Jamie Raskin (D-MD) and Alexandria Ocasio-Cortez (D-NY)\u2014who recently reached out to WADA about the <a href=\"https:\/\/www.marijuanamoment.net\/white-house-declines-to-defend-runner-suspended-from-olympics-over-marijuana-test-while-lawmakers-step-up\/\" target=\"_blank\" rel=\"noopener\">suspension of U.S. runner Sha\u2019Carri Richardson<\/a> over a positive cannabis test\u2014the global organization provided background on why marijuana was included in the banned substances list in the first place and explained why it couldn\u2019t unilaterally reverse the punishment.<\/p>\n<p>While WADA consistently reviews and updates the prohibited drug list, it said that decisions are made based on consensus among representatives of participating governments. It stressed that \u201cno time since the first Prohibited List was published in 2004 has WADA received any objection from U.S. stakeholders concerning the inclusion of cannabinoids on the Prohibited List.\u201d<\/p>\n<blockquote class=\"twitter-tweet\" data-width=\"550\" data-dnt=\"true\">\n<p lang=\"en\" dir=\"ltr\">WADA publishes response to U.S. Congressman Raskin and Congresswoman Ocasio-Cortez regarding the one-month suspension levied by the United States Anti-Doping Agency (USADA) against Ms. Sha\u2019Carri Richardson.<\/p>\n<p>Read the full response below:<a href=\"https:\/\/t.co\/LU2H639sOz\" target=\"_blank\" rel=\"nofollow noopener\">https:\/\/t.co\/LU2H639sOz<\/a><\/p>\n<p>\u2014 WADA (@wada_ama) <a href=\"https:\/\/twitter.com\/wada_ama\/status\/1413964639650603014?ref_src=twsrc%5Etfw\" target=\"_blank\" rel=\"nofollow noopener\">July 10, 2021<\/a><\/p>\n<\/blockquote>\n<p \/>\n<p>\u201cOn the contrary, as has been reported by some media, the U.S. has been one of the most vocal and strong advocates for including cannabinoids on the Prohibited List,\u201d the letter from Witold Banka, WADA\u2019s president, said. \u201cThe meeting minutes and written submissions received from the U.S. over nearly two decades, in particular from [the U.S. Anti-Doping Agency], have consistently advocated for cannabinoids to be included on the Prohibited List.\u201d<\/p>\n<p>That point was also made by the first president of WADA, Richard Pound, <a href=\"https:\/\/www.marijuanamoment.net\/how-u-s-bullying-in-the-1990s-led-to-the-olympics-marijuana-ban-behind-richardsons-suspension\/\" target=\"_blank\" rel=\"noopener\">in a recent interview with Marijuana Moment<\/a>.<\/p>\n<p>\u201cThe U.S. was a leader in saying\u2014and this was the [Office of National Drug Control Policy] saying this\u2014\u2019in our view, marijuana is the entry-level drug. If you can keep people from using marijuana, they don\u2019t graduate to cocaine and heroin and some of the other the other chemical variations of these things,\u2019\u201d he said.<\/p>\n<p>In the new letter, WADA wrote that \u201cthe argument that some have advanced indicating that U.S. anti-doping stakeholders are bound by antiquated thinking regarding the Prohibited List is not supported by the facts.\u201d<\/p>\n<p>\u201cThe consultative process in place allows for modifications to the Prohibited List and the Code, annually,\u201d it continued. \u201cIn fact, over time, as your letter recognizes, several such changes have occurred, and there is nothing preventing additional changes consistent with the process I have described.\u201d<\/p>\n<p>Part of the consultative process is based on recommendations from WADA\u2019s Prohibited List Expert Advisory Group. The letter emphasizes that the U.S. is overrepresented on that body, with three of its 12 seats\u2014\u201dincluding an official with more than two decades experience at the U.S. National Institutes of Health.\u201d The country also \u201chas had greater representation\u201d on WADA\u2019s separate Health, Medical and Research (HMR) Committee \u201cthan any other nation.