Bonnie Watson Coleman (D-NJ) and Cori Bush (D-MO) are sponsoring the legislation, which aims to promote a public health- and evidence-based approach to substance misuse. The bill is titled the Drug Policy Reform Act (DPRA) and was drafted in partnership with the Drug Policy Alliance (DPA).<\/p>\n<p>The proposal would end the threat of incarceration for people caught possessing drugs for personal use. Courts would still have the option of imposing a fine, but that could be waived if a person couldn\u2019t afford it.<\/p>\n<p>Importantly, the measure would make it so the U.S. Department of Health and Human Services (HHS)\u2014rather than the Justice Department\u2014would be responsible for classifying drugs, with the intent being to shift that role to a health-centric model.<\/p>\n<blockquote class=\"twitter-tweet\" data-width=\"550\" data-dnt=\"true\">\n<p lang=\"en\" dir=\"ltr\">Our approach until now has not been to help sick people with treatment and counseling, but to throw them in jail. Bonnie Watson Coleman (@RepBonnie) <a href=\"https:\/\/twitter.com\/RepBonnie\/status\/1404842779621138443?ref_src=twsrc%5Etfw\" target=\"_blank\" rel=\"nofollow noopener\">June 15, 2021<\/a><\/p>\n<\/blockquote>\n<p \/>\n<p>Federal district courts would be required to facilitate expungements and record sealing for those with qualifying convictions within one year of the bill\u2019s enactment.<\/p>\n<p>Almost half of the federal prison population is currently serving time over drug-related offenses\u2014a much smaller percentage of which is for possession alone\u2014and so the direct impact of the legislation\u2019s decriminalization provision would be somewhat minimal on incarceration rates, especially when factoring in the size of state-level prison populations.<\/p>\n<p>But that\u2019s where another key component comes into play: the bill would withhold federal funds for law enforcement through the Byrne and COPS grant program for states and cities that continue to enforce criminalization of simple drug possession. Bonnie Watson Coleman (@RepBonnie) <a href=\"https:\/\/twitter.com\/RepBonnie\/status\/1404842783190487040?ref_src=twsrc%5Etfw\" target=\"_blank\" rel=\"nofollow noopener\">June 15, 2021<\/a><\/p>\n<\/blockquote>\n<p \/>\n<p>In the meantime, advocates are cheering the fact that such a far-reaching bill was even introduced in Congress.<\/p>\n<p>\u201cEvery 23 seconds, a person\u2019s life is ruined for simply possessing drugs,\u201d Queen Adesuyi, policy manager for the Office of National Affairs at DPA, said in a press release. \u201cDrug possession remains the most arrested offense in the United States despite the well-known fact that drug criminalization does nothing to help communities, it ruins them. It tears families apart, and causes trauma that can be felt for generations.\u201d<\/p>\n<p>The all-drug legislation may seem controversial given that Congress has consistently stalled on more modest reform proposals such as simply protecting banks that service state-legal marijuana businesses. But recent polling from DPA and the ACLU shows that <a href=\"https:\/\/www.marijuanamoment.net\/two-thirds-of-americans-support-decriminalizing-drugs-new-aclu-backed-poll-finds\/\" target=\"_blank\" rel=\"noopener\">the public is ready for the policy change<\/a>.<\/p>\n<p>In fact, two-thirds of American voters believe that the war on drugs should end, and they support decriminalizing simple possession of currently illegal substances, the survey released last week found.<\/p>\n<p>Federal decriminalization and incentivizing reform at the state level are the main cruxes of the new legislation. But it\u2019s a multifaceted proposal that would fundamentally change the federal government\u2019s decades-long approach to drugs. That\u2019s how long our government has waged a war\u2014not on drugs, but on people.<\/p>\n<p>I\u2019m proud to partner with <a href=\"https:\/\/twitter.com\/RepBonnie?ref_src=twsrc%5Etfw\" target=\"_blank\" rel=\"nofollow noopener\">@RepBonnie<\/a> in introducing the Drug Policy Reform Act to end criminal penalties for drug possession at the federal level and repair harm in Black and brown communities.