Jacky Rosen (D-NV), describes the unique financial barriers that state-legal cannabis companies face while marijuana remains federally illegal. The senators said freeing up SBA loans and disaster assistance for the industry is especially needed because the funds \u201cwould fill gaps left by the private sector and help mitigate the effects of the COVID-19 pandemic.\u201d<\/p>\n<p>To that end, the lawmakers\u2014including Sens. Bernie Sanders (I-VT) and Cory Booker (D-NJ)\u2014submitted the request for a policy change to the heads of the Senate Appropriations Committee and the Appropriations Financial Services and General Government (FSGG) Subcommittee late last month. They specifically asked that language be added to the fiscal year 2022 FSGG spending bill report to ensure SBA is authorized to issue loans to these businesses.<\/p>\n<p>The report should call on SBA to stop \u201cdenying loan applications for the 7(a) Loan Guarantee Program, Disaster Assistance Program, Microloan Program, and 504\/Certified Development Company Loan Program to legally operating cannabis small businesses in states that have legalized cannabis sale and use,\u201d the letter says.<\/p>\n<blockquote class=\"twitter-tweet\" data-width=\"550\" data-dnt=\"true\">\n<p lang=\"en\" dir=\"ltr\">Small businesses are the backbone of our economy.<\/p>\n<p>I\u2019m leading my colleagues in requesting that non-profit child care providers &amp; cannabis small businesses have access to SBA loans, &amp; $37 million in funding for <a href=\"https:\/\/twitter.com\/USDA?ref_src=twsrc%5Etfw\" target=\"_blank\" rel=\"nofollow noopener\">@USDA<\/a>\u2019s Rural Business Development Grants to help businesses recover.<\/p>\n<p>\u2014 Senator Jacky Rosen (@SenJackyRosen) <a href=\"https:\/\/twitter.com\/SenJackyRosen\/status\/1413539251703123973?ref_src=twsrc%5Etfw\" target=\"_blank\" rel=\"nofollow noopener\">July 9, 2021<\/a><\/p>\n<\/blockquote>\n<p \/>\n<p>\u201cSBA\u2019s current policy excludes small businesses with \u2018direct\u2019 or \u2018indirect\u2019 products or services that aid the use, growth, enhancement, or other development of cannabis from SBA-backed financing,\u201d it explains. \u201cConsequently, small businesses in states with some form of legal cannabis must choose between remaining eligible for SBA programs and participating in or doing business with a rapidly-growing and legal industry.\u201d<\/p>\n<p>The letter also notes that while there has been a \u201cclear shift in public opinion supporting legalization of cannabis in the United States,\u201d many marijuana businesses still operate on a largely cash-only basis because many banks are not willing to take on clients that deal in a federally controlled substance.<\/p>\n<p>\u201cWe strongly support SBA making all of its loan programs available to all state-legal cannabis small businesses,\u201d the lawmakers <a href=\"https:\/\/www.rosen.senate.gov\/rosen-leads-colleagues-calls-provide-resources-millions-support-nevada-small-businesses\" target=\"_blank\" rel=\"noopener\">wrote<\/a>. \u201cWe, therefore, ask the Subcommittee on Financial Services and General Government to include language in your forthcoming legislation to help extend SBA loan programs to cannabis small businesses legally operating in states that allow the sale and use of cannabis for medical or recreational purposes.\u201d<\/p>\n<p>The letter\u2019s other signatories include: Sens. Jeff Merkley (D-OR), Maria Cantwell (D-WA), Ed Markey (D-MA), Ron Wyden (D-OR), Bob Menendez (D-NJ), Alex Padilla (D-CA) and Raphael Warnock (D-GA).<\/p>\n<p>This is a continuation of a conversation that has really heated up amid the coronavirus pandemic.<\/p>\n<p>In February, Rosen pressed the then-nominee for SBA administrator, Isabella Guzman, on <a href=\"https:\/\/www.marijuanamoment.net\/senator-gets-marijuana-commitment-from-bidens-small-business-administration-nominee\/\" target=\"_blank\" rel=\"noopener\">helping cannabis firms access assistance from the agency<\/a>. The since-confirmed official simply committed to \u201cfurther understanding those rules and regulations\u201d and working with the senator\u2019s office.<\/p>\n<p>SBA confirmed last year, as the pandemic broke out across the country, that state-legal cannabis businesses are <a href=\"https:\/\/www.marijuanamoment.net\/marijuana-businesses-are-ineligible-for-coronavirus-disaster-relief-federal-agency-confirms\/\" target=\"_blank\" rel=\"noopener\">ineligible for federal disaster relief loans<\/a>\u00a0offered to other small businesses. The agency went even further to say that the loans are also off-limits to\u00a0<a href=\"https:\/\/www.marijuanamoment.net\/businesses-that-indirectly-work-with-marijuana-industry-ineligible-for-federal-coronavirus-loans\/\" target=\"_blank\" rel=\"noopener\">businesses that indirectly serve the marijuana industry<\/a>.<\/p>\n<p>Rosen, Wyden and other lawmakers later penned <a href=\"https:\/\/www.marijuanamoment.net\/senators-want-marijuana-businesses-to-qualify-for-federal-coronavirus-relief-programs\/\" target=\"_blank\" rel=\"noopener\">a letter to Senate leadership in April<\/a> of last year arguing that the cannabis industry deserved equal access to federal relief.<\/p>\n<p>By the end of that month, supportive lawmakers in Congress had introduced a bill to <a href=\"https:\/\/www.marijuanamoment.net\/lawmakers-file-bill-to-let-marijuana-businesses-access-federal-coronavirus-relief-funds\/\" target=\"_blank\" rel=\"noopener\">extend access to coronavirus relief funds<\/a>\u00a0to state-legal cannabis businesses, but the measure did not come to a vote.<\/p>\n<p>Then in September, wildfires on the West Coast hit marijuana growers hard. Oregon regulators, for instance, said 20 percent of cannabis companies in the state had been encouraged to evacuate.