\u201d<\/p>\n<p>\u201cWhile the United States does not currently serve on WADA\u2019s Executive Committee, it has represented its 42-nation region more than any other nation in WADA\u2019s history (seven years),\u201d it continues. \u201cAn important fact for the U.S. Congress to know about this process is that there are more representatives from the United States advising WADA on these scientific issues than from any other nation in the world. These decisions are not reached in a vacuum.\u201d<\/p>\n<p>In other words, criticism from Americans over the marijuana ban should not solely target WADA but should take into account the fact that the U.S. itself bears significant responsibility for setting and maintaining the global prohibition.<\/p>\n<p>The letter further states that while WADA sympathizes \u201cwith the circumstances of this case\u201d and applauds \u201cMs. Richardson\u2019s accountability for accepting that the rules are in place for athletes worldwide, WADA simply plays a coordinating role in the development and publication of the Prohibited List.\u201d<\/p>\n<p style=\"padding-left: 40px\">\u201cAs you correctly noted in your letter, the testing of Ms. Richardson and her resulting suspension were administered and adjudicated by USADA. WADA is not a party to that particular matter and, therefore, simply is not in position to vacate the results of Ms. Richardson\u2019s test in Oregon, the 30-day suspension imposed by USADA, nor the decisions of USA Track and Field regarding her participation at the Tokyo Olympics.\u201d<\/p>\n<p>Separately, The U.S. Anti-Doping Agency (USADA) also responded to the letter from Raskin and Ocasio-Cortez last week. It asserted that the rules on marijuana for international athletes \u201cmust change.\u201d<\/p>\n<p>USADA had previously expressed sympathy last week for Richardson and indicated that it <a href=\"https:\/\/www.marijuanamoment.net\/white-house-and-u-s-anti-doping-agency-criticize-marijuana-ban-after-richardson-suspension\/\" target=\"_blank\" rel=\"noopener\">may be time for a reevaluation of the marijuana prohibition<\/a>\u2014but the latest statement explicitly calls for a policy change.<\/p>\n<p>Meanwhile, the White House ONDCP is also working to secure a meeting with WADA about cannabis policies on the international sports stage. The Financial Times <a href=\"https:\/\/www.ft.com\/content\/57a86835-cfd6-42a1-abfa-2a1a545ed96f\" target=\"_blank\" rel=\"noopener\">reported<\/a>\u00a0on Friday that the Biden administration intends to discuss issues \u201cincluding the timeframe for testing, and the basis for the consideration of cannabis as a performance enhancing drug.\u201d<\/p>\n<p>While WADA indicated that the U.S. has not strongly protested marijuana\u2019s inclusion on the banned substances list and has historically advocated for such inclusion, USADA said in its letter that it \u201chas argued for still more changes and will continue to advocate for changes going forward.\u201d<\/p>\n<p>Banka said in his new response on behalf of WADA that he was forwarding the congressional letter to various internal WADA decision-making committees and has \u201crequested that your concerns be specifically examined during their ongoing review of the<br \/>\nProhibited List.\u201d<\/p>\n<p>The organization noted that USADA amended its marijuana policy for domestic professional fighting that\u2019s not subject to WADA rules. On that note, Nevada sports regulators voted last week to make it so athletes will <a href=\"https:\/\/www.marijuanamoment.net\/nevada-sports-regulators-ditch-marijuana-testing-for-fighters-days-after-richardsons-olympics-suspension\/\" target=\"_blank\" rel=\"noopener\">no longer be penalized over a positive marijuana test<\/a>, with members citing Richardson\u2019s case during the meeting as an example of why the policy is inappropriate.<\/p>\n<p>USADA wrote that \u201cPresident Joe Biden described the way forward best when he said\u201d that the \u201crules are rules,\u201d\u00a0<a href=\"https:\/\/www.marijuanamoment.net\/biden-suggests-anti-marijuana-rules-banning-athletes-like-shacarri-richardson-could-change\/\" target=\"_blank\" rel=\"noopener\">but those regulations may need to be reevaluated<\/a>\u00a0and he\u2019s proud of Richardson for how she responded to the situation.