home-loans-denials-to-veterans-working-in-marijuana-industry\/\" target=\"_blank\" rel=\"noopener noreferrer\">prompted the congresswoman to circulate a sign-on letter<\/a>\u00a0and introduce an amendment to resolve the problem.<\/p>\n<p>Clark\u2019s amendment to address the problem was\u00a0<a href=\"https:\/\/www.marijuanamoment.net\/congress-votes-to-allow-home-loans-for-veterans-working-in-marijuana-industry\/\" target=\"_blank\" rel=\"noopener noreferrer\">approved by the House as part of a previous defense spending bill<\/a>\u2014though leaders in the chamber\u00a0<a href=\"https:\/\/www.marijuanamoment.net\/house-democrats-cave-to-senate-on-two-marijuana-and-veterans-measures\/\" target=\"_blank\" rel=\"noopener noreferrer\">agreed to scrap it after the Senate didn\u2019t include it in its version of the legislation<\/a>.<\/p>\n<p>The report also notes \u201cprogress\u201d that VA has made when it comes to marijuana research. However, advocates have been critical of the agency in this respect.
