The first is to expand the state\u2019s decriminalization policy, and the second is to have the state petition for a federal exemption for Minnesota\u2019s medical cannabis program.<\/p>\n<p>Part of the motivation behind that latter proposal is to ensure that registered patients are able to lawfully purchase and possess firearms in spite of federal restrictions.<\/p>\n<p>At the rally, which was organized by NORML, Republicans Against Marijuana Prohibition (RAMP) and other groups, Winkler and several other lawmakers spoke in favor of modest policy changes such as decriminalizing cannabis.<\/p>\n<div class=\"fb-video\" data-allowfullscreen=\"true\" data-href=\"https:\/\/www.facebook.com\/RepresentativeJeremyMunson\/videos\/340528504110118\" \/>\n<p>\u201cDecriminalizing small amounts is important,\u201d Rep. Jeremy Munson (R), one of only a handful of Republicans who voted for Winkler\u2019s broad adult-use legalization bill, said at the rally. \u201cIf someone in Minnesota gets caught with two gummy bears, it\u2019s a felony and they\u2019ll lose their gun rights forever.\u201d<\/p>\n<p>The coalition proposed several key reforms that they say should be integrated into public safety and health legislation that\u2019s currently moving through committee during the special session:<\/p>\n<p style=\"padding-left: 40px\">-Further reduce penalties for simple possession of marijuana.<\/p>\n<p style=\"padding-left: 40px\">-Allow people convicted of possession up to eight grams of cannabis to petition the courts for expungement.<\/p>\n<p style=\"padding-left: 40px\">-Require the Minnesota health commissioner to petition the Drug Enforcement Administration (DEA) for an exemption for its medical marijuana program.<\/p>\n<p>\u201dReducing or eliminating the criminal penalties we\u2019re seeing around marijuana is where we have consensus,\u201d Thomas Gallagher of RAMP <a href=\"https:\/\/docs.google.com\/document\/d\/1GnPjbAs-tbIL72tYK1IZRLk6qpJGG-65oduwAjqTaQQ\/edit\" target=\"_blank\" rel=\"noopener\">said<\/a> in a press release. \u201cLet\u2019s focus on the people who have small quantities. There is injustice in a trivial amount of marijuana resulting in life-changing punishments like imprisonment, criminal records, and lost jobs and kids.\u201d<\/p>\n<blockquote class=\"twitter-tweet\" data-width=\"550\" data-dnt=\"true\">\n<p lang=\"en\" dir=\"ltr\">Rally for Our Special Session Agenda: <br \/>1. Medical reform: Require Minn to petition for a fed exemption fr Schedule 1 for Minn&#8217;s Med Cannabis patients.<a href=\"https:\/\/t.co\/9S8Vwz4yoB\" target=\"_blank\" rel=\"nofollow noopener\">https:\/\/t.co\/9S8Vwz4yoB<\/a><\/p>\n<p>\u2014 Minnesota NORML (@MNNORML) <a href=\"https:\/\/twitter.com\/MNNORML\/status\/1404885775997706254?ref_src=twsrc%5Etfw\" target=\"_blank\" rel=\"nofollow noopener\">June 15, 2021<\/a><\/p>\n<\/blockquote>\n<p \/>\n<p>Similar to the Minnesota activists\u2019 call, Iowa officials have requested that federal agencies guarantee some level of protection for people <a href=\"https:\/\/www.marijuanamoment.net\/iowa-asks-dea-to-guarantee-protections-for-medical-marijuana-program-after-facing-activist-lawsuit\/\" target=\"_blank\" rel=\"noopener\">participating in the state\u2019s medical marijuana program<\/a>.<\/p>\n<p>The Hawaii legislature <a href=\"https:\/\/www.marijuanamoment.net\/hawaii-legislature-seeks-marijuana-exemption-from-dea-while-senate-requests-legal-psilocybin-plan\/\" target=\"_blank\" rel=\"noopener\">adopted a resolution in April seeking an exemption<\/a>\u00a0from DEA stipulating that the state is permitted to run its medical cannabis program without federal interference.<\/p>\n<p>Back in Minnesota, the House\u00a0<a href=\"https:\/\/www.marijuanamoment.net\/minnesota-house-approves-marijuana-legalization-bill\/\" target=\"_blank\" rel=\"noopener\">approved a bill last month to legalize marijuana for recreational use<\/a>\u00a0following 12 committee assignments. That legislation stalled in the GOP-controlled Senate, however.