Edward Osienski (D), would allow adults 21 and older to purchase and possess up to one ounce of cannabis. Home cultivation would not be permitted, however.<\/p>\n<p>The proposal <a href=\"https:\/\/www.marijuanamoment.net\/delaware-lawmakers-approve-marijuana-legalization-bill-in-committee-vote\/\" target=\"_blank\" rel=\"noopener\">cleared its first committee in March<\/a> and then, on Friday, it moved through the House Appropriations Committee. But while advocates are encouraged by its progress, it\u2019s also the case that <a href=\"https:\/\/www.marijuanamoment.net\/delawares-democratic-governor-reaffirms-opposition-to-legalizing-marijuana-which-he-says-can-be-a-gateway-drug\/\" target=\"_blank\" rel=\"noopener\">the state\u2019s Democratic governor remains opposed to adult-use legalization<\/a>.<\/p>\n<p>HB 150 would set a 15 percent sales tax on marijuana sales, with revenue covering the administrative costs of the adult-use program. Jeffrey Spiegelman (R), would also remove the creation of a fund to provide financial aid\u2014low-interest loans and grants\u2014for social equity businesses. Taken together, those proposed changes are elicit ing strong pushback from reform advocates.<\/p>\n<p>Naugle said MPP opposes the potential changes.<\/p>\n<p>\u201cThis amendment would gut the critical social equity components of HB 150. Cannabis prohibition has caused tremendous harm\u2014disproportionately in communities of color,\u201d she said. \u201cTo ensure cannabis is legalized equitably in Delaware and is focused on the communities most impacted by the war on cannabis, HA 3 must be rejected.\u201d<\/p>\n<p>Two other amendments concerning accreditation for cannabis testing facilities have also been filed.<\/p>\n<p>In order to be enacted, the legislation will need a supermajority of 25 House votes this week and would then need to similarly clear the Senate. But those aren\u2019t the only obstacles the proposal faces: Gov. John Carney (D) is a rare type of Democratic governor who <a href=\"https:\/\/www.marijuanamoment.net\/delawares-democratic-governor-reaffirms-opposition-to-legalizing-marijuana-which-he-says-can-be-a-gateway-drug\/\" target=\"_blank\" rel=\"noopener\">remains opposed to recreational cannabis legalization<\/a>, and he reiterated that position just last month.<\/p>\n<p>\u201cWe spend all this time and money to get people to stop smoking cigarettes and now we want to say it\u2019s okay to just smoke marijuana recreationally,\u201d Carney\u00a0said. \u201cLook, I don\u2019t want to sound like a prude about it, I just don\u2019t think it\u2019s a good idea.\u201d<\/p>\n<p>He declined to say whether he would sign or veto the bill, but called it a \u201cbad idea.\u201d<\/p>\n<p>A legalization bill previously\u00a0<a href=\"https:\/\/www.marijuanamoment.net\/majority-of-delaware-lawmakers-approve-marijuana-legalization-bill-but-it-fails\/\" target=\"_blank\" rel=\"noopener\">received majority support on the House floor in 2018<\/a>, but it failed to receive the supermajority needed to pass.<\/p>\n<p>Despite his wariness about adult-use legalization, Carney did sign two pieces of marijuana expungement legislation in recent years.
