{"id":48181,"date":"2021-06-10T13:04:44","date_gmt":"2021-06-10T21:04:44","guid":{"rendered":"https:\/\/cannabiscultivatornews.com\/home\/index.php\/2021\/06\/10\/virginia-launches-website-to-educate-people-about-marijuana-legalization-law-taking-effect-on-july-1\/"},"modified":"2021-06-10T13:45:30","modified_gmt":"2021-06-10T21:45:30","slug":"virginia-launches-website-to-educate-people-about-marijuana-legalization-law-taking-effect-on-july-1","status":"publish","type":"post","link":"https:\/\/cannabiscultivatornews.com\/home\/index.php\/2021\/06\/10\/virginia-launches-website-to-educate-people-about-marijuana-legalization-law-taking-effect-on-july-1\/","title":{"rendered":"Virginia Launches Website To Educate People About Marijuana Legalization Law Taking Effect On July 1"},"content":{"rendered":"<\/p>\n<p>Marijuana legalization is <a href=\"https:\/\/www.marijuanamoment.net\/virginia-governor-signs-marijuana-legalization-bill-in-ceremonial-event-even-though-its-already-enacted\/\" target=\"_blank\" rel=\"noopener\">set to go into effect in Virginia at the beginning of next month<\/a>\u2014and now the state is taking a step to educate residents about the rules of the new program.<\/p>\n<p>The state on Thursday launched a web page that breaks down the various provisions of the adult-use legalization law that was enacted in April and takes effect on July 1, detailing what people can\u2014and can\u2019t\u2014do legally.<\/p>\n<p>\u201cThe legalization of cannabis creates an opportunity for Virginia to implement criminal justice reforms, to promote diverse participation in the cannabis industry, and to reinvest in communities that have been disproportionally affected by marijuana prohibition,\u201d the site states.<\/p>\n<blockquote class=\"twitter-tweet\" data-width=\"550\" data-dnt=\"true\">\n<p lang=\"en\" dir=\"ltr\">If you have questions about marijuana legalization in Virginia, check out <a href=\"https:\/\/t.co\/FOHaH2zHqp\" target=\"_blank\" rel=\"nofollow noopener\">https:\/\/t.co\/FOHaH2zHqp<\/a>, the Commonwealth&#8217;s new website with information, updates, and answers to frequently asked questions about the law.<\/p>\n<p>\u2014 Governor Ralph Northam (@GovernorVA) <a href=\"https:\/\/twitter.com\/GovernorVA\/status\/1403070170176831490?ref_src=twsrc%5Etfw\" target=\"_blank\" rel=\"nofollow noopener\">June 10, 2021<\/a><\/p>\n<\/blockquote>\n<p \/>\n<p>At the same time, the state\u2019s Joint Legislative Audit &amp; Review Commission (JLARC) is recommending that lawmakers add a misdemeanor penalty to be imposed for possession in excess of the new limit\u2014a proposal opposed by advocates.<\/p>\n<p>\u201cIn the 2022 General Assembly, the focus should be on expediting safe, regulated retail sales, not finding new ways to criminalize Virginians for a legal substance,\u201d NORML <a href=\"https:\/\/www.thecentersquare.com\/virginia\/jlarc-suggests-higher-penalties-for-possessing-large-amounts-of-marijuana-in-virginia-pro-marijuana-groups\/article_5131290e-c89f-11eb-a066-f3d8a91b9898.html\" target=\"_blank\" rel=\"noopener\">said<\/a> in response.<\/p>\n<p>But for now, pro-legalization Gov. Ralph Northam (D) and his administration are hoping to spread awareness about the new law as approved this past session, letting citizens know that things like possession of up to one ounce of cannabis will be permissible for adults 21 and older, while underage use and driving under the influence will remain prohibited.<\/p>\n<p>\u201cVirginia\u2019s marijuana legalization law ends the prohibition of simple possession of marijuana for adults 21 years and older on July 1, 2021,\u201d a page <a href=\"https:\/\/www.cannabis.virginia.gov\/\" target=\"_blank\" rel=\"noopener\">states<\/a>. \u201cThe law also lays out a timeline for state agencies to seal marijuana-related criminal records.\u201d<\/p>\n<p style=\"padding-left: 40px\">\u201cOn July 1, 2021, all records of misdemeanor possession with intent to distribute marijuana arrests, charges, and convictions will be automatically sealed from public view in the Virginia State Police\u2019s systems. This follows the sealing of simple possession of marijuana records that were completed in 2020. By July 1, 2025, after several state entities overhaul record-keeping systems, all records, including records of arrests, charges, and convictions, for simple possession of marijuana or misdemeanor possession with the intent to distribute marijuana will be automatically sealed across all state and private databases.\u201d<\/p>\n<p>The notice on the new state site also advises that while regulators can begin developing certain rules for adult-use sales starting on July 1, stores cannot open until January 1, 2024 and it will \u201ctake time for the authority to hire staff, write regulations, and implement equity and safety initiatives.\u201d<\/p>\n<p>In the meantime, gifting of small amounts of cannabis from one adult to another is allowed, but it cannot come with a quid pro quo of having to purchase another product in order to receive the gift.<\/p>\n<p>\u201cThus, the \u2018gifting market\u2019 seen in Washington, D.C. will not be legal in Virginia,\u201d the site says, referring to an unregulated market that has cropped up in the nation\u2019s capital that involves companies selling $60 bottles of juice or t-shirts that come along with a \u201cfree\u201d gift of marijuana.<\/p>\n<p>Over the past session, the governor strongly advocated for cannabis reform, and lawmakers sent bills to enact legalization to his desk in February. In March, the governor formally <a href=\"https:\/\/www.marijuanamoment.net\/virginia-governor-officially-asks-lawmakers-to-speed-up-marijuana-legalization-so-it-happens-this-year\/\" target=\"_blank\" rel=\"noopener\">submitted substitute language to the bills<\/a>, and both chambers approved the proposed changes as suggested in April. That meant no further action was needed from Northam to enact them into law.<\/p>\n<p>In addition to possession, home cultivation will be also allowed starting in July. Plants will have to be labeled with \u201cidentification information, out of sight of public view, and out of range of individuals under the age of 21.\u201d<\/p>\n<p>The governor also asked the legislature to adopt an amendment to expedite automatic expungements for people with prior marijuana convictions, and they accepted that request. Sales are still slated to begin in 2024.<\/p>\n<p>State Attorney General Mark Herring (D), who had endorsed legalization before Northam and legislative leaders, said that he is \u201cproud to have played a role\u201d in building support for the issue.<\/p>\n<p>Support for legalizing marijuana is strong in Virginia,\u00a0<a href=\"https:\/\/www.marijuanamoment.net\/virginia-voters-support-legalizing-marijuana-in-new-poll-as-lawmakers-rapidly-advance-bills\/\" target=\"_blank\" rel=\"noopener\">according to a poll released in February<\/a>.