<\/p>\n<p>\u2014 Congresswoman Cori Bush (@RepCori) <a href=\"https:\/\/twitter.com\/RepCori\/status\/1404839954602135555?ref_src=twsrc%5Etfw\" target=\"_blank\" rel=\"nofollow noopener\">June 15, 2021<\/a><\/p>\n<\/blockquote>\n<p \/>\n<p>Broad decriminalization might be new to Congress, but lawmakers in several states have recently been pushing for the reform.<\/p>\n<p>Last month, a joint Maine House and Senate committee advanced a bill to <a href=\"https:\/\/www.marijuanamoment.net\/maine-lawmakers-advance-drug-decriminalization-bill-to-house-floor-with-conflicting-recommendations\/\" target=\"_blank\" rel=\"noopener\">broadly decriminalize possession of illicit drugs<\/a>.<\/p>\n<p>Last year, Oregon voters elected to\u00a0<a href=\"https:\/\/www.marijuanamoment.net\/oregon-voters-approve-ballot-measure-to-decriminalize-all-drugs-and-fund-treatment-services\/\" target=\"_blank\" rel=\"noopener\">end criminalization of low-level drug possession<\/a>\u00a0at the ballot.<\/p>\n<p>Vermont lawmakers also introduced\u00a0<a href=\"https:\/\/www.marijuanamoment.net\/vermont-would-decriminalize-drugs-under-new-bill\/\" target=\"_blank\" rel=\"noopener\">a bill in March that would end criminal penalties<\/a>\u00a0for possessing small amounts of drugs in the state.<\/p>\n<p>Also that month, a Rhode Island Senate committee held a hearing on decriminalization legislation to\u00a0<a href=\"https:\/\/www.marijuanamoment.net\/rhode-island-lawmakers-hear-bill-to-decriminalize-all-drugs-as-marijuana-legalization-measures-move-forward\/\" target=\"_blank\" rel=\"noopener\">replace criminal penalties for possessing small amounts of drugs<\/a>\u00a0with a $100 fine.<\/p>\n<p>President Joe Biden has voiced support for <a href=\"https:\/\/www.marijuanamoment.net\/where-presidential-candidate-joe-biden-stands-on-marijuana\/\" target=\"_blank\" rel=\"noopener\">ending incarceration for low-level drug cases<\/a>, saying \u201cnobody should be going to jail for the use of drugs\u201d and the country should \u201cchange the way we deal with all drug abuse.\u201d But the administration has not taken any demonstrable steps to redirect federal policy so far, and he\u2019s yet to grant presidential clemency for any people incarcerated for drugs.<\/p>\n<p>White House Press Secretary Jen Psaki said in April that Biden\u2019s pledge to release federal inmates with marijuana convictions specifically\u00a0<a href=\"https:\/\/www.marijuanamoment.net\/biden-press-secretary-misstates-marijuana-reschedulings-impact-for-federal-prisoners-who-want-clemency\/\" target=\"_blank\" rel=\"noopener\">would start with rescheduling cannabis<\/a>\u2014a proposal that advocates say wouldn\u2019t actually accomplish what she suggested.<\/p>\n<p>Meanwhile, congressional lawmakers are also working to end a more specific federal prohibition on marijuana.<\/p>\n<p>The Marijuana Opportunity, Reinvestment and Expungement (MORE) Act\u2014which would deschedule cannabis and promote social equity, <a href=\"https:\/\/www.marijuanamoment.net\/house-approves-federal-marijuana-legalization-bill-in-historic-vote\/\" target=\"_blank\" rel=\"noopener\">cleared the chamber last year<\/a>\u00a0<a href=\"https:\/\/www.marijuanamoment.net\/bill-to-federally-legalize-marijuana-reintroduced-in-congress-as-senate-prepares-separate-measure\/\" target=\"_blank\" rel=\"noopener\">and was recently refiled<\/a>.<\/p>\n<p>Senate leadership is <a href=\"https:\/\/www.marijuanamoment.net\/schumer-worries-senate-marijuana-banking-vote-could-undermine-broader-legalization-push\/\" target=\"_blank\" rel=\"noopener\">continuing to draft a bill to end federal cannabis prohibition<\/a>, which Majority Leader Chuck Schumer (D-NY) has repeatedly said would be introduced \u201csoon.\u201d Senate Finance Committee Chairman Ron Wyden (D-OR), who is also working the bill alongside Schumer and Sen.
