Jeff Merkley (D-OR) has again filed a bill to promote affordable housing in the U.S. that includes a provision preventing landlords from evicting people over manufacturing marijuana extracts if they have a license to do so.<\/p>\n<p>The language is identical to a section included in a version of the legislation the senator <a href=\"https:\/\/www.marijuanamoment.net\/senate-housing-bill-would-prevent-evictions-for-state-legal-marijuana-extraction\/\" target=\"_blank\" rel=\"noopener\">introduced last Congress that did not advance<\/a>.<\/p>\n<p>Under the measure, filed late last month, there\u2019s a list of \u201cjust causes for eviction\u201d such as failure to pay rent or causing significant damage to a property. The \u201cmanufacture of a cannabinoid extract\u201d is another cause for eviction, \u201cunless the tenant holds a license to manufacture the cannabinoid extract under Federal, State, or Tribal law.\u201d<\/p>\n<p>It should be noted, however, that the bill lacks any specific protections for other state-legal cannabis activities, including simple possession.<\/p>\n<p>Just above the manufacturing provision is language stating that \u201cthe unlawful manufacture, delivery, or possession of a controlled substance\u201d is grounds for eviction, though it contains no caveat exempting state-legal activity as cause for eviction.<\/p>\n<p>Despite the growing number of states moving to allow cannabis for medical or recreational use, it remains \u201cunlawful\u201d under the federal Controlled Substances Act.<\/p>\n<p><strong>\u2014<br \/>\n<strong>Marijuana Moment is already <a href=\"https:\/\/www.marijuanamoment.net\/bills\/\" target=\"_blank\" rel=\"noopener\">tracking more than 1,100 cannabis, psychedelics and drug policy bills<\/a> in state legislatures and Congress this year. <a href=\"https:\/\/www.patreon.com\/marijuanamoment\" target=\"_blank\" rel=\"noopener\">Patreon supporters<\/a> pledging at least $25\/month get access to our interactive maps, charts and hearing calendar so they don\u2019t miss any developments.<\/strong><br \/>\n<a href=\"https:\/\/www.marijuanamoment.net\/bills\/\" target=\"_blank\" rel=\"noopener\"><img loading=\"lazy\" class=\"alignnone wp-image-9128 size-medium\" src=\"https:\/\/cannabiscultivatornews.com\/home\/wp-content\/uploads\/2021\/07\/MM_Bill_Tracker_V5_blank-43.jpg\" alt=\"\" width=\"300\" height=\"300\" \/><\/a><br \/>\n<strong>Learn more about our <a href=\"https:\/\/www.marijuanamoment.net\/bills\/\" target=\"_blank\" rel=\"noopener\">marijuana bill tracker<\/a> and become a <a href=\"https:\/\/www.patreon.com\/marijuanamoment\/\" target=\"_blank\" rel=\"noopener\">supporter on Patreon<\/a> to get access.<br \/>\n\u2014<\/strong><\/strong><\/p>\n<p>While advocates would likely applaud the inclusion of state-legal protection language, it\u2019s also the case that eviction proceedings are handled at the state level, and so some courts would presumably defer to state law when it comes to cannabis-related eviction cases.<\/p>\n<p>Also, when it comes to the manufacturing provision, states generally do not provide licenses that would specifically allow individuals to produce marijuana extracts in their residences, so it\u2019s unclear how impactful that policy would be in practice if enacted into law.<\/p>\n<p>Of course, the cannabis provision is just one notable part of a comprehensive housing\u00a0<a href=\"https:\/\/www.congress.gov\/bill\/117th-congress\/senate-bill\/2234\/\" target=\"_blank\" rel=\"noopener\">bill<\/a>, which aims to \u201caddress the shortcomings of our current housing policies and funding levels by holistically addressing disparities and systematic obstacles and ensuring an equitable outcome for the most vulnerable Americans.