<\/p>\n<p>Advocates are hopeful about the possibility that further cannabis reforms could be accomplished in the special session, but they see an obstacle in Senate Majority Leader Paul Gazelka (R), who has been relatively silent on the issue since the end of the regular session.<\/p>\n<p>He did previously say, however, that \u201cwe\u2019re always said we were open to lowering the criminal penalties [for marijuana].\u201d<\/p>\n<p>The decriminalization legislation that advocates are rallying behind would make possession of up to eight grams of cannabis a petty misdemeanor. It would also make people with prior convictions for that level of possession eligible for expungements.<\/p>\n<p>Under the separate medical cannabis expansion bill that the governor has signed, adults 21 and older will be able to access smokable marijuana products. That policy must take effect by March 1, 2022, or earlier if rules are developed and the state\u2019s cannabis commissioner authorizes it.<\/p>\n<p>Dispensaries could also provide a curbside pickup option for patients under the new law. It further removes restrictions for designated caregivers and allows them to tend to six registered patients at once, rather than just one.<\/p>\n<p>Walz, who hadn\u2019t been especially vocal about legalization as the broader legislation advanced during the regulator session, said, \u201cI\u2019ve thought for a long time about that,\u201d adding that \u201cwe know that adults can make their own decisions on things, we know that criminalization and prohibition has not worked.\u201d<\/p>\n<p>\u201cI\u2019ve always thought that it makes sense to control how you\u2019re doing this and to make sure that adults know what they\u2019re getting into, and use it wisely,\u201d he said. \u201cI also think there\u2019s a lot of inequity about how folks have spent time in jail or been arrested around this, especially in communities of color.\u201d<\/p>\n<p>The majority leader\u2019s legalization legislation as introduced was identical to a proposal he filed last year, with some minor technical changes. Winkler, who led a statewide listening to gather public input ahead of the measure\u2019s introduction, called it the <a href=\"https:\/\/www.marijuanamoment.net\/top-minnesota-lawmaker-unveils-long-delayed-best-marijuana-legalization-bill-in-the-country\/\" target=\"_blank\" rel=\"noopener\">\u201cbest legalization bill in the country\u201d<\/a>\u00a0at the time. It did not advance in that session, however.<\/p>\n<p>Under the measure, social equity would be prioritized, in part by ensuring diverse licensing and preventing the market from being monopolized by corporate players. Prior marijuana records would also be automatically expunged.<\/p>\n<p>Walz in January he called on lawmakers to pursue the reform as a means to\u00a0<a href=\"https:\/\/www.marijuanamoment.net\/minnesota-governor-urges-lawmakers-to-pursue-marijuana-legalization-amid-budget-talks\/\" target=\"_blank\" rel=\"noopener\">boost the economy and promote racial justice<\/a>. He did not include a request to legalize through his budget proposal, however.<\/p>\n<p>The governor did say in 2019 that he was\u00a0<a href=\"https:\/\/www.marijuanamoment.net\/minnesota-governor-directs-state-agencies-to-prepare-for-marijuana-legalization\/\" target=\"_blank\" rel=\"noopener\">directing state agencies to prepare to implement reform<\/a>\u00a0in anticipation of legalization passing.<\/p>\n<p>Winkler, meanwhile, said in December that if Senate Republicans don\u2019t go along with the policy change legislatively, he said he hopes they will\u00a0<a href=\"https:\/\/www.marijuanamoment.net\/top-minnesota-house-lawmaker-wants-marijuana-on-ballot-if-gop-senate-blocks-legalization-bill\/\" target=\"_blank\" rel=\"noopener\">at least let voters decide on cannabis<\/a>\u00a0as a 2022 ballot measure.<\/p>\n<p>Heading into the 2020 election, Democrats believed they had a shot of taking control of the Senate, but that didn\u2019t happen.