<\/p>\n<p>Also last week, the White House press secretary\u2014like USADA\u2014expressed sympathy for the runner and indicated that it\u00a0<a href=\"https:\/\/www.marijuanamoment.net\/white-house-and-u-s-anti-doping-agency-criticize-marijuana-ban-after-richardson-suspension\/\" target=\"_blank\" rel=\"noopener\">may be time for a reevaluation of the marijuana prohibition<\/a>.<\/p>\n<p>Press Secretary Jen Psaki previously\u00a0<a href=\"https:\/\/www.marijuanamoment.net\/white-house-declines-to-defend-runner-suspended-from-olympics-over-marijuana-test-while-lawmakers-step-up\/\" target=\"_blank\" rel=\"noopener\">declined to condemn Olympics officials\u2019 sanction<\/a> on Richardson when asked about the issue at a briefing with reporters earlier this month, but she told CNN in the newer comments that the case highlights the need to \u201ctake another look\u201d at the rules on cannabis, especially in light of the decision to bar the athlete from a second event that fell outside the scope of the 30-day suspension.<\/p>\n<p>USA Track &amp; Field also said last week that international policy on cannabis punishments for athletes <a href=\"https:\/\/www.marijuanamoment.net\/usa-track-and-field-team-says-marijuana-punishments-should-be-reevaluated-following-richardson-suspension\/\" target=\"_blank\" rel=\"noopener\">\u201cshould be reevaluated.\u201d<\/a><\/p>\n<p>Following Ocasio-Cortz and Raskin\u2019s letter, a separate group of <a href=\"https:\/\/www.marijuanamoment.net\/congressional-lawmakers-request-marijuana-policy-change-following-shacarri-richardson-suspension\/\" target=\"_blank\" rel=\"noopener\">lawmakers also sent a letter to USADA<\/a>\u00a0on Friday to urge a policy change.<\/p>\n<p>\u201cWe believe that cannabis does not meet the description of scientifically proven risk or harm to the athlete,\u201d those 18 lawmakers wrote, \u201cand the USADA is perpetuating stereotypes and rhetoric fueled by the racist War on Drugs by claiming its usage, in private use and outside of competition, violates the \u2018spirit of the sport.\u2019\u201d<\/p>\n<p>Advocates have broadly embraced internal marijuana policy reforms at other major professional athletic organizations, arguing that they are long overdue especially given the ever-expanding legalization movement.<\/p>\n<p>NFL\u2019s\u00a0<a href=\"https:\/\/www.marijuanamoment.net\/new-nfl-policy-would-end-suspensions-for-testing-positive-for-any-drug-not-just-marijuana\/\" target=\"_blank\" rel=\"noopener\">drug testing policy changed demonstrably<\/a>\u00a0last year as part of a collective bargaining agreement, for example. Under the policy, NFL players will not face the possibility of being suspended from games over positive tests for any drug\u2014not just marijuana.<\/p>\n<p>In a similar vein, the MLB decided in 2019 to\u00a0<a href=\"https:\/\/www.marijuanamoment.net\/mlb-officially-removes-marijuana-from-banned-substances-list-for-baseball-players\/\" target=\"_blank\" rel=\"noopener noreferrer\">remove cannabis from the league\u2019s list of banned substances<\/a>. Baseball players can consume marijuana without risk of discipline, but officials clarified last year that\u00a0<a href=\"https:\/\/www.marijuanamoment.net\/baseball-players-can-smoke-marijuana-but-cant-be-sponsored-by-cannabis-companies-mlb-says\/\" target=\"_blank\" rel=\"noopener\">they can\u2019t work while under the influence<\/a>\u00a0and can\u2019t enter into sponsorship contracts with cannabis businesses, at least for the time being.<\/p>\n<p>Meanwhile, a temporary NBA policy\u00a0<a href=\"https:\/\/www.marijuanamoment.net\/nba-players-wont-be-tested-for-marijuana-next-year-as-league-weighs-permanent-change\/\" target=\"_blank\" rel=\"noopener\">not to randomly drug test players for marijuana<\/a>\u00a0amid the coronavirus pandemic may soon become permanent, the league\u2019s top official said in December.