\u201d<\/p>\n<p>Rep. Alexandria Ocasio-Cortez (D-NY) and Sen. Kamala Harris (D-CA) rolled out a different kind of housing reform bill in 2019 that would <a href=\"https:\/\/www.marijuanamoment.net\/aoc-and-kamala-harris-file-bill-protecting-drug-offenders-from-losing-public-housing\/\" target=\"_blank\" rel=\"noopener noreferrer\">protect people with low-level drug convictions<\/a>\u00a0from being denied access to or being evicted from public housing.<\/p>\n<p>More recently, Rep. Eleanor Holmes Norton (D-DC) sent a letter to the head of the Department of Housing and Urban Development (HUD) in May, imploring her to use \u201cexecutive discretion\u201d to <a href=\"https:\/\/www.marijuanamoment.net\/congresswoman-urges-hud-secretary-to-protect-marijuana-consumers-from-losing-public-housing\/\" target=\"_blank\" rel=\"noopener\">not enforce policies that prohibit cannabis use in federally assisted housing<\/a> in states that have enacted legalization.<\/p>\n<p>The congresswoman wrote to HUD Secretary Marcia Fudge two weeks after filing legislation that would\u00a0<a href=\"https:\/\/www.marijuanamoment.net\/congressional-bill-filed-to-protect-marijuana-consumers-from-losing-public-housing\/\" target=\"_blank\" rel=\"noopener\">legislatively accomplish the same objective<\/a>.<\/p>\n<p>Norton\u2019s bill would provide protections for people living in public housing or Section 8 housing from being displaced simply for using cannabis in states that have legalized it for medical or recreational purposes.<\/p>\n<p>The\u00a0legislation\u00a0would also require the HUD secretary to enact regulations that restrict smoking marijuana at these properties in the same way that tobacco is handled.<\/p>\n<p>Norton\u00a0<a href=\"https:\/\/www.marijuanamoment.net\/people-could-use-marijuana-in-public-housing-under-new-congressional-bill\/\" target=\"_blank\" rel=\"noopener\">filed earlier versions of<\/a>\u00a0<a href=\"https:\/\/www.marijuanamoment.net\/congressional-bill-would-allow-marijuana-use-in-public-housing\/\" target=\"_blank\" rel=\"noopener\">the Marijuana in Federally Assisted Housing Parity Act<\/a>\u00a0in 2018 and 2019, but they did not receive hearings or votes.<\/p>\n<p>In 2018, a Trump administration official said that she was working to resolve conflicting federal and state marijuana laws\u00a0<a href=\"https:\/\/www.marijuanamoment.net\/trump-official-wants-to-legally-permit-medical-marijuana-in-federally-subsidized-housing\/\" target=\"_blank\" rel=\"noopener\">as it applies to residency<\/a>\u00a0in federally-subsidized housing, but it\u2019s not clear what came of that effort.<\/p>\n<blockquote class=\"wp-embedded-content\" data-secret=\"Ntumvk7NnB\">\n<p><a href=\"https:\/\/www.marijuanamoment.net\/ohio-lawmakers-to-file-first-of-its-kind-marijuana-legalization-bill-as-activists-pursue-local-reforms\/\" target=\"_blank\" rel=\"nofollow noopener\">Ohio Lawmakers To File First-Of-Its-Kind Marijuana Legalization Bill As Activists Pursue Local Reforms<\/a><\/p>\n<\/blockquote>\n<p \/>\n<p><em>Photo by <a href=\"https:\/\/unsplash.com\/photos\/hAyInG_uDtE\" target=\"_blank\" rel=\"noopener\">Sam Doucette<\/a> on Unsplash.<\/em><\/p>\n<p>The post <a rel=\"nofollow noopener\" href=\"https:\/\/www.marijuanamoment.net\/senator-files-housing-bill-that-would-prevent-evictions-for-state-legal-marijuana-extraction\/\" target=\"_blank\">Senator Files Housing Bill That Would Prevent Evictions For State-Legal Marijuana Extraction<\/a> appeared first on <a rel=\"nofollow noopener\" href=\"https:\/\/www.marijuanamoment.net\" target=\"_blank\">Marijuana Moment<\/a>.<\/p>\n<p>&#013;<br \/>\n&#013;<br \/>\nRead More: <a href=\"https:\/\/www.marijuanamoment.net\/senator-files-housing-bill-that-would-prevent-evictions-for-state-legal-marijuana-extraction\/\" target=\"_blank\" rel=\"nofollow noopener\">Senator Files Housing Bill That Would Prevent Evictions For State-Legal Marijuana Extraction<\/a><\/p>\n","protected":false},"excerpt":{"rendered":"<p>Sen.
