Marijuana Sales Ban"},"content":{"rendered":"<p><img loading=\"lazy\" src=\"https:\/\/cannabiscultivatornews.com\/home\/wp-content\/uploads\/2021\/06\/MM_Bill_Tracker_V5_blank-89.jpg\" width=\"1500\" height=\"1500\"> <\/p>\n<p>President Joe Biden wants to keep blocking Washington, D.C. from implementing marijuana sales. But on Wednesday, leaders of a U.S. House of Representatives subcommittee released a wide-ranging spending bill would lift that ban, in addition to protecting banks that service state-legal cannabis businesses.<\/p>\n<p>Despite the president specifically maintaining a rider <a href=\"https:\/\/www.marijuanamoment.net\/biden-budget-keeps-medical-marijuana-protections-but-would-block-d-c-from-legalizing-recreational-sales\/\" target=\"_blank\" rel=\"noopener\">barring D.C. from using its tax dollars to legalize marijuana commerce<\/a> in his budget proposal last month, the legislation from House Appropriations Financial Services and General Government (FSGG) Subcommittee Chairman Mike Quigley (D-IL) would remove that barrier.<\/p>\n<p>The proposal, which covers annual funding for various federal agencies, also contains language that would protect banks from being penalized by federal regulators simply for working with cannabis companies that operate in accordance with state laws. Biden\u2019s budget request did not weigh in on that issue, nor has he commented on standalone legislation that cleared the House for the fourth time this year to provide the same protections.<\/p>\n<p>But the exclusion of the D.C. provision from the Fiscal Year 2022 FSGG appropriations <a href=\"https:\/\/appropriations.house.gov\/events\/markups\/financial-services-and-general-government-subcommittee-markup\" target=\"_blank\" rel=\"noopener\">bill<\/a>, which will be voted on in subcommittee on Thursday and then taken up by the full Appropriations panel on Tuesday, could set the stage for conflict between lawmakers and the president. The Biden administration has already disappointed advocates by declining to take meaningful action on cannabis reform as promised on the campaign trail, and his inclusion of the D.C. rider was seen as an outright hostile act.<\/p>\n<p>The District\u2019s mayor said in April that local officials are prepared to move forward with <a href=\"https:\/\/www.marijuanamoment.net\/d-c-is-ready-to-legalize-marijuana-sales-as-soon-as-congress-gets-out-of-the-way-mayor-says\/\" target=\"_blank\" rel=\"noopener\">implementing a legal system of recreational cannabis sales<\/a>\u00a0in the nation\u2019s capital just as soon as they can get over the final \u201churdle\u201d of congressional interference.<\/p>\n<p>After the Biden budget was released, Rep. Eleanor Holmes Norton (D-DC) told Marijuana Moment that <a href=\"https:\/\/www.marijuanamoment.net\/congresswoman-blasts-biden-decision-to-block-marijuana-sales-in-d-c\/\" target=\"_blank\" rel=\"noopener\">she\u2019s \u201cvery disappointed\u201d over the decision<\/a>, especially considering that fact that he\u2019s voiced support for D.C. statehood.<\/p>\n<p>The ongoing blockade is the result of an amendment that was first added by Rep. Andy Harris (R-MD) when Republicans controlled the House and has since been continued in annual appropriations legislation. President Donald Trump and President Barack Obama <a href=\"https:\/\/www.marijuanamoment.net\/trump-budget-proposes-ending-state-medical-marijuana-protections-and-blocking-dc-from-legalizing\/\" target=\"_blank\" rel=\"noopener\">each called for ending the policy<\/a> as part of their budget proposals, but <a href=\"https:\/\/www.marijuanamoment.net\/top-pro-trump-lawmaker-congress-will-ignore-presidents-push-to-end-medical-marijuana-protections\/\" target=\"_blank\" rel=\"noopener\">Congress has consistently upheld it regardless<\/a>.<\/p>\n<p>In 2019 and last year, the House approved an even more expansive amendment that would have <a href=\"https:\/\/www.marijuanamoment.net\/house-passed-marijuana-amendments-stripped-from-congressional-spending-bills\/\" target=\"_blank\" rel=\"noopener noreferrer\">provided protections for all state and territory marijuana programs<\/a>, rather than just medical cannabis systems. But the Senate did not follow suit and the provision was not included in final spending bill sent to Trump\u2019s desk.<\/p>\n<p>On several occasions when Trump signed large-scale annual spending legislation, he attached a statement that said he is <a href=\"https:\/\/www.marijuanamoment.net\/trump-says-he-can-ignore-medical-marijuana-protections-passed-by-congress\/\" target=\"_blank\" rel=\"noopener noreferrer\">empowered to ignore the congressionally approved medical cannabis rider<\/a>, stating that the administration \u201cwill treat this provision consistent with the President\u2019s constitutional responsibility to faithfully execute the laws of the United States.\u201d<\/p>\n<p>When it comes to banking, the House has not only passed standalone legislation to protect financial institutions from being punished for working with cannabis businesses, but has also included a rider on the topic in previous years\u2019 appropriations bills. While the Senate under Republican control has refused to take up any of those measures, advocates are hopeful that the issue will advance now that the chamber has a Democratic majority.<\/p>\n<p><strong>The current House FSGG bill\u2019s banking language reads:<\/strong><\/p>\n<p style=\"padding-left: 40px\">\u201cSEC. 629. None of the funds made available in this Act may be used to penalize a financial institution solely because the institution provides financial services to an entity that is a manufacturer, a producer, or a person that participates in any business or organized activity that involves handling hemp, hemp-derived cannabidiol products, other hemp-derived cannabinoid products, marijuana, marijuana products, or marijuana proceeds, and engages in such activity pursuant to a law established by a State, political subdivision of a State, or Indian Tribe. In this section, the term \u2018State\u2019 means each of the several States, the District of Columbia, and any territory or possession of the United States.\u201d<\/p>\n<p>The language would provide limited protections as compared to the more comprehensive standalone legislation on the topic, since it would need to be renewed annually and only applies to the Treasury Department. It provides no restrictions on the Department of Justice, which is covered under a separate appropriations bill, for example.<\/p>\n<p>Meanwhile, the Biden administration is being closely watched by advocates when it comes to any marijuana policy development\u2014especially since the president has maintained an opposition to adult-use legalization even as multiple bills to end federal prohibition are being drafted and introduced.<\/p>\n<p>Perhaps unsurprisingly, Biden\u2019s budget did not propose gutting the Office of National Drug Control Policy (ONDCP) as Trump did. The former president called for <a href=\"https:\/\/www.marijuanamoment.net\/trump-budget-guts-drug-czars-office\/\" target=\"_blank\" rel=\"noopener\">a roughly 90 percent cut in the agency\u2019s budget<\/a> in his proposals, but Congress did not follow suit. Biden helped to establish the drug czar\u2019s office during his time in the Senate.<\/p>\n<p>Biden\u2019s\u00a0<a href=\"https:\/\/www.govinfo.gov\/app\/collection\/budget\/2022\" target=\"_blank\" rel=\"noopener\">budget<\/a>\u00a0also includes $17 million in funding to support industrial hemp production.<\/p>\n<p>The FSGG measure is the first of twelve separate appropriations bills that Congress will take up this year.
