{"id":48162,"date":"2021-06-09T10:26:10","date_gmt":"2021-06-09T18:26:10","guid":{"rendered":"https:\/\/cannabiscultivatornews.com\/home\/index.php\/2021\/06\/09\/trump-clemency-recipient-says-federal-marijuana-legalization-bill-will-leave-many-prisoners-behind\/"},"modified":"2021-06-09T13:45:33","modified_gmt":"2021-06-09T21:45:33","slug":"trump-clemency-recipient-says-federal-marijuana-legalization-bill-will-leave-many-prisoners-behind","status":"publish","type":"post","link":"https:\/\/cannabiscultivatornews.com\/home\/index.php\/2021\/06\/09\/trump-clemency-recipient-says-federal-marijuana-legalization-bill-will-leave-many-prisoners-behind\/","title":{"rendered":"Trump Clemency Recipient Says Federal Marijuana Legalization Bill Will Leave Many Prisoners Behind"},"content":{"rendered":"<\/p>\n<p>Advocates are eager for a House vote on a <a href=\"https:\/\/www.marijuanamoment.net\/bill-to-federally-legalize-marijuana-reintroduced-in-congress-as-senate-prepares-separate-measure\/\" target=\"_blank\" rel=\"noopener\">recently reintroduced bill to federally legalize marijuana<\/a>\u2014but some others are sounding the alarm about provisions related to resentencing that might not help to repair the harms of the war on drugs in the way lawmakers are aiming for.<\/p>\n<p>The Marijuana Opportunity, Reinvestment and Expungement (MORE) Act, sponsored by Judiciary Committee Chairman Jerrold Nadler (D-NY), would remove cannabis from the list of federally controlled substances. But it also has a concerted focus on social equity, which includes providing for resentencing for people convicted over certain federal marijuana offenses.<\/p>\n<p>To many advocates and legislators, there\u2019s a necessity to couple legalization with equity. And that\u2019s what the resentencing language, along with other provisions, is supposed to achieve. But in a letter to congressional lawmakers, a pro-reform individual who received clemency for a cannabis conviction from President Donald Trump warned that the bill, as written, would not have the impact that the sponsors intend.<\/p>\n<p>Because the legislation gives significant deference to the courts to make decisions on resentencing petitions\u2014but also declines to resolve cases where there are aggravating factors such as possession of a firearm or sums of money at the time of an arrest\u2014relief could be out of reach for a large number of federal inmates, the letter states.<\/p>\n<p>Craig Cesal, who is serving a sentence of supervised release after being <a href=\"https:\/\/www.marijuanamoment.net\/trump-grants-clemency-to-marijuana-prisoners-on-last-day-in-office\/\" target=\"_blank\" rel=\"noopener\">granted clemency by Trump over a federal cannabis trafficking case<\/a>, said in the letter that many people incarcerated for marijuana \u201cwould receive no relief from their conviction at all\u201d under the MORE Act, and some would \u201ccontinue to serve life sentences for conduct which would no longer be considered illegal.\u201d<\/p>\n<p>He pointed to three specific parts of the legalization legislation that could keep people incarcerated over marijuana based on the language.<\/p>\n<p>First, it would give \u201cdiscretion to the sentencing court as to whether the marijuana conviction or related conduct would be expunged.\u201d The bill states that people would be eligible for expungement only if their case was non-violent, and courts have frequently disagreement about what constitutes a violent offense.<\/p>\n<p>Second, it does not \u201cprovide relief for additional counts of conviction inextricably relying on the criminality of the marijuana offense.\u201d For example, if a person who was convicted on a cannabis charge was in possession of a firearm that would\u2019ve otherwise been lawful if marijuana wasn\u2019t illegal, that could complicate resentencing processing.<\/p>\n<p>Finally, those \u201cwhose offense involved five or more people, which is most marijuana offenses, would be specifically excepted from relief under the MORE Act,\u201d Cesal said.<\/p>\n<p>A spokesperson for the Judiciary Committee did not respond to Marijuana Moment\u2019s requests for a reaction to Cesal\u2019s concerns about the chairman\u2019s bill.<\/p>\n<p>Advocates have criticized certain other elements of the legislation when it was introduced and passed last Congress, but these specific issues have not been prominently raised.<\/p>\n<p>Rather, they focused on a provision that was added at the last minute last session that would have excluded people with prior marijuana convictions from operating a \u201ccannabis enterprise\u201d in the legal industry\u2014and that language has since been removed.<\/p>\n<p>Advocates are still taking issue with a separate policy that maintains a prohibition on people who\u2019ve been sentenced under \u201ckingpin\u201d statute from being eligible for expungements, which \u201cundermines the purpose of the bill and continues to perpetuate the War on Drugs,\u201d the Leadership Conference on Civil and Human Rights <a href=\"https:\/\/www.marijuanamoment.net\/civil-rights-groups-demand-congress-pass-federal-marijuana-legalization-bill-this-month\/\" target=\"_blank\" rel=\"noopener\">said in a recent letter to House leadership<\/a>.<\/p>\n<p>While advocates are generally backing Nadler\u2019s bill, this letter also comes as Senate leadership\u00a0<a href=\"https:\/\/www.marijuanamoment.net\/schumer-worries-senate-marijuana-banking-vote-could-undermine-broader-legalization-push\/\" target=\"_blank\" rel=\"noopener\">continues to draft a bill to end federal cannabis prohibition<\/a>, which Majority Leader Chuck Schumer (D-NY) has repeatedly said would be introduced \u201csoon.\u201d Senate Finance Committee Chairman Ron Wyden (D-OR), who is also working the bill alongside Schumer and Sen.
